Trump campaign expands lawsuits in strategy rooted in Constitution's voting law authority

Trump has assembled a high-powered legal team to combat what it says is executive and judicial overreach in key battleground states led by Democratic governors.

As the Trump campaign expands its lawsuits — including new filings Wednesday in Georgia and Pennsylvania — legal scholars say they are likely rooted in the Constitution's voting law authority, which limits the power of non-legislative actors trying to assert their power over balloting.

Trump has assembled a high-powered legal team to combat what it says is executive and judicial overreach in key battleground states led by Democratic governors. The Elections Clause of the Constitution (Article I, Section 4) gives state legislatures the authority to set the time, place and manner of federal elections, i.e., the rules governing the election process, including absentee ballots. Republicans say this legislative power has been eroded by both executive and judicial mission creep.

In Wisconsin, for example, the Governor, Tony Evers is a Democrat, but both chambers of the legislature are held by Republicans. The Trump campaign has filed for a recount in the Badger State amid a razor-thin lead held by rival Joe Biden. The Supreme Court late last month rejected Democrats' request to extend the deadline for counting mail-in ballots in Wisconsin beyond Election Day because of coronavirus concerns.

The GOP and the Trump campaign also announced Wednesday they are suing Pennsylvania, claiming the extension of a voter ID deadline is in violation of state law. The Keystone State has a Democratic governor, Tom Wolf, and a state supreme court with a majority of partisan, elected justices — five of its seven judges were Democrats upon their first election. The court recently ruled against Republicans and allowed Pennsylvania to accept ballots received up until 3 days after Election Day.

The U.S. Supreme Court declined to hear a challenge to that ruling, letting it stand for now with a 4-4 ruling, prior to Justice Amy Coney Barrett's seating. Republicans brought the case up to the high court a second time after Barrett's seating and were again denied a hearing on the case prior to Election Day (Barrett did not vote on that ruling, saying she hadn't had time to review the case). Republicans say a third try might see a different outcome, if the court agrees to hear the case in an emergency situation like the current electoral uncertainty.

Conservative activists filed a lawsuit on Election Day against the Pennsylvania state secretary alleging that a last-minute rule change to the state's ballot-counting process is privileging some voters over others and potentially slanting the outcome of the election.

On Wednesday, Trump's team also filed a lawsuit in Georgia, where a GOP poll observer saw 53 late absentee ballots "illegally added to a stack of on-time absentee ballots in Chatham County," said Deputy Campaign Manager and Senior Counsel Justin Clark. "We will not allow Democrat election officials to steal this election."

US Military Took Cyber Action Against ‘Adversaries’ Before Election

FBI, Military, and CIA have been launching offensive cyber attacks

With all of the controversy surrounding election day, one claim not being made so far is that of foreign interference from countries like Russia, China, or Iran. US officials are claiming they thwarted foreign interference in the election by going on the offensive.

US Cyber Command Chief Gen. Paul Nakasone issued a statement late Tuesday night that said the US took action against “adversaries” to prevent election interference.

“I’m confident the actions we’ve taken against adversaries over the past several weeks and months have ensured they’re not going to interfere in our elections,” Nakasone said. “When it comes to those who threaten our democratic processes, we are equal opportunity disruptors.”

Anonymous officials told The Washington Post that the US undertook a cyber operation within the last two weeks against Iran. In October, US officials claimed Iran was behind a few hundred threatening emails sent to voters in Florida, Alaska, and Arizona.

Director of National Intelligence John Ratcliffe also claimed Iran and Russia obtained voter registration data used to send the emails. But officials from the three states targeted by the emails said their voter databases had not been compromised, suggesting that any data that had been obtained was public information.

US intelligence agencies claiming cyber attacks from so-called adversary nations has become a regular occurrence. But locating the source of cyber activity and hacks is difficult, and the agencies rarely offer evidence to back up their claims.

The Iranian email scheme was attributed to Iran within 27 hours, which is the fastest attribution in history, according to The Washington Post. Trying to explain the quick attribution, anonymous officials told Reuters that the hackers made a “dumb mistake” that revealed their IP address.

