Will Judge Emmet Sullivan accept President Trump’s pardon of General Michael Flynn? No one has suggested that possibility, other than The New York Sun. The general’s case, though, has become a bonfire of the vanities of one district judge who has denied the presumption of regularity to an official act of the United States government — meaning Attorney General William Barr’s attempt to drop the case.

• So why would Judge Sullivan credit President Trump’s workaround of a pardon? We understand, the pardon could be the least fettered of all the powers that the Constitution grants to the president. That doesn’t guarantee that a runaway judge won’t ignore or reject a pardon. The pardon power, after all, is no more holy writ than the clause in Article III that limits the power of the courts to deciding actual cases and controversies.

• The reason Mr. Trump pardoned General Flynn in the first place is because the District Judge in the case, Emmet Sullivan, is refusing to accept the government’s finding — on which prosecution and defense agree — that a case or controversy no longer exists. Instead, Judge Sullivan appointed an amicus lawyer to launch a whole new probe, this time against General Flynn and the Attorney General of the United States.

• This prompted General Flynn to ask the judges who ride the appeals circuit in the Columbia District to order Judge Sullivan to grant the government’s motion to dismiss the case against General Flynn. The appellate panel promptly did so. The judge refused to bow to the appeals panel, though, and instead sought a full review. The full bench threw out the panel’s order, and let Judge Sullivan proceed.

• With one important caveat. “As the underlying criminal case resumes in the District Court,” the appellate bench said, “we trust and expect the District Court to proceed with appropriate dispatch.” Famous last words. That business about “trust and expect” deserves to go in the Guiness Book of World Records as the most naive statement ever issued from a federal bench. Judge Sullivan simply ignored it

• To gain a glimpse of this, we commend a visit to the docket in the case. It is festooned with various amici — friends of the court — and their applications to file briefs. They include “separation of powers scholars”; the “national association of criminal defense lawyers”; “former federal prosecutors and high ranking Department of Justice officials”; and the chairman and members of Committee of the House Judiciary Committee.”

• We’re not questioning the bona fides of these worthy amici.We’re just suggesting that Judge Sullivan appears to have no intention of bowing to the order of the Court of Appeals that the district court proceed with dispatchIt would take months just to sort through all these amici briefs.The circuit was hadNo wonder President Trump granted a pardon. If the court accepts it, we’d be amazed — but delighted to be wrong.

California's top elections official is pushing the state to pay out a $35 million contract with a major Democratic consulting firm as he lobbies behind the scenes for a Senate seat.

 

California secretary of state Alex Padilla (D.), reportedly the favorite to fill Vice President-elect Kamala Harris's Senate seat, awarded Democratic public relations giant SKDKnickerbocker the lucrative deal in August as part of a voter outreach program. Weeks later, however, Democratic state controller Betty Yee's office refused to approve the contract, arguing that Padilla did not have the authority to pay for it.

 

The resolution of the dispute could be a make-or-break issue for Padilla. His victory in a fight that would send a tranche of money to some of the country's leading Democratic strategists could ease his path to being appointed to fill Harris's seat, a decision that Democratic governor Gavin Newsom plans to announce prior to inauguration day on Jan. 20.

 

SKDK has deep ties to Harris and President-elect Joe BidenThe firm's managing director, Anita Dunn, led Biden's presidential campaign, which has disbursed more than $2.2 million to SKDK since December 2019. Newsom did not make any payments to the firm during his runs for lieutenant governor and governor in 2014 and 2018.

 

According to internal emails obtained by CalMatters, Padilla has spent months fighting to pay the Biden-linked firm following Yee's rebuke. The Democrat personally lobbied Yee to approve the payment in an Oct. 20 email, citing an August bill signed by Newsom that called on Padilla to "conduct a statewide voter education and outreach campaign."

