DNI Ratcliffe Releases New Batch of Spygate Docs to DOJ Following Trump Tweetstorm Urging Agencies to Act Swiftly

DNI John Ratcliffe approved the release of a new batch of Spygate documents to the Justice Department for John Durham’s review, according to sources who spoke to Axios editor Jonathan Swan.

US Attorney from Connecticut John Durham was appointed by US Attorney General Bill Barr last year to investigate the origins of Spygate.

“At my direction, the Office of the Director of National Intelligence has provided almost 1,000 pages of materials to the Department of Justice in response to Mr. Durham’s document request, including a new batch that Justice Department lawyers are now able to view immediately.” Ratcliffe told Axios.

Director of National Intelligence John Ratcliffe has approved the release to the Department of Justice of a large binder full of documents to assist a review of the Obama administration’s handling of the Trump-Russia investigation, according to a source with direct knowledge of the materials and confirmed by Ratcliffe.

“I will continue to ensure the Intelligence Community’s responsiveness to the DOJ’s requests. We also look forward to supporting the DOJ in further declassifications consistent with their investigation.”

DNI John Ratcliffe declassified documents on Tuesday revealing former CIA Director John Brennan briefed Barack Obama on Hillary Clinton’s plot to ‘stir up’ a scandal to tie Trump to Russia in order to distract from her email scandal ahead of the 2016 election.

This declassification comes after Ratcliffe released a Russian intel assessment in which he asserted that Hillary Clinton hatched the Russia hoax in order to pin the DNC ‘hacking’ on President Trump.

“In late July 2016, US intelligence agencies obtained insight into Russian intelligence analysis alleging that US Presidential candidate Hillary Clinton had approved a campaign plan to stir up a scandal against US Presidential candidate Donald Trump by tying him to Putin and the Russians’ hacking of the DNC. The IC does not know the accuracy of this allegation of the extent to which the Russian intelligence analysis may reflect exaggerations or fabrication,” Ratcliffe wrote to Lindsey Graham.

The Obama-Biden White House was briefed on it by then-CIA Director John Brennan.

President Trump fired off another tweet on Wednesday accusing Obama, Hillary and Biden of leading a “treasonous plot.”

An email release in June 2020 revealed that dirty cop Peter Strzok from Obama and Comey’s FBI is the one who identified using the Logan Act for the crime to pin on General Michael Flynn.

We reported earlier in June that the Justice Department released Peter Strzok notes from January 4th, 2017 regarding the Flynn-Kislyak calls.

Strzok also noted that Obama DIRECTLY ordered an investigation into Flynn, saying “Have the right people on the case.”

Then-FBI Director James Comey said the calls between Flynn and Kislyak “appear legit” but they went ahead with the hit job against Flynn anyway.

“Strzok’s notes believed to be of January 4, 2017, reveal that former President Obama, James Comey, Sally Yates, Joe Biden and apparently Susan Rice discussed the transcripts of Flynn’s calls and how to proceed against him.”

“Mr. Obama himself directed that “the right people” investigate General Flynn.”

It was Joe Biden who brought up the Logan Act to go after General Flynn.

Dem Sen. Coons: Amy Coney Barrett ‘Even More Conservative Than Justice Scalia’ — ‘Qualified as a Judge’

Wednesday on MSNBC’s “Morning Joe,” despite taking issue with the timing of the confirmation process for Seventh Circuit U.S. Court of Appeals Judge Amy Coney Barrett, Sen. Chris Coons (D-DE) acknowledged the pick was “qualified as a judge” for the nomination.

“We should not be racing ahead with this partisan process,” Coon declared. “There is no precedent in our nation’s history for the Senate holding a confirmation hearing for a Supreme Court nominee this close, just 27 days, before a presidential election where people are already voting in more than half the states.”

The Delaware U.S. Senator described Barrett as “even more conservative” than former Justice Antonin Scalia.

“I’ve been reading her opinions and law review articles, and I’m increasingly convinced that she’s even more conservative than Justice Scalia for whom she clerked on the Supreme Court, and she has demonstrated a willingness to reverse long-settled precedent,” he added, saying the confirmation hearings should be delayed until after the presidential election.

“So you disagree with Judge Barrett on major policy issues, obviously, but do you think she’s qualified as a judge?” MSNBC’s Willie Geist asked.

