Apple Faces Lawsuit Over iPhone 'Tracking Software' That Targets Users With Ads

Stefano Rosetti, lawyer for NOYB (None of Your Business), said the group was suing Apple in national courts rather than under EU-wide GDPR regulations - fearing a lengthy legal fight like that between Irish regulators and Facebook's European division.

Internet privacy campaigners are suing tech giant Apple in two European countries for alleged illegal tracking of iPhone users' movements in order to target them with adverts.

The case is being brought in German and Spanish courts by Austrian digital rights group NOYB over Apple's use of the Identifier for Advertisers (IDFA) code feature on its devices to track user's movements and bombard them with "personalised" adverts based on that data.

"Apple's operating system creates the IDFA without user's knowledge or consent. After its creation, Apple and third parties (e.g. applications providers and advertisers) can access the IDFA to track users' behaviour, elaborate consumption preferences and provide personalised advertising," NOYB said in a statement.

The group argues that Apple's use of IDFA breaches European Union (EU) privacy regulations governing the use of cookies and other tracking features.

"EU law protects our devices from external tracking," NOYB privacy lawyer Stefano Rosetti said. "Tracking is only allowed if users explicitly consent to it. This very simple rule applies regardless of the tracking technology used."

"While Apple introduced functions in their browser to block cookies, it places similar codes in its phones, without any consent by the user. This is a clear breach of EU privacy laws," he added.

But Rossetti said the group was taking its case to national rather than Europe-wide courts, based on rules that predate the EU's 2018 General Data Protection Regulation (GDPR). He claimed that could yield faster results than recent attempts to use the GDPR to limit tech giants' data-gathering on users.

"These cases are based on the 'old' cookie law and do not trigger the cooperation mechanism of the GDPR," Rosetti said. "In other words, we are trying to avoid endless procedures like the ones we are facing in Ireland" where social media giant Facebook's European operations are based. The firm is locked in a legal battle there, and warned in September it would close its website to European users if Ireland's Data Protection Commission enforced GDPR rules against sending user's data back to its parent company in the US.

NOYB, founded in Vienna in 2017 by Max Schrems, takes its name from the acronym of 'none of your business'.

Biden Meets with Leadership of Union Under Fire for Corruption

Meeting comes as feds weigh oversight of UAW

President-elect Joe Biden met with United Auto Workers leaders Monday just hours after federal authorities moved to sentence an ex-union official to 34 months in jail in connection with a corruption probe.

Biden told a gathering of business and labor leaders that his administration would be in "lockstep" with them on reviving the economy after the coronavirus pandemic. The meeting between the Democrat and UAW leadership came the same day that federal prosecutors recommended a jail term of almost three years for former UAW vice president Joe Ashton, who received hundreds of thousands of dollars in kickbacks.

The federal corruption probe has also ensnared the UAW's last two presidents. A total of 14 top union officials pleaded guilty to or were convicted of accepting illegal gifts, misusing millions in union funds, or embezzlement. The probe found that former UAW president Dennis Williams, who served from 2014 to 2018, used union funds to pay for personal expenses. Federal prosecutors called for government oversight of the union to root out corruption.

A labor watchdog questioned whether Biden's meeting with current UAW president Rory Gamble could influence the decision to monitor the union's activities.

"The next administration should be just as committed to fixing what ails the UAW as the current one," Charlyce Bozzello, communications director for the Center for Union Facts, told the Washington Free Beacon. "That means Joe Biden needs to prioritize rank-and-file workers instead of cutting his political allies in union leadership a break."

The Biden campaign did not respond to a request for comment on the UAW's potential federal oversight.

When asked for comment on the meeting and what was discussed, a UAW spokesman referred the Free Beacon to a June statement about negotiations between Gamble and the U.S. attorney for the Eastern District of Michigan to reform the union's practices. The union declined to comment on the content of the meeting.

The union endorsed Biden's candidacy in April, touting Biden's support for unionization and collective bargaining rights. "UAW Members need a federal government that ensures that members have both a good job to go to, and that they come home to their families at night having earned a fair day’s wage in a safe and secure place," Gamble said in the statement. The union donated nearly $6 million to Democratic political causes in 2020.

