In order to prove with watermarks etc which ballots are legit and which ones aren't, the Whitehats have to legally get their hands on the ballots in question first. This is done in the discovery portion of the miscounted ballot suits.
They can't just start scanning thousands or millions of ballots first, then take the results to court, because there is no legal reason to scan them in the first place without a court order.