For their part, Iran denied being responsible for the email scheme and summoned a Swiss envoy to voice their objection to the US. Since Washington and Tehran have no diplomatic ties, Switzerland acts as a mediator between the two countries.

California votes to return voting rights to felons on parole

California voters on Tuesday approved a ballot initiative restoring voting rights to Golden State parolees.

In its current form, the state Constitution disenfranchises Californians with felony convictions who are still incarcerated or on parole. People on probation, in contrast, already have their right to vote enshrined in the state Constitution. The new measure, Proposition 17, will re-enfranchise about 50,000 people, according to the Los Angeles Times.

The measure won support from prominent California Democrats, including vice presidential nominee Sen. Kamala Harris and Assemblyman Kevin McCarty, who wrote the initiative. It passed with 59 percent of the vote, according to a projection by The New York Times.

“Prop. 17 gives Californians the chance to right a wrong and restore voting rights for a marginalized community and people of color,” McCarty said. “This is good for democracy and good for public safety.”

“Today, in California there are 50,000 women and men who have completed their state prison sentence, are reintegrating back into society, working jobs and paying taxes, but are denied the right to vote,” California Secretary of State Alex Padilla (D) said, according to the Los Angeles Times. “Yet research shows that in jurisdictions where voting rights are more easily restored, formerly incarcerated individuals re-offend at lower rates."

People incarcerated with felony convictions in California will still not be able to vote, unlike states like Vermont that allow incarcerated people to vote as well, although the state does allow Californians in county jails to vote.

In Unprecedented Move CDC Stops Tracking Influenza for 2020-21 Flu Season

I have been covering the fraud that happens every year with how the CDC tracks incidents and deaths due to the annual influenza for almost a decade now.

The numbers used each year to scare the public into getting the flu vaccine are based not on actual data, but estimates of number of people who die from the flu according to the CDC. Basically, anyone dying from “influenza-like” symptoms are all lumped together into supposed flu deaths each year. Autopsies are seldom performed to prove cause of death.

The CDC has admitted publicly in the past that these numbers are just “estimates.” If the real number of those infected with the influenza virus, and resulting deaths, were vastly lower than what the CDC reports based on their “estimates,” the public would have no way of knowing it.

So this has presented quite a dilemma for the CDC for the first couple of weeks of the 2020-21 flu season, which have just passed.

Because “flu-like” symptoms could also be attributed to COVID-19, and they have the now widely known ineffective COVID PCR test to back up these claims, which also kicks in federal funding for hospitals to treat COVID patients.

As one might expect, with the media widely reporting that cases of COVID are now increasing just as flu season starts, reports of flu cases have dropped dramatically during the same time period last year. Across the globe, it has been reported that incidents of influenza have dropped by about 100%. (Source.)

Whoops! How did the CDC allow these numbers to be published?

In an apparent response to media reports about the fast declining flu cases here at the beginning of the 2020-21 flu season, the CDC did what any corrupt agency would do which doesn’t want the public to know the truth: They decided to “suspend data collection for the 2020-21 influenza season.” (Source.)

U.S. News Technology Business Virus Outbreak San Francisco San Francisco voters approve taxes on CEOs, big businesses

In an effort to address economic disparity laid bare by the coronavirus pandemic, San Francisco voters overwhelmingly approved several tax measures targeting property owners and big businesses with CEOs paid far higher than their average workers.

Under the new law, any company whose top executive earns 100 times more than their average worker will pay an extra 0.1% surcharge on its annual business tax payment. If a CEO makes 200 times more than the average employee, the surcharge increases to 0.2%; 300 times gets a 0.3% surcharge and so on.

Voters also agreed to sweeping business tax changes that will lead to a higher tax rate for many tech companies, and a higher transfer tax on property sales valued between $10 million and $25 million.

“We’re not gonna shed any tears if penthouse dwellers have to cough up,” the San Francisco League of Pissed Off Voters wrote in its voter guide.