The question of union influence has dogged Biden in the past. The Obama administration eased federal oversight of the Teamsters shortly after Obama and Biden arrived in the White House. The decision drew scrutiny, particularly because the Teamsters union was one of the first major labor groups to endorse Obama in the 2008 campaign. Bozzello said Biden owes it to rank-and-file auto workers to protect them against the perception of corruption.

"After two former union presidents and numerous other officials have pleaded guilty to helping embezzle hundreds of thousands of members' dues dollars, government oversight of the UAW may be the only way to reverse years of entrenched corruption at the union," Bozzello said.

Cop-Hating Portland Commissioner Apologizes For Her Behavior In a Lyft. Just Kidding, She Blamed 'White Supremacists'

This may come as a shock to you, dear reader, but cop-hating Portland City Commissioner Jo Ann Hardesty has failed to take responsibility for her awful behavior towards a Lyft driver.

I’ll give you a moment to recover.

Last week, it came to light that Hardesty had been verbally abusive to her Lyft driver on a trip home from ilani Casino Resort on November 1, to the point the driver canceled the ride and dropped her off at a gas station to order another Lyft. In response, Hardesty called 911.

Hardesty, facing mounting criticism for not addressing the situation, finally spoke during a Zoom meeting of the Portland City Council.

“I didn’t expect the Lyft driver to do it. Certainly didn’t expect the place to do it. It was my responsibility to make sure I got home safe and I did everything I could to get home safe. Where you’re living in a city where white supremist [sic] are proudly riding around in their big trucks with their flags. And you’re a black person. Does somebody wants to sit on the side of the road at night? Not going to happen.”

Remember, Hardesty became verbally abusive to her driver when she failed to show up at the designated pickup spot at the casino. The Lyft driver sacrificed over an hour of his time for no pay trying to accommodate her special needs. Hardesty insisted that the driver close the windows, in contradiction of Lyft’s COVID-19 recommendations for driver and rider safety.

As I wrote last week,

Lyft’s terms of service and local laws back up the statement that this is the driver’s personal vehicle, and he gets to set the rules. Apparently, Hardesty was initially set off because she was not at the designated pickup location that the casino sets up for rideshare pickups to avoid confusion and traffic. The driver called her to figure out where to pick her up, drove to her location, and started the ride. This, after a 25-minute pickup time after the driver dropped off his previous passenger.

The driver said Hardesty was abusive from the moment she got in the car. He told OregonLive,

Once in his car, Hardesty was perturbed that he had trouble finding her, he said. He grabbed his phone from the bindle on his dashboard and showed her where the pin drop indicated her location, but that didn’t seem to assuage her displeasure, he said.

“I just wanted to calm her down, make her understand that I’m not a rookie. I know what I’m doing. She didn’t want to hear any of that. She just wasn’t happy with that.”

As he started to drive out of the casino’s lot, Hardesty told him that he needed to roll up the windows, that she couldn’t ride with them down.

The car windows on the front driver’s side and front passenger’s side were cracked open to allow for air circulation as a safeguard due to the coronavirus pandemic, he said. According to Lyft’s website, the company’s new rules for the road during the pandemic recommend keeping the car windows open.

That set Hardesty off even worse. She demanded that the driver roll up the windows, COVID be damned. The driver says Hardesty went ballistic at this point.

Hardesty, not known for her gracious or humble personality, continues to refuse to take personal responsibility. Instead, she imagines white supremacist boogeymen around every corner.

Final note: Hardesty once again failed to take the opportunity to publicly thank the police officers who saved her from that nightmare ride.

On November 12, True the Vote announced that they had sued Michigan Governor Gretchen Whitmer to challenge illegal ballots cast in that state. In the press release, they said, “evidence exists to cast sufficient doubt on the current results of the presidential election in Michigan and seeks to invalidate the presidential election results in counties where illegal ballots and ballot-counting were so widespread that the overall results cannot be trusted.”