 

Padilla issued the contract on an "emergency" basis, meaning that it did not require a competitive bidding process and was not approved by relevant state agencies before it was awardedThe lack of transparency sparked criticism from Yee's office: In a September email, chief counsel Rick Chivaro wrote that trying to get a "definitive answer" on the contract was "a little like catching a greased pig."

 

SKDK may not be able to recover its expenses should Padilla fail in his attempt to fulfill the $35 million payment. The contract asserts that California can cancel the agreement "with no liability" should the state reduce funding for the program.

 

Padilla awarded the contract to SKDK as part of the state's "Vote Safe California" initiative, which aimed to "educate the public on the safety, security, and ease of voting in the general election amid the COVID-19 pandemic."The program also required SKDK to give "special attention" to "reaching first-time mail voters" after Newsom decided to send every registered voter in the state a mail-in ballot

 

According to a Politico report, Newsom is "leaning heavily" toward picking Padilla—a longtime ally of Newsom's—to replace Harris. Top Democratic activists in the state, however, are urging Newsom to select a woman of color. Other reported candidates include state attorney general Xavier Becerra (D.) and Reps. Karen Bass (D.) and Barbara Lee (D.).

 

Bass was also floated as a potential Biden running mate but faced criticism over her role in headlining two Democratic Socialists of America conferences in 1988 and 1993. The Democrat has also praised the Church of Scientology, and she called Communist dictator Fidel Castro's death a "great loss" to Cuba in a 2016 statement.

Asked by Carlson if he could measure the effect Google’s manipulations had on the results of the election, Epstein said the search engine “could easily have shifted at least 6 million votes in just one direction__” going on to note thatthat figure was his “bare minimum” effect of the election

 

“The maximum, we haven’t even begun to estimate that yet because we have so much data to look at,” Epstein said.

 

Carlson responded by noting that the 6 million vote figure is the current margin of the popular vote in the presidential election.

 

“There’s no question that they set about after the 2016 election to make sure that President Trump, whom I do not support by the way, to make sure that he is not reelected,” the psychologist said.

 

“The massive amount of data we’ve collected is consistent with what the whistleblowers and leaks have been telling us for a long time now,” he said.

 

Epstein went on to claim that Google gets away with the manipulation because the search giant buys political candidates.

 

“The problem, though, is that we don’t know who Google is going to be supporting tomorrow,” he continued. “In different countries around the world, they don’t necessarily support liberals. In some countries, they support conservatives. In China, they worked with the Chinese government to help surveil and control the Chinese population.”

 

Epstein concluded by saying his team would be closely monitoring Georgia’s January Senate runoff.

There are three things we need to prepare for when President Trump is announced the winner. That’s not to say we need to take it for granted or get complacent, but if we believe truth will prevail, then we know President Trump will prevail. On the latest episode of NOQ Report, I discussed these three things (and dealt with few trolls as well).

 

First and foremost, we must prepare to address the unhinged reactions from peers and those we know on social media. They’re going to take mainstream media’s word for it that when it happens, it will be President Trump “stealing” the election. We need to be prepared to convince them otherwise by sharing the truth and calling them out for preferring to win by cheating than lose with integrity.

 

Second, there will be violence. Lots of it. Unlike conservatives who have not burned down any building just because Joe Biden has been announced the winner, we need to prepare to defend ourselves, our families, and our communities from the violent responses from the radical left.

 

Lastly, we need to hold the weak or fake conservatives accountable. They are either giving up too easily or never supported President Trump at all. Either way, their treachery must not be forgotten. That doesn’t mean we don’t forgive them, but forgiveness and forgetfulness are not the same thing.

Fareed of CNN says in video that 8 out of 9 states has Republican majority, they have chosen the electors and those states regardless of the “popular vote”(some states have passed laws to make popular vote the winner by electors), although he says those are state laws, they are not a constitutional mandate. He says “that might be the Republican’s plan (yes Fareed to use the constitution), he makes it sound like it’s a plot by republicans”
