That has nothing to do with this app. Your phone is already doing this, whether you have

The app informs you that someone near you tested positive. That's it. It doesn't know if you
tested positive, nor does it ask.

I agree, turning off location services only stops apps from accessing your whereabouts. Your provider always knows, so does the government.
It does for most. You can tell by turning it off and some app that needs your location whines for you
to turn it back on. The source code for Android is publicly available, so it this wasn't true, we'd
have heard about it by now.
The built-in (Android OS) ones still can access that information, I think, but I can't verify.
It can't happen without a Constitutional amendment. The process is spelled out.
