California Judge Finds Newsom Lacked Authority for Mail Ballot Order

 

A California judge ruled on Friday that Gov. Gavin Newsom (D-CA) overstepped his authority when he signed an executive order earlier this year sending vote-by-mail ballots to every registered voter in the state.

 

Judge Sarah Heckman of the Sutter County Superior Court found the governor lacked the authority to amend or change existing elections law, even under the guise of an emergency. Heckman's ruling allows a permanent injunction to take effect against the governor, barring Newsom from using the California Emergency Services Act to change the law.

 

In her ruling, the judge called the case "a critically important one for the Judicial Branch to resolve" since the State of Emergency "continues in effect, indefinitely."

 

California Republican Assemblymen Kevin Kiley and James Gallagher, the two plaintiffs in the suit, issued a statement applauding the judge's decision.

 

"Today, the Court confirmed that Gavin Newsom does not rule California and that we are still a nation of laws," the assemblymen wrote. "California has not been well-served by one-man rule. A return to representative government will be best for public health and the economy. The Governor must accept this ruling as a fundamental principle of our democracy and govern himself accordingly."

 

Similar legal challenges are being waged in battleground states where other Democratic leaders made changes to the law in the run up to Election Day. Earlier this week, a Pennsylvania judge ordered segregated ballots to be excluded from vote tallies in the state, after finding Pennsylvania Secretary of State Kathy Boockvar lacked the "statutory authority" to change the law.

 

Gov. Newsom also came under fire this week after The San Francisco Chronicle revealed the governor attended a birthday celebration for a political advisor at the luxurious French Laundry restaurant in Napa Valley, defying his own coronavirus guidelines prohibiting Californians from attending such gatherings.

 

Gavin Newsom clearly thinks he's above the law.

Lindsey Graham fires back after top Democrat demands no more hearings for Trump’s judicial nominees

Sen. Lindsey Graham (R-S.C.), chairman of the Senate Judiciary Committee, fired off the perfect response after Democrat Sen. Dianne Feinstein (Calif.) asked Republicans to stop confirming President Donald Trump’s federal judiciary nominees.

What’s the background?

 

Feinstein, the top Democrat on the Senate Judiciary Committee, wrote Graham on Thursday requesting he stop conducting hearings on Trump’s judicial nominees to allow media-declared president-elect Joe Biden to fill the court vacancies instead.

 

“Now that the 2020 election has concluded, it is clear that the American people have overwhelmingly rejected a second term for President Trump. President-Elect Joe Biden and Vice President-Elect Kamala Harris are already implementing their transition plan,” Feinstein said.

 

“In light of that, it is imperative that the Judiciary Committee cease to process judicial nominations and allow President-Elect Biden the opportunity to appoint judges following his inauguration on January 20, 2021,” she added.

What was Graham’s response?

 

Graham responded with a resounding “no,” according to reporter Sam Brodey.

 

“The Senate Judiciary Committee will continue to process judges nominated by President Trump. We have confirmed over 220 and look forward to confirming even more,” Graham said.

What's the background?

 

In addition to having three Supreme Court nominees confirmed, Trump has added a whopping 53 judges to U.S. federal appeals courts and 164 judges to federal district courts.

 

Currently, an additional 31 of Trump's federal district nominees are awaiting confirmation, and another two of Trump's appeals court judges are awaiting confirmation.

 

This is why analysts predict that as much as $1 billion could be spent on Georgia's two runoff elections for their U.S. Senate seats, for control of the Senate hinges on those two races.

 

Currently, Republicans — who have held a majority in the Senate since regaining the majority after the 2014 midterms — have control of 50 seats. If they lost both runoff races, Democrats would have effective control of the Senate since media-declared vice president-elect Kamala Harris would serve as the Senate's tie-breaking vote.

 

But, if Republicans win just one of the races, they would maintain control of the Senate and prevent a Biden administration from implementing its agenda — and further cement Trump's judicial legacy.

Russia, North Korea Hackers Target COVID Vaccine Firms

 

As health officials scramble to put a COVID-19 vaccine on the market for widespread distribution, they are facing another unprecedented, terrifying challenge: hackers.

 

Russian and North Korean hackers have attempted to attack the American pharmaceutical firms working on developing a vaccine for the disease, Microsoft said Friday.

 

The tech mogul said it has detected cyberattacks in recent months against seven major companies “directly involved” in treatment research.

 

“It’s disturbing that these challenges have now merged as cyberattacks are being used to disrupt health care organizations fighting the pandemic,” Tom Burt, corporate vice president of customer security and trust said in a blog post.

 

He also urged governments to act on these “unconscionable” attacks.

