Life, Liberty and Levin: Mark L Explains What Trump Campaign is Doing

11-23-2020

The vid keeps getting wiped out, so here's a summary of Levin's brilliant open.

Mark Levin explains why it's reasonable for Trump campaign to bring suit RE the current election chaos:

Everybody's saying: "Where's the evidence?"

[Gotta know what evidence really means]

Civil litigation - how it works

To file a civil complaint, you need a reasonable basis in fact and law

A motion to dismiss tests the legal sufficiency of the complaint

If it is not legally sufficient, the judge will dismiss

But in the case of many of the cases brought by Trump campaign, they should not have been dismissed

The standard is usually fairly easy - you don't need a lot of evidence to bring a case

You can seek expedited discovery to seek all the evidence after bringing the complaint

Can be granted by a court - and it often it

Discovery can be ordered immediately

In the case of Dominion Voting System

"Unexplained significant deviations from expected results - mathematical inconsistences supported by experts - should be more than sufficient to establish a reasonable basis to file a complaint and justify fast discovery."

This is expert testimony given in affidavits

Its ALL WRONG to say - "Where's all the evidence?" early on

If judge's prevent the case from going forward, the evidence will never be gathered

Different kinds of cases that Trump is bringing

  1. Testing this machine system with a filing - as above (they're getting their experts/affidavits lined up)

  2. actual fraud (collecting affidavits from hundreds of poll workers, etc.)

  3. Constitutional cases - very serious cases (cites Alito opinion): Article 2, Section 1: legislature given the authority to determine electors/election laws

Constitutional factors

Dems brought 200-300 lawsuits just prior to the election trying to make voter fraud easier.

Trump campaign is now trying to address these, some of which are illegal.

[cites multiple examples about courts illegally intervening to make late voting easier, etc.]

[condemns media for their bad coverage and some Repubs like Sasse and Romney for their opposition]

We the people make the election laws, not judges.

These rulings are NULL AND VOID.

These were unconstitutionally altered.

SCOTUS: Levin says Justice John Roberts and Kavanaugh should have voted with the originalists.

If you believe in our current Constitutional system, this process should NOT be cut short.
