Complete Misunderstanding of the Constitution

 

The Colorado Legislature, in choosing to allot their Electoral College votes according to the national popular tally is not unconstitutional, nor does it "bypass" the Electoral College.

As to the latter, how does deciding how Colorado's Electors vote in the Electoral College "bypass" the Electoral College?

It simply is illogical to assert that they are bypassing the College.

 

As to the former, any anon can read the plain text of Article II, Section 1, Para 2:

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress;

 

In other words, the State Legislature has the sole power to determine how their Electors shall vote.

Let that sink in.

They are not bound, as per the WDN staff writer, to"cast the vote for President, based on the vote of the populace in the State."

 

Where in the Constitution does it say that the Electors shall cast their votes according to the vote of the populace in the State? Nowhere!

 

As an aside, the Colorado Legislature will end up with egg on their faces when they realize that the national popular tally is for Trump, and they'll be forced, by their own law, to vote for Trump in the Electoral College. Hoist on their own petard!