 

Microsoft traced the hacks to a Russian group called “Strontium,” also known as “Fancy Bear” and two groups in North Korea that the company calls “Zinc” and “Cerium.”

 

These hackers targeted firms not only in the United States, but Canada, France, India and South Korea, most of which have coronavirus vaccines in “various stages of clinical trials,” according to the company. The attacks most recently used ransomware attacks to target hospitals and healthcare organizations.

 

“The majority of these attacks were blocked by security protections built into our products,” Burt said. “We’ve notified all organizations targeted, and where attacks have been successful, we’ve offered help.”

 

Microsoft explained that the Fancy Bear hackers attempted to break into people’s accounts by trying to log in thousands – or even millions – of times. Both of the North Korean groups used “spear-phishing” techniques, according to the company – Zinc sent messages containing fake job descriptions, while Cerium posed as representatives from the World Health Organization in emails.

 

This discovery comes at a crucial time, as the global race for a coronavirus vaccine grows more intense by the minute.

 

American drugmakers Pfizer and Moderna are both on track to seek emergency approval for their vaccine by the end of this month, according to the New York Post.

 

“”At a time when the world is united in wanting an end to the pandemic and anxiously awaiting the development of a safe and effective vaccine for Covid-19, it is essential for world leaders to unite around the security of our health care institutions and enforce the law against cyberattacks targeting those who endeavor to help us all,” Burt said.

When the incoming national security advisor General Flynn spoke to the Russian Ambassador, which was standard procedure for an incoming NSA, Joe Biden suggested the General be investigated for a Logan Act violation. The only reason to make such a suggestion was that he didn’t believe Trump was legitimately president-elect.

 

Hillary Clinton made a “concession” speech on the 2016 election night. Still, her actions and those of the Obama Administration, the DOJ, and the FBI demonstrated that her speech was only words. They refused to concede. Instead, they obstructed the approval of his cabinet picks, tried to obstruct his foreign policy, and created the Russia hoax. And after the Russia Hoax didn’t work, they created a fake Ukraine story because the party still didn’t believe Trump was fairly elected.

 

After President Trump submitted his cabinet picks, Senate minority leader Chuck Schumer led the Democrats in making slanderous accusations about people Trump sent to the Senate for confirmation, and Schumer “slow-walked” the nominations delaying cabinet approval votes even when he knew he couldn’t win.

China’s Xi Moved Too Soon, And Will Lose Power

 

If you read any book this year, let it be ‘The 100 Year Marathon‘, by Michael Pillsbury, where the author describes the long-term plan of the Chinese Communist Party (CCP) to conquer the West.

 

They almost succeeded.

 

History will write that one man stopped it – Donald J. Trump.

 

Pillsbury describes the strategy of the Chinese in their bid to take down America. He lays out the patience, the subterfuge, the deceit, the tactics of buying/blackmailing the target’s elites, bending them to Beijing’s will and using local politicians to enact the agenda of the CCP.

 

However, there is one part of the book that describes when an enemy hiding in your midst gives away his strategy, moves too soon, and is sent to the gallows. When an enemy asks ‘the weight of the emperor’s cauldrons’, he is asking how powerful is the king. There is only one reason to ask this question — you are telegraphing your treachery. You have moved too soon.

 

Xi Jinping has moved too soon, and China will pay a terrible price.

 

The CCP has been at work for decades to co-opt the America elite — look at the results. The corporate media, a majority of politicians national and local, Silicon Valley, the leadership of our Department of Defense, all are in bed with the agenda of the Chicom murderers. Many are just naive and stupid, or greedy, but many are fully on-board with the Chinese takeover of our great republic.

 

China even launched a bioweapon to soften America as the Trump economy roared at the end of 2019. The CCP lackeys in our Democrat-run state capitals worked with glee to lockdown the population for their Chinese overlords.

 

Then on November 3rd, the CCP delivered its hoped-for coup-de-grace, a full-on manipulated election to take down the only man standing in their way — the President of the United States.

The Chinese Communist Party is terrified of this outcome, but it is exactly what Xi will deliver.

Xi will lose power. He will be shown to have moved too soon, asked the weight of the emperor’s cauldrons. His plan to destroy America will crash and burn, as will his hold on power in China.

 

Perhaps we are asking too much for China to change, but at least their diabolical plans are now out in the open.

 

One question that needs answering is — a biological attack on America requires a nuclear response.

 

Once Trump is inaugurated, and he will be inaugurated for a second term, this is going to get interesting.

Report: Trump Has Elaborate Plan To 'Wreck' Fox News

 

A new report revives speculation from four years ago that Donald Trump might transition from politics to the media, but it adds a new spin.