“One of the most fundamental rights that we as Americans possess is the right to vote,” said True the Vote Founder and President Catherine Engelbrecht. “It is a critical part of our freedom of speech, yet we are seeing that basic freedom silenced in states all across the country that refuse to implement adequately fair and secure elections – Michigan being one of the worst offenders. Every illegal vote that is counted dilutes the voting rights of law-abiding American citizens, and jeopardizes Americans’ trust in their electoral process. Enough is enough. True the Vote’s lawsuit will ensure that legal voters have their voices heard and their votes counted.”

In the announcement, True the Vote gives a long but partial list of evidence they have reviewed that led to the lawsuit:

A credentialed poll challenger was excluded from the absentee counting process, contrary to Michigan law. Additionally, it is alleged that absentee counting boards conducted counts without inspectors from each party being present and that challengers were denied access to video of ballot boxes, contrary to Michigan law.

Election officials in Wayne County refused to permit statutorily designated challengers to observe the conduct of the election and the processing of ballots. This included being denied meaningful opportunity to observe the counts; denial of access to the facility; denial of re-entry; lack of replacement of Republican challengers; social distancing enforced in a partisan manner; blocking by election officials; being forced to observe at unreasonable distances; windows being covered to prevent viewing; and intimidation, threatening, and harassment by election officials. Election officials also ignored and disregarded valid challenges.

Senate Republicans Say They'll Continue Hunter Biden Probe

Sens. Chuck Grassley (R-Iowa) and Ron Johnson (R-Wis.), who headed a Senate investigation into Joe Biden’s family dealings, signaled they will continue their investigations in 2021 after the new Congress is sworn in.

“I’m not going to turn a blind eye” to the recent developments in the investigation, Johnson told The Hill, which claimed there is “limited appetite” among Republicans for a renewal of the probe.

“Tony Bobulinski coming forward, the computer being revealed, the FBI possibly starting an investigation. We had a hard enough time getting what evidence we got to even write a report, and then all of a sudden our report sort of opened up this logjam,” said Johnson, the head of the Senate Homeland Security Committee.

He was making a reference to Hunter Biden and James Biden—Joe Biden’s son and brother—and their overseas business dealings that became the subject of scrutiny and big tech censorship last month.

“I’m very confident there are probably more financial transactions that will probably be revealed,” Johnson added to the outlet.

Both Grassley, the head of the Senate Finance Committee, and Johnson have been investigating the Bidens’ business, namely in reference to Hunter’s reportedly lucrative position on the board of Ukrainian gas company Burisma Holdings, which has been long suspected of corruption.

Last month, the New York Post and other news outlets reported on a laptop that allegedly belonged to Hunter Biden, which contained an email from a Burisma advisor that suggested Hunter was trying to set up a meeting for his father when he was the vice president. The Biden campaign denied the meeting ever took place but later qualified that it might have happened in an unofficial capacity.

Joe Biden on Thanksgiving Gatherings: 5 People, 10 Maximum ‘Socially Distanced, Wearing Masks’

Former Vice President Joe Biden suggested that Americans limit their gatherings on Thanksgiving and adhere to coronavirus protocols in their private residences, citing experts who, according to the former vice president, recommend gatherings of “five people, maximum ten people” who are “socially distanced, wearing masks.”

Biden, whom the media have declared president-elect, detailed his view on holiday gatherings during a Monday press conference in Wilmington, Delaware, urging Americans to adhere to the advice of “health experts.”

“What is your message to people who are considering, for example, getting together with their families and others for Thanksgiving? Would you urge people to reconsider their plans?” a reporter asked.

“Here’s what I would do. Let me tell you what health experts have said to me,” Biden began.

“They strongly urge that, if, in fact, we’re going to have Thanksgiving with anyone, that we limit it to maximum, maximum, they suggest five people, maximum 10 people, socially distanced, wearing masks, and people who have quarantined,” he explained.

Biden said he has been discussing how his own family will handle Thanksgiving this year and told reporters that they have successfully “narrowed down which family members” will attend, adding, “and that they were tested, recently tested within 24 hours.”

