Cruz was born in Canada. Naturalized by law, see Rogers v. Bellei. Father was a Cuban. Ted is a Cubanadian at birth. As much right to Cuban citizenship as US.

 

Obama dual citizen at birth. Father could have taken him to UK. Congress doesn't heed the constitution beyond lip service.

Congress ignores all the citizenship stuff. Part of globalization, we are all citizens of the world. It is beyond question, anybody who runs is qualified.

Naturalization act created a legal fiction, "shall be considered as" is legal language that creates a legal fiction. See regulations today that say a 26 year old "shall be considered as" as child. Child in fact? No. Legal fiction? Yes.

 

No matter. Congress will accept anybody. The citizenship qualification is not functional, in fact. Much of the constitutional limits on fedgov are not fuctional in fact. Feds have usurped power, and there is nothing you can do about it.

You are the one conflating. So was 1795 Naturalization act. My take is "not born in US, not a natural born citizen", period. Your take is if there is a statute that make foreign born a citizen at birth, then that person is natural born citizen. That was Cruz's argument. See Rogers v. Bellei (1970's case) for the current legal standard, not that it will be applied.