 

This time, Axios writes, his goal is to take on and defeat Fox News.

 

In October 2016, when many believed Trump could not defeat Democrat Hillary Clinton in the presidential election, talk of what was labeled “Trump TV” flowed freely.

 

That talk is flowing again now that Democrat Joe Biden is leading in the presidential race and has been declared the projected winner by many news organizations. Trump’s campaign has launched a bevy of lawsuits to challenge the results in key states.

 

As Axios tells the story, Fox’s early call that Trump would lose Arizona when the state was still very much in play was the last straw for the president, who has become increasingly disenchanted with Fox’s coverage of his administration.

 

Axios quoted “a source with detailed knowledge of Trump’s intentions” as saying, “He plans to wreck Fox. No doubt about it.”

 

The source said the president is “going to spend a lot of time slamming Fox.”

 

Axios recalled past speculation about some form of “Trump TV” but noted that launching a cable network would be a costly, laborious undertaking.

 

Instead, the report said, the president “is considering a digital media channel that would stream online, which would be cheaper and quicker to start.”

 

How would it work? Axios took a guess.

 

“Trump’s digital offering would likely charge a monthly fee to MAGA fans. Many are Fox News viewers, and he’d aim to replace the network — and the $5.99-a-month Fox Nation streaming service, which has an 85% conversion rate from free trials to paid subscribers — as their top destination,” it said.

 

Trump has a vast database of supporter contacts as well as a loyal base who could be the foundation of any post-White House effort.

 

The president has signaled here and there that Fox has lost its luster in his eyes.

 

“Fox has changed a lot,” Trump said in a Nov. 3 phone interview with the network’s “Fox & Friends.” “Somebody said to me, ‘What’s the biggest difference between this and four years ago?’ And I say, ‘Fox. It’s much different.'”

 

“I’m not complaining — I’m just telling people,” he said. “It’s one of the biggest differences this season compared to last.”

 

In 2016, one commentator said Trump could launch a streaming service quickly, according to NBC.

 

“If he’s willing to launch with a limited slate, five, 10 hours of mostly just him, and the rest will come in the next six months, he can get that up in three, four months and just build from there,” Alan Wolk, an industry analyst, said.

 

Adding unscripted reality show programming and on-demand videos could serve as a bridge to more traditional programming, Wolk said.

 

“You can watch political stuff for free, his stuff with ads, and then a mix of political and reality programming. If he has access to the beauty pageant footage, some sort of reality thing,” Wolk said. “Those are down and dirty and he can get them up much earlier. Then he might have specials or movies he buys rights to.”

 

Some are hoping that rather than starting his own media empire after he leaves the White House, Trump will join an existing operation.

 

“Donald Trump was, is and always will be a ratings phenomena,” said Christopher Ruddy, CEO of Newsmax, according to the Los Angeles Times. “After the presidency, we’d welcome his new show on Newsmax in a heartbeat.”

Bay Area Food Bank Now Serves 500k Working-Poor As Demand "Doubles"

 

The virus pandemic is threatening another lost decade, similar to the Great Recession of 2007-2009, or even the Great Depression of the 1930s, for America's working poor.

 

Widespread permanent job loss and the collapse of small and medium-sized enterprises have become a severe risk to the broader recovery - as the economic fallout from the virus-induced downturn could linger for years.

 

Case in point, the San Francisco Bay Area has lost 350,000 jobs this year - leaving many households with food and housing insecurity problems ahead of the holiday season.

 

Local news station KQED offers a sobering reminder of the economic devastation left behind from the virus - and one that will likely continue to intensify as virus cases explode to new highs, forcing state officials to reimpose new social distancing restrictions.

 

KQED said, "food banks are racing to keep up with increased demand for food — and volunteers."

 

One of the top food banks in the state, called Second Harvest of Silicon Valley, has "literally doubled the amount of food we're distributing," said CEO Leslie Bacho.

 

Bacho continued: "We already serving a quarter-million people. Now we're serving a half million people."

 

She said many of the folks picking up care packages at food banks across the Bay Area are coming for the first time. "This is a testament to how the pandemic-induced economic crisis is disproportionately impacting low-wage workers," she added.

 

"We are seeing so many people who are already just living on the edge, having to then burn through their savings," Bacho said. "More than half the people we're serving now have never sought food assistance before."

 

Someone named "Gabriel" sent Second Harvest of Silicon Valley a donation of around $1,300 - the letter Gabriel received from the food bank outlines the dire situation playing out in the Bay Area.

 

With president-elect Joe Biden calling for 4 to 6-week lockdowns as coronavirus winter fast approaches, the jobless rate could soon start rising again as a double-dip recession could be nearing.

