Associate Justice of the Supreme Court, while continuing to serve in a senior status, as provided in 28 U.S.C 371 (b).

greater than the amount of work involving courtroom participation which an average judge in active service would perform in three months. In

 

the instance of a justice or judge who has sat on both district courts and courts of appeals, the caseload of appellate work and trial work

 

shall be determined separately and the results of those determinations added together for purposes of this paragraph.

Federal law permits a retired Justice to continue service in the lower federal judiciary, and most retired Justices do that on an appeals

 

court rather than the federal trial courts, known as district courts. Retired Justices do not become regular members of an appeals court;

 

they go on temporary assignments, made by Chief Justice John G. Roberts, Jr., as part of his duties as the head of the federal court system.

 

John Glover Roberts Jr. is an American attorney serving as the 17th and current Chief Justice of the United States, since 2005. He was

 

nominated by President George W. Bush after the death of Chief Justice William Rehnquist, and has been described as having a conservative

 

judicial philosophy in his jurisprudence.
