EU lawfag here, looking for a US lawfag to comment on this California woman's video about 18 U.S.C. 1038.

She claims that this federal law provides for a penalty of life in prison for anyone who disseminates false information relating to biological hazards and conducts hoaxes.

 

Her point is that prisons should be full of politicians, and I would add journalists and government-paid scientists, because of virus misinformation.

 

BUT even without knowing US law, I can see that she repeatedly confuses civil penalties with criminal ones. Sounds like she means well but is definitely not a lawyer herself.

 

Is this something worthwhile for American anons to pursue? Or is it legally inapplicable to the virus-hype scenarios she describes? Thank you
