If she goes back before a decision, it will add weeks or months for the DC circuit to rule. Also, keep in mind the DC circuit is heavily D leaning (I believe 7 - 3).
She will appeal once he rules if he doesn’t drop the case. Judging by the en banc decision, the DC circuit will be very annoyed if he doesn’t dismiss the case.