He then urged the American people to “think about this” before gathering for Thanksgiving.

“I would strongly urge for the sake — not just your sake, for the sake of your children, your mother, your father, your sisters, your brothers, whoever you get together at Thanksgiving — think about this,” he said, stressing that Americans should limit their holiday gatherings to ten people.

“There should be no group more than ten people in one room at one time. I mean, inside the home. That’s what they’re telling me. They’re telling me, making sure that that’s the case,” he said before emphasizing his belief in the importance of masks.

“Save lives. Look, I just want to make sure that we’re able to be together next Thanksgiving. Next Christmas. I mean it is an international crisis. It’s an international health crisis,” he said, adding that the world is “at war” with the Chinese coronavirus.

“There’s nothing macho about not wearing a mask,” the former vice president added.

The Centers for Disease Control and Prevention (CDC) recently released a list of suggestions ahead of the holiday, recommending Americans to limit Thanksgiving gatherings or hold them virtually or outdoors. The CDC also recommended guests to bring their own food and wear a mask.

Some Democrat leaders have embraced the recommendations. Last week, New York Gov. Andrew Cuomo announced his intention to limit gatherings in private residences to ten people, while Chicago Mayor Lori Lightfoot urged Chicagoans to cancel their traditional Thanksgiving plans altogether.

Part 5: In Competitive States, Once Biden Gained the Lead with MASSIVE Vote Dumps, The Remainder of Votes All Possessed Same Biden to Trump Vote Ratio — THIS IS INCONCEIVABLE!

Now today we have identified another unusual pattern in vote reporting in at lease two states.

We have identified in at least two states that after large entries were made which provided for a lead for Joe Biden, all subsequent entries after that period of time had the exact same unusual ratio of Trump to Biden votes.

We reported last night that in Virginia in the election a number of large vote transactions or entries were recorded and reported in the voter data feed used by multiple Big Data companies to keep tabs on the election. Then after these large entries were dropped, the ratio of Biden to Trump in most all the remaining data feeds was the exact same ratio.

We noted the following:

Overall three entries of over 300,000 votes were posted in the data base to Biden’s vote total. Two entries of over 300,000 votes were taken away. The same happened to President Trump’s totals but in much smaller amounts. Overall 851,000 votes were added to Biden’s totals and only 318,000 were awarded to President Trump between 11:14pm (Eastern) on November 3rd and 5:00am November 4th. This resulted in over half a million more votes net going to Biden and 73% of the votes during this timeframe.

What’s really odd about these entries are the huge negative entries. One entry taking away 330,153.54 votes from Biden and 37,510.39 from Trump appears to have reversed an entry a few minutes that at around midnight. Then at 12:26 and 12:30am an entry in the amount of 308,341.59 from Biden and 80,357.05 from Trump was posted and reversed. The exact same amounts. A few hours later another 230,000 votes net were added to Biden’s lead.

Joe Biden and Kamala Harris claim they are scheduled to receive a national security briefing on Tuesday, despite the fact that the election results are still being challenged and ballots are still being counted.

Forbes reporter Andrew Solender tweeted a press release from the “transition team” about the meeting on Monday evening.

“On Tuesday, November 17, President-elect Joe Biden will receive a briefing on national security in Wilmington, Delaware, which will include a photo spray. Vice president-elect Kamala Harris will also participate,” the statement read.

It is unclear who the briefing is with.

You own a small grocery store and a taco shop. It is 10:30 on a Sunday morning, and customers are coming through to pick up their orders for Sunday dinner. You look up from fixing the next order and a young man is at the counter. He points a gun at you and demands the money from the cash register. You open the cash drawer and hand him the bills. He points at the next register and you give him that cash as well. You own a firearm. You have a permit to own and carry your gun in this store and at your home. You’re armed. The robber takes the money and turns away. You draw your gun behind his back. You shout to him and he turns back toward you. That is when you shoot him twice in the chest, though one shot goes through his wrist as well as he raised his firearm.

