Arizona, Michigan and Georgia all use election tabulation systems provided by a company called Dominion Voting. Dominion Voting was founded in 2003 by James Hoover and John Poulus. Dominion Voting initially developed the election tabulation software and licensed it to Smartmatic International Corp in October 2009. Part of the non-exclusive, worldwide licensing agreement was that Smartmatic was prohibited from "developing, marketing or selling Dominion Voting products in Canada and the US". In 2011, Dominion accused Smartmatic of violating that licensing agreement by attempting to bid on an open RFP for Puerto Rico. As a result, Dominion filed a lawsuit against Smartmatic.

Smartmatic is reported to have been created in either Florida and Venezuela in 2000, depending on the source. The current Chairman of Smartmatic's board is Peter Neffenger, who previously operated as the former head of the TSA (June 2015 - January 2017). It's unclear where or if Smartmatic has been used in the 2020 elections but there are reports that it was used entirely in the county of Los Angeles for the Primary elections. Smartmatic's previous Chairman, Mark Malloch-Brown, has operated as Vice-chairman for George Soros Investment Funds, Soros' Open Society Institute and Vice President of the World Bank.

There seems to be a direct connection between Dominion Voting, Smartmatic and Sequoia Voting Systems. Smartmatic acquired Sequoia Voting Systems in 2005 and stated on their website that they had "tripled” the company’s market share in the U.S. in less than a year". Due to US Committee on Foreign Investment in the United States (CFIUS) concerns about Sequoia's connection to Venezuela, Smartmatic sold Sequoia in 2007.

Dominion Voting was acquired by a private equity firm, Staple Street Capital, in July 2018. Staple Street Capital was formed in 2009 and since 2009, only 4 acquisitions have been made publicly available. Two acquisitions are industrial-related and two are tech related. The tech-related acquisitions are Dominion Voting and CyberlinkASP, a cloud provider of hosted applications such as Sage Accounting and Citrix VDI.

Kennard has served as General Counsel to the FCC (1993-1997) under Bill Clinton, as the Chairman of the FCC (1997-2001) and as an Ambassador to the EU under Obama (2009-2013). Prior to working for the FCC, he was a partner at Verner, Bernhard, McPherson and Hand (now DLA Piper). Kamala Harris' husband, Doug Emhoff, also worked for Piper DLA from 2017 to 2020.

Kennard was the Chairman of the FCC when the telcos promised Fiber connectivity, including the costs to upgrade their backend systems, to all US residents in exchange for being allowed to add surcharges to customer bills but ultimately, never delivered on the promise.