“I think she is qualified as a judge,” Coons replied. “I think she’s going to be an engaging candidate.

“But, frankly, what matters here is not whether she’s taught at a well-regarded law school or whether she answers questions well,” he added. “What matters is her judicial philosophy, how she will change the balance on the court, and what the consequences will be for tens or hundreds of millions of Americans.”

IRS Investigated For Warrantless Location Tracking Of Americans

Following Ron Wyden and Elizabeth Warren's request for the Treasury Department watchdog to investigate the IRS' use of smartphone location data to track ordinary Americans without a court warrant, Motherboard has obtained a letter from the head of the watchdog committee that specifies a formal investigation is underway.

Treasury Inspector General for Tax Administration J. Russel George said in the letter he would examine the IRS' use of a commercial database containing millions of U.S. cellphone locations. The data was used to conduct warrantless surveillance of Americans.

"We are going to conduct a review of this matter, and we are in the process of contacting the CI [Criminal Investigation] division about this review," the letter, signed by J. Russell George, the Inspector General, and addressed to the Senators, reads. CI has a broad mandate to investigate abusive tax schemes, bankruptcy fraud, identity theft, and many more similar crimes. Wyden's office provided Motherboard with a copy of the letter on Tuesday.

Between 2017 and 2018, the IRS purchased a subscription to the commercial database from a government contractor called Venntel. The IRS used the location data, derived mainly from smartphone apps, to identify and track individual criminal suspects.

We noted, in August, there are a handful of government contractors tracking hundreds of millions of mobile phones around the world. Many were pulling location data from over 500 apps.

A former Venntel employee, recently spoke with Motherboard under cover of anonymity, which said Venntel's database allows users to track devices and see where they have been.

"If you search a certain house, you're only going to get three or four different signals out of there. I think from that standpoint, you could definitely try and identify specific people," the source said. "I think that was part of the goal in using it for government customers and things like that, is that you're able to identify devices, and then you can do device searches to see where else they might have been."

Requiring a warrant as demanded by the Fourth Amendment is needed, as per a landmark opinion via the Supreme Court in Carpenter v. the United States that protects phone location information. As to legal justification behind the IRS' warrantless surveillance of Americans, well, that remains unclear.

The Inspector-General also said it would investigate the legal argument used:

"You requested that TIGTA investigate CI's use of commercial databases in the performance of its duties, and that TIGTA examine the legal analysis IRS lawyers performed to authorize this practice. Your concern is that CI's use of the data described above may not be consistent with the holding of the Supreme Court in the case Carpenter v. the United States," the Inspector General's letter continues, referring to the Treasury Inspector General for Tax Administration.

Now we wait for the legal justification behind the IRS' warrantless surveillance of Americans.

As Election 2020 Voting Under Way, Swing-State Mail-In-Voting Proving Disastrous

Legislators in swing states, including Michigan and Pennsylvania, have pushed to change state laws to allow early voting, which includes opening ballot envelopes for verification and preparing them for eventual counting, by November 3, but with varying and as yet undetermined success.

Bucks County, Pennsylvania, Commissioner Gene DiGirolamo wrote in an opinion piece in September for the Courier Times: "Regardless of political affiliation, no one wants to have a situation where election results are not determined until weeks or even months later. We need legislation to become law that allows counties to pre-check.

Republican DiGirolamo warned that pre-checking is the only way to avoid a delay that will hurt everyone later. In the Pennsylvania primary, for example, more people voted by mail than voted in person. He later wrote: "If we are not given the authority to do this, we will be forced to face a man-made disaster, one that could easily be avoided if our legislature and our governor worked together.

According to the local Fox43 channel, the Pennsylvania County Commissioners Association (CCAP) has asked Harrisburg legislators to allow pre-voting three days before the election. A Republican-backed bill would allow early voting, although it is currently being thwarted by Democrats, who claim that the bill includes other measures, such as mailbox restrictions for ballots sent through the mail.

In the meantime, CCAP is waiting for the state legislature to consider a bill that only addresses the pre-survey. Association President Jeff Snyder has commented to Fox43: "Without the possibility of a pre-voter survey on Election Day, it may take days or even weeks before the final election results are known.

