Legally speaking, sure, they could be culpable for participating in fraud if they knowingly declare victory on a fraudulent basis, but that only flies in court if there's proof that they know about the fraud.

 

Emails/texts/phone calls could be used as proof of such a thing if there's record of them talking about it. FISA goes both ways… Hmm…

 

I'd call it totally plausible, but I won't say likely just yet.