Your attacker drops his gun and falls to the floor. You retrieve his handgun and then call 911. EMTs take your attacker to the hospital in serious, but not a life-threatening condition. The police say that your attacker matches the description of the man who robbed a liquor store and an ATM earlier that morning.

It is 1 in the morning on Friday. Your friend is living with you and your fiance. He is acting crazy after taking some drugs. You ask him to calm down, but he becomes more and more frightened and angry. You and your fiance retreat to your room where you grab your shotgun. Your crazy roommate comes through your door with a knife and stabs you six times. You shoot him twice with your shotgun. Now he turns away and you stop shooting. Your girlfriend calls 911. EMTs take you to the hospital. They declare your attacker dead at the scene.

Ilhan Omar Cuts Ties With Husband’s Consulting Firm After Nearly $3 Million In Campaign Payments

Democratic Rep. Ilhan Omar of Minnesota announced Sunday that she had severed financial ties with her husband’s consulting firm after her campaign had divvied out nearly $3 million to the company.

Omar’s campaign was the largest known client of Tim Mynett’s firm, E Street Group, having paid the firm $2.78 million since July 2019, Federal Election Commission (FEC) records show. Mynett co-owns the firm with Will Hailer, a former staffer for Minnesota Attorney General Keith Ellison. E Street Group’s second-largest client that reports to the FEC was the Minnesota Democratic-Farmer-Labor Party, which has reported payments of $128,000 to the firm.

Omar said in an email Sunday to her supporters that she did not cut ties with her husband’s firm sooner because of the spending her primary and general election opponents put up against her.

“So we’ve decided to terminate our contract with Tim and Will’s firm,” Omar wrote in the email, according to the Washington Free Beacon. “While many of our close supporters know these two well and have recommended we keep them on — I want to make sure that anybody who is supporting our campaign with their time or financial support feels there is no perceived issue with that support.”

“Because of Will and Tim’s decades of combined knowledge and experience in the (5th District), and the work they had done to prepare us for re-election — where our primary and general opponents spent a record-setting $14 million against us — we couldn’t part ways with this team after we got married,” the email said.

Omar’s financial relationship with the firm first came under considerable scrutiny in August 2019 when both she and Mynett were married to other individuals.

Omar’s campaign had disbursed $21,547 to cover travel expenses for E Street Group from April through June 2018. The payments coincided with the alleged start of Omar’s affair with Mynett, according to an FEC complaint filed by the conservative National Legal and Policy Center arguing that the campaign funds were illegally used to further Omar’s romantic affair with the consultant. Omar and Mynett divorced their respective spouses by the end of 2019, all the while denying they were having an affair. The couple announced they had tied the knot in March.

Omar’s campaign ramped up its spending with Mynett’s firm after they announced their marriage. She paid the firm over $1 million from late July through October, FEC records show.

Omar said in March on Twitter her campaign’s work with her husband’s consulting firm was cleared by a “top FEC campaign attorney” and that “everything we spend is used for a legitimate expense and paid at fair market value.”

MSNBC anchor Nicolle Wallace said Monday on her show “Deadline” that Fox News and other “right-wing media” are creating an “alternate reality.”

Wallace said, “I was off a couple of days last week. I tuned in to a little Fox News in prime time and was aghast. I mean, they are pumping flagrant lies into millions of viewers. They’re interviewing lunatics. They call them lawyers, not sure how many of them have law degrees, saying there are a million votes here, observers here. These cases have been filed. They’ve gone before judges that were Democratic and Republican appointees, and they’ve all been thrown out. Fortune 500 CEOs Will Intervene if Joe Biden Isn’t Inaugurated by January 20

Executives from Fortune 500 corporations say they are planning to intervene if Democrat Joe Biden is not inaugurated into office by January 20, 2021.

A report by CBS News states that in a conference call late last week, Fortune 500 executives were planning to step in on behalf of Biden to pressure Republican lawmakers if President Trump holds up the former vice president’s transition.