For its part, the state of Michigan has made further progress on pre-election. The state legislature, led by Republicans, passed a bill that allows calls for the state to begin pre-election on the day before the election. The Detroit Free Press reported that it is still awaiting the signature of Democratic Governor Gretchen Whitmer.

Michigan Secretary of State Jocelyn Benson has said in the past month that she supports the bill, however, she wishes she had more time to conduct the pre-election poll. Benson said in a statement that while a recommendation called for seven days for pre-screening, the bill gives workers only ten hours.

Finally, Benson closed by saying, "Senate Bill 757 is a step in the right direction, but does not go far enough to provide the relief that the secretaries have been seeking for more than a year. I support the small step forward because I know that at this point the secretaries will receive any legislative assistance. But the bill falls far short of what our secretaries and voters deserve.

Cal Cunningham Threatens to Unseat John Edwards As North Carolina’s Horniest Democrat

Cal Cunningham, the Democratic Party's controversial nominee for Senate in North Carolina, is threatening to unseat disgraced former Sen. John Edwards (D., N.C.) as the horniest Democrat in the history of the Tar Heel State.

Cunningham, a married father of two, has gone into hiding since becoming embroiled in an extramarital sex scandal that has grown increasingly problematic with each passing day as new information comes to light. On Tuesday, for example, the Associated Press spoke to one of Cunningham's alleged mistresses, Arlene Guzman Todd, who confirmed that the two had "weird" sexual relations in Cunningham's home in North Carolina.

Guzman Todd, who is herself married, also confirmed the authenticity of text messages in which she acknowledged having "naked photos" of the Senate candidate in her possession. The text exchanges, between Guzman Todd and an unnamed friend, reveal that the secret lovers were in contact as recently as August, when Guzman Todd said she wished Cunningham a happy birthday. "I want to unwrap you today," the candidate responded.

According to the texts, Guzman Todd was growing frustrated with her relationship with Cunningham, whom she described as "not even cute enough for me" and not deserving of her "p—y." She also described "trying to make plans to see the politician so I can give him the f— of his life and then walk away."

Guzman Todd, who is married to Army Sergeant Jeremy Todd, said the affair with Cunningham, an officer in the Army Reserve, occurred "during a period of marital separation," and apologized for her "lapse in judgment." The U.S. military considers adultery to be "unacceptable conduct" that could be "service discrediting." On Wednesday, the Army Reserve said it had opened an investigation into Cunningham, who has frequently invoked his service in an effort to portray himself as the "integrity" candidate.

Cunningham has dropped off the map since last Friday, when he issued a statement apologizing for having "hurt my family" and urging the media to respect his "privacy." He has declined interviews with local media outlets, and canceled an appearance at a town hall event on Monday. Cunningham is scheduled to appear Wednesday at a virtual fundraiser with Sen. Tammy Duckworth (D., Ill.).

Cunningham's opponent, Sen. The newspaper's editors on Tuesday urged Cunningham to break his silence and "explain himself."

The candidate finally broke his silence on Wednesday when a local reporter spotted Cunningham out in public, but the Democrat declined to elaborate on his infidelity. "Look, I've made it clear that I've hurt my family, and that I've disappointed my supporters," Cunningham said. "This campaign isn't about my personal life, it's about the people of North Carolina."

Wearing face masks outdoors now mandatory all over Italy

Italy on Wednesday imposed mandatory face-mask wearing outdoors across the country, in an effort to reduce coronavirus infections.

The cabinet agreed on the measure, which makes the wearing of face masks outdoors mandatory, amid a steady increase in new cases in the last two months, the health ministry said.

The decree will probably be effective from Thursday, and ministers have also approved a move to extend the Covid-19 state of emergency to January 31, a cabinet source was quoted as saying.

On October 3, wearing masks outdoors became obligatory in Rome and the Lazio region, amid a rise in new cases. The previous day, Italian PM Giuseppe Conte said that a similar nationwide move would be “evaluated.”

In the Lazio region, which includes the capital, Rome, those who fail to comply with the new restrictions will be fined up to €400. Wearing masks there is also compulsory indoors in public places, at all times.

Masks are already obligatory outdoors in Campania, Calabria, and Sicily, as well as some Italian cities, including Foggia and the historic center of Genoa.

Italy imposed a rigid lockdown between March and May. The country reported an average of more than 2,400 infections daily in the past week, according to a Reuters tally.
