If a cop finds a diary, and the author admits in detail to committing a crime, that diary is not admissible in court without a warrant.

To obtain a warrant, one needs probable cause that a crime has been committed, otherwise it's the "fruit of a poisonous tree."

However, if the ACT of WRITING the diary is a crime, then all the crimes therein can be subject to jurisprudence.

 

Q… correct us if we're wrong, but we should be able to prosecute ALL crimes committed from the INITIAL crime of having an ILLEGAL server(s) correct??

 

Example; The police chase a bank robber to his house and find a dead body. The suspect can be charged for BOTH crimes even though the cops were only after him for the bank robbery.