But if Mr. Trump tries to undo the legal process or disrupts a peaceful transition to Biden, the CEOs discussed making public statements and pressuring GOP legislators in their states who may try to redirect Electoral College votes from Biden to Trump, said Yale Management Professor Jeffrey Sonnenfeld, who convened the meeting. “They’re all fine with him taking an appeal to the court, to a judicial process. They didn’t want to deny him that. But that doesn’t stop the transition,” said Sonnenfeld. “They said if that makes people feel better, it doesn’t hurt anything to let that grind through.” [Emphasis added]

The CEOs decided to wait for the November 20 certification of votes in Georgia before meeting to decide their next moves. Action could include threats to stop donations to political action committees or even corporate relocations, Sonnenfeld said. [Emphasis added]

The big business lobby and Wall Street have been looking to undermine Trump’s economic nationalist agenda for years. The U.S. Chamber of Commerce and the Business Roundtable — both representing some of the nation’s largest multinational corporations and fighting Trump — congratulated Biden and Sen. Kamala Harris (D-CA) days after the November 3 election.

“The U.S. Chamber stands ready to work with the Biden administration and leaders on both sides of the aisle to restore public health, revitalize our economy, and help rebuild American lives and communities,” the Chamber’s statement reads.

As California Braces for Curfew, Some Lawmakers Gather in Maui

Several California lawmakers are in Maui, Hawaii, this week, for an annual legislative convention — despite rising coronavirus cases that led Gov. Gavin Newsom to threaten a statewide curfew on Monday.

The San Francisco Chronicle reported:

Although the coronavirus pandemic has largely grounded the global travel industry, it did not stop the annual political conference that brings California lawmakers to Hawaii for five days of policy discussions and schmoozing with corporate sponsors.

The conference, which has been hosted by the Independent Voter Project every November for more than a decade, is taking place this week at the Fairmont Kea Lani on Maui’s southwest shore.

The event is smaller this year, only a third of its usual size, Howle said. Organizers booked about 50 rooms at the Fairmont and have about 120 people staying there this week, including legislators from California, Texas and Washington state.

Under a travel advisory issued last week, legislators and others attending the conference are recommended to quarantine for 14 days upon their return to California.

Newsom said that he was considering a curfew based on the experiences of countries such as France, Germany, and Saudi Arabia.

The governor has also discouraged social gatherings of more than ten people, and urged people to limit the size of family gatherings at Thanksgiving to no more than two separate households.

Wisconsin: Trump Must Pay $7.9 Million If He Wants a Recount

Madison, WI – Wisconsin’s county clerks have submitted cost estimates totaling approximately $7.9 million for a statewide recount, according to the Wisconsin Elections Commission. The fee would be required up-front from President Donald Trump’s campaign, the Commission said.

“We still have not received any indication that there will or will not be a recount,” said Meagan Wolfe, Wisconsin’s chief election official. “But we want Wisconsin’s voters to know we are ready.”

Part of that readiness includes collecting recount cost estimates from all 72 counties and assembling a statewide estimate, which must be paid before any recount can begin.

“Our county clerks have carefully estimated their costs for recounting 3.2 million ballots, which is approximately $7.9 million,” Wolfe said. “These estimates are significantly higher than the actual costs of the 2016 recount, but they take into account factors not present four years ago, including the need for larger spaces to permit public observation and social distancing, security for those spaces, the higher number of absentee ballots, a compressed timeframe over a holiday, and renting high-speed ballot scanning equipment.”

The Wisconsin Legislature changed state law in 2017 following the 2016 presidential recount to allow the Wisconsin Elections Commission to include its costs in the estimate. WEC costs are less than $30,000 of the total estimate. If the estimated costs exceed actual costs, the candidate’s committee will receive a refund for the difference, Wolfe said.

Last week, the WEC contacted the presidential campaigns to inform them of the procedures for requesting a recount. A copy of the letter is attached.

Wolfe also announced the potential timeline for a recount, if one is requested. The timeline permits the recount to be completed and the results to be certified by December 1, 2020.

“Watch this video from September, you may not have seen it – it wasn’t played much in this country,” Carlson said before rolling the footage. “This is the Prime Minister of Canada Justin Trudeau speaking to the United Nations.”
