There is some 1A jurisprudence concerning quasi-agencies of government. If it could be demonstrated that Lifelog code or other intellectual property changed hands, there’s a case to be made that a “private company” is actually a crypto-governmental body subject to 1A. That there’s clearly an intent to deceive the public and circumvent 1A application would be an aggravating factor for a court to weigh. A similar argument could be constructed for several big tech entities spun out of DARPA in part and then funded by “government” venture capital (In-Q-Tel, etc).
I’m not aware of any state in which a previously submitted and registered mail-in ballot can be withdrawn in favor of a subsequent in-person vote. Are you?

If the idea originated within DARPA and was developed for some years before being laundered into the commercial arena, no partnership or incubator argument could be sustained. The cases I’m most interested in are those where the populace was the target, not secret weapons programs etc. That tech was spun out precisely so that would not be perceived as a government surveillance program - hence the Facebook/Zuckerborg narrative b/s. These cynical deep state maneuvers should not go “unpunished” - placing the likes of FB within the ambit of 1A would feel a little like justice.
