DOD Announces $600 Million for 5G Experimentation and Testing at Five Installations

Today, the Department of Defense announced $600 million in awards for 5G experimentation and testing at five U.S. military test sites, representing the largest full-scale 5G tests for dual-use applications in the world. Each installation will partner military Services, industry leaders, and academic experts to advance the Department’s 5G capabilities. Projects will include piloting 5G-enabled augmented/virtual reality for mission planning and training, testing 5G-enabled Smart Warehouses, and evaluating 5G technologies to enhance distributed command and control.

The Department of Defense has published a new Data Strategy focused on accelerating the Department’s transition to a data-centric organization that uses data at speed and scale for operational advantage and increased efficiency. The Strategy emphasizes managing data as a strategic resource, highlighting the criticality of data to build and maintain battlefield advantage, and the need to treat information systems on par with the priority given to weapon systems.

DOD Chief Information Officer Dana Deasy stated, “Data is the ammunition in the Digital Modernization Strategy and is increasingly central to warfighter advantage on and off the battlefield. The National Defense Strategy directed us to be more lethal, efficient, and interoperable with partners. This strategy is our first step to making that ammo persistently available to the men and women of the DOD regardless of echelon or geographic location.”

When Spirk was appointed as the Chief Data Officer for DOD, he noted how the Data Strategy will support operational data needs. “The Honorable Mr. Deasy gave me clear guidance to focus early efforts on data for joint warfighting. The Strategy’s emphasis will allow us to concentrate on that. It reinforces DOD’s priority focus areas of joint warfighting, senior leader decision support, and data analytics”

Implementing the Data Strategy will require an automated orchestration of numerous data pipelines (e.g., discovery, ingestion, preparation, storage, processing, exposure / dissemination) in order to facilitate trusted and reproducible machine-to-machine data exchanges. In close partnership with the Military Department and Joint Staff CDOs, Spirk will map and build an even larger community of data leaders, via a deliberately expanded DOD Data Council that brings in the Combatant Commands and Department Agencies and Field Activities. This empowered enterprise-wide team of DOD data leaders will work together to operationalize the objectives under the Data Strategy’s seven goals of making data visible, accessible, understandable, linked, trustworthy, interoperable, and secure.

Deasy added, “The principal challenge in the Data Strategy isn’t getting data; the Department has access to vast data reserves, but we need to build the engine to turn this resource into insight for our service members at the speed of need. The Digital Modernization program is doing just that, via our investments in cloud, A.I., C3 modernization, and cyber.”

Continuation of the National Emergency With Respect to the Situation In and In Relation to Syria

On October 14, 2019, by Executive Order 13894, I declared a national emergency pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701-1706) to deal with the unusual and extraordinary threat to the national security and foreign policy of the United States constituted by the situation in and in relation to Syria.

The situation in and in relation to Syria, and in particular the actions by the Government of Turkey to conduct a military offensive into northeast Syria, undermines the campaign to defeat the Islamic State of Iraq and Syria, or ISIS, endangers civilians, and further threatens to undermine the peace, security, and stability in the region, and continues to pose an unusual and extraordinary threat to the national security and foreign policy of the United States. For this reason, the national emergency declared on October 14, 2019, must continue in effect beyond October 14, 2020. Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I am continuing for 1 year the national emergency declared in Executive Order 13894 with respect to the situation in and in relation to Syria.

Department of Homeland Security Releases Homeland Threat Assessment

Washington, D.C. – Acting Secretary of Homeland Security Chad F. Wolf released the Department of Homeland Security’s (DHS) Homeland Threat Assessment (HTA). This first-of-its-kind report synthesizes threat information across DHS including intelligence and operational components.

“This HTA is as close as the American people will get to seeing and understanding the information that I see as Acting Secretary and that our employees see in their national security missions. As you read through the HTA you should have faith in knowing that these threats were identified using the best intelligence, operational information, and employee knowledge available to the Department,” said Acting Secretary Chad F. Wolf. “When the American people read this HTA they will be more aware of the traditional threats facing the Homeland like terrorism and organized crime. However, I think they will also realize that we face a significant threat in the Homeland from nation-states like China, Russia, and Iran.”

On November 15, 2019, the U.S. Supreme Court agreed to hear United States v. Briggs and United States v. Collins as consolidated cases.[8]

In 2014, a general court-martial convicted Michael Briggs of one charge of rape in violation of Article 120(a), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 920 for an event that occurred in 2005.[9] Briggs appealed to the United States Air Force Court of Criminal Appeals, seeking to file a supplemental assignment of error asserting that the statute of limitations had expired, along with unrelated assignments of error. The Air Force Criminal Court of Appeals denied leave to file on the basis that Briggs had not raised the statute of limitations during the trial, rejected the other assignments of error, and affirmed the trial court findings and sentence.[6]

Briggs filed a petition for grant of review with the Court of Appeals for the Armed Forces. The court granted review of one assignment of error filing concerning the lower court's judicial composition, denied review of an assignment of error filing stating that Briggs' counsel failed to raise the statute of limitations, and affirmed the decision of the Air Force Criminal Court of Appeals. Briggs appealed to the Supreme Court of the United States on a writ of certiorari regarding the judicial composition issue. The Supreme Court initially denied the petition. Upon reconsideration, the Supreme Court granted the petition, vacated the Court of Appeals for the Armed Forces' judgment affirming the Air Force Criminal Court of Appeals' decision, and remanded the case to the Court of Appeals for the Armed Forces for further consideration. On remand, the Court of Appeals for the Armed Forces reversed the decision, dismissed the charge, and vacated the sentence. The United States of America appealed the decision to the Supreme Court on a writ of certiorari.[6]

Similarly, in United States v. Collins, Richard Collins was found guilty of rape in violation of Article 120(a), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 920. On appeal, Collins asserted that the statute of limitations had expired, and the Court of Appeals for the Armed Forces dismissed the charge and vacated the sentence.[7]
