Remember, at what point is the current election concluded? Methinks it is Jan. 6th, 2021. This would put the 45 day deadline at Feb. 8, 2021. Perhaps Feb. 9, 2021.

 

In any case, a naive (and perhaps common) misreading of this would be to start that 45 days from Nov. 3. I don't think that's legally proper.

Jan 6th is the schedule Senate meeting to certify the results, I believe. I think normally this is thought of as certifying the electors, but that isn't the case if the race is decided by a House vote.

 

Dec. 14 is the normal date of the reading of the electors in the Senate. If this reaches 270, then we would know the results but that may not be the "legal conclusion" of the election. That's why I was suggesting Jan. 6th.

 

I could resolve this with moar reading, but the last three years (around 8000 hours) of reading has really bruised my walnut.

This is the case if there are at least 270 EC votes on Dec. 8. If not, it goes to a vote in the House. After that, the following steps don't make sense because the race wasn't decided based on electoral votes.