The results “show that San Franciscans are concerned about growing economic inequality,” city Supervisor Matt Haney, the author of the measure titled the “Overpaid Executive Tax,″ said Wednesday. “The very wealthy are gaining more and more. They’ve gotten much richer during the pandemic, while everyone else has remained stagnant.”

“We need the wealth that has been generated in the city to be shared more broadly with workers and residents,” he said.

Critics call the surcharge a blatant attempt at redistribution of wealth and criticized raising business taxes in the middle of a recession.

Since March, COVID-19 restrictions have shut down critical elements of San Francisco’s vibrant economy. Tourists are scarce, and legions of workers in tech and in the city’s main business and financial districts have left, able to work remotely from anywhere. Office vacancy rates went up while rents in the prohibitively expensive city dropped to their lowest in years.

Jeff Bezos, founder and CEO of e-commerce giant Amazon, has sold more than $3 billion worth of shares in his company this week, according to filings with the Securities and Exchange Commission.

The billionaire CEO has offloaded stock sales in the last year, selling more than $3.1 billion in August and $4.1 billion of Amazon shares in February. This week’s sales bring his total cash out this year to $10.2 billion, which is $8 billion more than his cash out in 2019. Bezos still owns shares worth $170 billion despite the recent sales, OpenInsider reported.

The Amazon CEO has sold nearly a fifth of the company’s shares since it went public 15 years ago. The retail giant’s stock is also up 75% this year and is worth over $1.6 trillion. He still holds more than 10% of the company.

Bezos’ wealth has also risen from $76.1 billion to $191 billion, with his net worth increasing by $10.5 billion on Wednesday, which is the most massive single-day increase recorded, Bloomberg reported.

Bezos has previously sold $1 billion of Amazon stock to fund Blue Origin. That startup hopes to develop rocket-powered technologies and vertical takeoff and landing vehicles for space travel.

The Amazon CEO also launched the $10 billion Bezos Earth Fund in February, an initiative that issues grants to scientists, activists and nonprofits who want to combat climate change.

“Climate change is the biggest threat to our planet,” Bezos has said.

The Bezos Earth Fund is expected to grant $100 million each to the Nature Conservancy, the Environmental Defense Fund, the Nature Resources Defense Council and the World Wildlife Fund, The Atlantic reported.

Sources also revealed that the World Resource Institute would be granted $100 million. The global organization is focused on researching renewable energy and helping cities grow more sustainably.

Bezos had also promised amounts between $10 million to $50 million to the Energy Foundation, the Union of Concerned Scientists, the ClimateWorks Foundation and the Rocky Mountain Institute.

GOP Observers Barred From Entering Philadelphia Vote Counting Center After Receiving Court Order – Philly Sheriff Not Enforcing Appellate Court Order

An appellate judge on Thursday morning handed the Trump campaign a win by allowing it to observe Pennsylvania officials count ballots.

“The media and the insiders is in the city, they’ve been trying to count Donald Trump out for years,” Trump campaign manager Bill Stepien told reporters on a call. “Donald Trump is alive and well.”

“We will win Pennsylvania. I have as much confidence today as I had yesterday. We also won a major victory in Pennsylvania this morning that helps ensure the transparency and openness that Pennsylvania deserves is held true,” he added.

However, Republican observers are barred from entering the Philadelphia vote counting center even after receiving the appellate court order.

The Philadelphia Sheriff is not enforcing the appellate court order, according to Corey Lewandowski who is on the ground in Philly.

This is a banana republic.

Pam Bondi said the counting machines were moved far away from observers, defying the court order allowing GOP observers to be no more than 6 feet away from officials counting ballots.

Democrats are FURIOUS that President Trump is fighting back after they have stolen the election from him on Tuesday night.

The president, whose Twitter comments Wednesday complained about Democratic challenger Joe Biden’s lead among mail-in ballots and claimed victory for himself in Pennsylvania, Georgia and North Carolina before counting was finished, has been spreading “pure disinformation,” Virginia Rep. Gerry Connolly said on the social media platform.

