Federal court rules Texas doesn’t have to notify voters whose ballots are tossed
Texas elections officials will not have to notify voters when their ballots are rejected over a signature mismatch issue, after a federal appellate court intervened and temporarily halted a U.S. district judge’s ruling requiring notification.
A three-judge panel of the Fifth Circuit Court of Appeals ruled Monday — after more than 4 million Texans have already voted — that the state was likely to succeed on the merits of its argument that Texas’s signature-verification procedures are constitutional and necessary to prevent voter fraud. The panel comprised Judges Patrick Higginbotham, Jerry Smith and Andrew Oldham, all three appointed by Republican presidents.
