Misleading tweet. The evidentiary hearing set for tomorrow was cancelled so the plaintiff can file a new motion (with amended arguments) and file a brief in opposition to dismiss.

 

Yesterday's hearing was on defendant's motion to dismiss. The judge did NOT dismiss. If "the plan" is to stall counties and states until the hammer drops, this is a win.

In fact, the defendant's attorneys repeatedly badgered Judge Brann to skip these procedural steps and dismiss yesterday, but he refused.

 

When you read the media making fun of Guliani in the courtroom, the judge was kind and thorough in helping him get up to speed on PA nuance, not at all disparaging or mocking him as reported.

 

the opacity "gaffe" was a result of Guliani not hearing what Brann said. It had nothing to do with him not knowing what the word meant.