“Suspend his account, @Twitter,” Connolly wrote. “Valid votes are being counted. This is America, not Russia.”

Rhode Island’s Rep. David Cicilline said Trump’s Wednesday tweets were “a threat to our democracy.”

Trump: ‘If You Count The Legal Votes, I Easily Win The Election!’

President Donald Trump‘s press secretary Thursday afternoon tweeted out a statement from him in which he appears to discredit ballots that are still being counted and still arriving at election clerk offices, claiming that they are illegal and don’t help him win if they are counted.

The all-caps statement in the tweet from Press Sec. Kayleigh McEnany kept it brief.

“IF YOU COUNT THE LEGAL VOTES, I EASILY WIN THE ELECTION!” the president’s statement read. “IF YOU COUNT THE ILLEGAL AND LATE VOTES, THEY CAN STEAL THE ELECTION FROM US!”

While he gives no specific context to his statement, Trump is likely talking about ballots that arrive at election clerk offices late, even if postmarked on or before Election Day. He has routinely made claims that such ballots are illegal and shouldn’t be counted. His campaign has even filed lawsuits to halt the vote counts in Pennsylvania, Michigan, and Georgia, with such claims forming part of his team’s legal arguments alongside other claims of voter fraud. Some of these lawsuits have been struck down, however, such as the one in Georgia.

Many ballots are still arriving at counting centers and being counted, something which is legal to varying parameters between the states.

Votes are still being counted in many places because many states don’t allow election workers to count the ballots before Election Day, which created million-ballot backlogs of uncounted votes that had to be tallied on Election Day—on top of the votes cast in person on that day too. Additionally, these state laws allow such ballots to be counted if received by a certain date because the unprecedented amount of ballots sent through the mail are traveling slowly through the overwhelmed U.S. Postal Service, whose service has slowed down due to all of this.

No independent authority has declared an official winner of this presidential election yet, with millions of ballots left to be counted in states currently with paper-thin margins between President Trump and former Vice President Joe Biden.

Europe Arrests Hundreds of Suspected Human Traffickers

Authorities across Europe arrested nearly 400 suspected human traffickers in a series of joint actions that targeted child trafficking, Europol said on Wednesday.

The massive operation in early October brought together police, immigration and border control agencies, social assistance and child protection services, as well as labour inspectors from 12 countries.

Officers checked more than a thousand locations and questioned almost 60,000 people to arrest 388 suspects and identify 249 victims, including 61 confirmed minors while the ages of 107 victims have not yet been determined.

“Human traffickers target the most vulnerable groups and children are among them. Child trafficking remains, however, underreported,” Europol said.

In the EU, children are most commonly trafficked by relatives, while children from non-EU countries are brought in by people smugglers.

“These criminal organisations, connected through large clan networks, operate in several countries and move the children on a rotational basis,” Europol said. “They abuse them in sexual exploitation, forced begging and forced criminality schemes.”

U.S. Sentences Cyber Criminal to 8 Years for Theft of $100 Million

A Russian national was sentenced to eight years in prison for his role in an online scheme that was set to steal more than US$100 million through identity theft, according to a statement released by the U.S. Department of Justice.

Alexander Brovko, 36, pleaded guilty in February to conspiracy to commit bank and wire fraud. He was an active member of several online forums designed for Russian-speaking cybercriminals to gather and exchange their criminal tools and services, according to court documents.

From 2007 until 2019, the Russian national who had previously resided in the Czech Republic, monetized with other cybercriminals vast troves of data that had been stolen by “botnets,” or networks of infected computers.

He wrote code to parse the networks for valuable data, such as personally identifiable information and online banking credentials. Brovko also verified the validity of stolen account credentials, and even assessed whether they had enough funds to make it worthwhile to attempt to use them to conduct fraudulent transactions, Monday’s statement explained.

“Aleksandr Brovko used his programming skills to facilitate the large-scale theft and use of stolen personal and financial information, resulting in over $100 million in intended loss,” said U.S. Attorney G. Zachary Terwilliger for the Eastern District of Virginia.