 

Despite trillions of dollars in stimulus, mainly for corporate elites and capital markets - the hundreds of thousands of San Franciscans depended on local area food banks is absolutely disturbing.

 

Readers may recall - Second Harvest has warned about nationwide food bank "meal shortages" by early Summer 2021.

Churches have replaced prayer with “smoke machines and coolness’

 

(OPINION) ETH – Bestselling author and founder of The A21 Campaign, Christine Caine has come out with a strong rebuke to the modern Church in what she is saying is placing its focus on being “cool” instead of holiness and warned that unless the Body of Christ returns to a focus on “righteousness, joy, and peace,” revival will never happen.

 

According to the Christian Post, Caine, recently participated in a 2020 Q&A: A Virtual Townhall event focused on the topics of prayer and revival alongside Pastor Jon Tyson and author Corey Russell. In the opening session, the Australian speaker and author discussed how the Church has gotten “so scared of emotionalism,” prayer has gone to the “basement with the grandmothers.”

 

“That’s where we’ve put it, and I’m on a campaign to pull prayer out of the basement and put it on the pulpit and put it front and center,” she declared. “We got a bit embarrassed because in our coolness, in between our skinny jeans and tattoos, beautiful light section and camera, we thought, ‘prayer is not cool, prayer is embarrassing. UC Santa Barbara now offers paid ‘Racial Justice Fellowships’

 

Engineering students can get money to study racism

 

The University of California Santa Barbara announced that it will offer paid “Racial Justice Fellowships” to four graduate students.

 

“The Racial Justice Fellowships will provide recipients $8,000 in summer funding for three years on top of a five-year package of full funding,” the public university said in its news release.

 

The school described it as “an initiative designed to enhance the recruitment of graduate students committed to teaching, research and mentorship around racial justice” and said it comes in “light of recent protests against police violence directed at Black communities and the persistence of systemic racism.”

 

A dean said that students could use the fellowships to start or continue research on topics such as “political anti-racist resistance.”

 

Leila Rupp, dean of the graduate school and a professor of feminist studies, said in the news release:

 

Students in a variety of disciplines are engaged in research that explores the historical roots or contemporary experiences of racism; the educational, environmental, health or economic disparities impacting Black, Indigenous and communities of color; cultural, social and political anti-racist resistance; and other ways in which systemic racism and responses to it have shaped and continue to shape human societies.

 

The school’s media relations office said in the news release that the program will “foster a more inclusive university community committed to racial justice.”

 

The opportunity does not just extend to the fields that would traditionally be associated with racial justice activism, such as education, sociology or political science, however.

 

It’s open to students in the environmental science graduate school, engineering school and for graduate students in the “Division of Mathematical, Life and Physical Science,” according to the statement from the public university.

 

The dean of the engineering department said the fellowships will help his colleagues and students embrace diversity and inclusiveness.

 

Dean Rod Alferness said in the school’s statement:

 

As a college, we hold inclusivity and diversity as core values, and we are committed to strengthening diversity in order to ensure that every individual feels welcome and an integral part of our college. We embrace and celebrate inclusion because a more diverse environment will provide new insight to solve society’s grand challenges.

“What a Mess!”: Charles Koch Regrets Funding the Tea Party Movement Because It May Have Fueled the Rise of Donald Trump

 

Libertarian “conservative” mega donor Charles Koch has expressed regret over funding the Tea Party movement. He claims that in addition to failing to reduce the national debt, it helped usher in an era of extreme partisanship that has culminated in the presidency of Donald Trump.

 

Koch expressed these sentiments in a forthcoming book co-written with Brian Hooks titled Believe in People: Bottom-Up Solutions for a Top-Down World.

 

“Boy, did we screw up!” Koch wrote. “What a mess!”

 

His and his late brother David’s decision to pour money into the Tea Party movement was because “we shared their concern about unsustainable government spending,” said Koch in an email to the Wall Street Journal. But now he regrets it because government spending has increased even more and, in his view, the Tea Party deepened the ideological divide between Democrats and Republicans.

 

In an effort to shed his “partisanship,” Koch is trying to work with Democrats on issues like immigration, criminal justice reform, and foreign policy—though he still does give overwhelmingly to Republicans.

 

The Wall Street Journal describes Koch’s book overall as “part mea culpa, part self-help guide and part road map toward a libertarian America. Along the way, the book traces Mr. Koch’s life from hardheaded adolescent to student, engineer, industrialist, tycoon and political mastermind. The book suggests that he wants to add one final act: philosopher and, he hopes, unifier.”
