Aren't these splits about who the "Chief Justice" will be hearing those state's case for the purpose of writing an opinion it's not as if the other Justices will not be part of hearing the case or participating in a vote. Thinking about the Obamacare decision..Roberts wrote the opinion which created a tax mandate.. but it's not as though none of the other judges didn't get to weigh in with a vote before the ruling. I don't see how this would be any different. The only difference I see here is who writes the final opinion.
