You have to bring the RIGHT CASE at the trial court (Fed Dist or state court), lose on appeal at Cir Ct of Appeals (11 + D.C.Cir Ct.?), then politely, respectfully, ask it to grant a writ of certiorari. This is a request that the Supreme Court order a lower court to send up the record of the case for review. But on important constitutional crises cases, the Sup Ct will be looking for the petition to grant Writ and will grant it ASAP.
Oh hell, there's a quicker way as well, but I'm a tapped out.
