Pennsylvania Supreme Court Tosses GOP Lawsuit on Absentee Ballots, Lifts Block on Certification of Election

The Pennsylvania Supreme Court on Saturday evening reversed a lower court’s block on certifying the state’s elections issued Friday night, dismissing with prejudice a lawsuit brought by Republican candidates for the U.S. House of Representatives that sought to have the results nullified over constitutional concerns about a 2019 change in absentee ballot rules. The lead plaintiffs in the case are Rep. Mike Kelly and Sean Parnell.

The Pennsylvania Supreme Court said the suit was dismissed because the plaintiffs failed to file their case in a “timely manner” when Act 77 was passed in 2019.

2-4 Hour Lines Outside Supermarkets Due to New Mexico Gov’s Lockdown

New Mexico Gov. Michelle Lujan Grisham (D) has put immense pressure on businesses with her “abrupt” lockdown order – forcing “nonessential” businesses to close and creating what has been dubbed “modern breadlines” — with people waiting 2-4 hours to enter essential retailers, former GOP Senate candidate Elisa Martinez explained during an appearance on Breitbart News Saturday.

Martinez, a former U.S. Senate candidate and Trump campaign surrogate, said that there has been a lot of downward pressure on the economy and people of New Mexico due to “ridiculous mandates” pushed by the governor, imposing some of the “strictest lockdowns” in the country. Martinez discussed the governor’s “abrupt” November 13 announcement, which put residents under another lockdown, closing businesses deemed nonessential.

The lockdown, which went into effect November 16, created a “huge rush to all of the stores,” which Martinez said was “very counterintuitive if the idea is to stop the in-person contact.”

The governor ultimately capped capacity in retail stores to 75 people, regardless of size.

“So now we’re experiencing 2-4 hour lines outside in the cold — some areas of the state it’s snowing, raining,” she said.

“I had an elderly woman contact me. She was waiting in line for two hours to get their meds — to get their, you know, essential medicine. So it’s making a public health emergency worse in my opinion for the people of New Mexico, especially leading up to Thanksgiving,” she said:

The issues were further compounded, she said, “by the fact that she also declared that if you have four rapid response coronavirus tests that came back in one of these essential businesses, that the whole business, the whole store, had to shut down.”

That resulted in at least 12 stores across the state closing “in these smaller communities.” She added that it is “all up to the whims of the governor to declare what is essential and not.”

Lujan Grisham’s order ultimately put pressure on mom and pop stores, she continued, explaining that Democrat governors are “enriching corporate empires like Amazon and Walmart.” All the while, Hollywood productions are allowed to take place in the state.

“We have video of an actual production crew at work here in the state that took place after the lockdown orders. And my understanding is that there’s a special agreement that the film industry gets to operate outside of the public health order based on their own agreement with unions. It’s really a slap in the face to the people of New Mexico who are truly struggling, who are waiting outside in these lines,” she said.

The “fearmongering about this virus never stops from the governor, but the film industry, somehow, is exempt from the virus and exempt from the lockdown order,” Martinez said, adding that the hypocrisy is “off the charts” in the state.

Lujan Grisham’s office responded to the backlash by proclaiming that the state is “not forcing anyone to stand in a crowded line.” A spokesperson for the governor added that the chatter over the long lines is nothing more than a “Republican talking point.”

“Let’s now make the best of the situation and show our love and affection for people by keeping them safe,” Dr. Fauci added.

Dr. Fauci pushed out more panic porn about the coronavirus and warned again of a “dark winter” where the situation in America will continue to deteriorate through the New Year.

“If the surge takes a turn of continuing to go up and you have the sustained greater than 100,000 infections a day and 1,300 deaths per day and the count keeps going up and up . . . I don’t see it being any different during the Christmas and New Year’s holidays than during Thanksgiving,” Dr. Fauci added.

But despite all the hysteria from so-called “experts” like Dr. Fauci and the so-called “expert models” predicting the health care system in America will collapse, the hospitals have not been overrun.

All Americans are asking for is accurate data – and not hysteria and campfire scary stories – about the risks of the virus so they can make the most informed decision about their Christmas plans without having tyrannical bureaucrats and dictator Mayors and Governors canceling Christmas.

Facebook fact-checker forced to issue correction after Candace Owens challenged 'false' rating

'I am taking every measure to fight these communists in the court room'

Political commentator Candace Owens challenged a "false" rating from a third-party Facebook fact-checker and she won.

Earlier this month, Owens announced that she was taking legal action against the fact-checkers used by social media platforms. Owens brought the case because she became tired of being censored on Twitter and Facebook by third-party fact-checkers, as well as seeing fellow conservatives being silenced on social media.

Owens retained a pair of lawyers to represent her in the lawsuit, including attorney Todd McMurtry, who was part of the legal team representing former Covington Catholic High School student Nick Sandmann. Owens is reportedly suing fact-checkers from USA Today and Lead Stories, according to the Daily Wire.

"It is time to fact-check the fact-checkers," Owens said. "I'm going to put these suckers through discovery and figure out what the relationship is that they have with Facebook."

Owens launched a website titled "Fact-Check Zuck," which says, "Our freedoms are being stripped away. The overlords of Big Tech are determining what Americans can and cannot say, share, like, and post."

"Support our legal efforts today as we fight back against Facebook's fact-checkers, confronting those who are suppressing free speech, thought, and expression across our great country," the site says.

"I wanted to show that these fact-checkers just lie, and they usually go unchecked because most people don't have the money, don't have the time, and don't have the platform to go after them — and I have all three," Owens said.

Owens celebrated her first victory in the case against the social media behemoths on Saturday.

"Weeks ago, @Facebook censored a post of mine which truthfully stated that @JoeBiden is NOT the President-elect," Owens wrote on Saturday. "So I got lawyers involved. Conclusion? @PolitiFact uncensored the post & admitted that they LIED by rating my post false. The fact-checkers are lying for Democrats."

PolitiFact issued a correction and removed the false rating.

"Correction: PolitiFact originally labeled this video false in our capacity as a third-party fact-checker for Facebook," PolitiFact wrote on Facebook on Nov. 25. "On Nov. 20, an appeal to that decision was made on behalf of Ms. Owens. PolitiFact approved the appeal on Nov. 20, determined that a correction was appropriate, and removed the false rating."

Owens argued that Joe Biden is not technically the president-elect as of yet, he was only named as the president-elect by media outlets, which is not authorized to name the president-elect. Biden is projected to be the winner of the 2020 presidential election, but the president-elect will not officially be named until the Electoral College cast its votes on Dec. 14, once all states have officially certified their results.

President Donald Trump is currently challenging the results in the election and has filed several lawsuits in critical swing states.

EU Fines Teva $72 Million For Illegally Delaying Cheaper Generic Drug

The European Commission said on Thursday that it fined Teva pharmaceuticals, the largest generic drug manufacturer in the world, €60.5 million (US$72 million) for illegally delaying the entry of a cheaper generic version of a drug for sleep disorders.

The Israeli pharmaceutical company was found to have violated EU antitrust rules by engaging in a “pay-for-delay” agreement, where it allowed its competitor, Cephalon – a company it acquired – to continue charging higher prices for a drug that had long lost its patent.

“It is illegal if pharmaceutical companies agree to buy-off competition and keep cheaper medicines out of the market,” said the commission’s Executive Vice-President Margrethe Vestager, who is also in charge of competition policy.

She added that the two companies’ maneuvers “harmed patients and national health systems, depriving them of more affordable medicines.”

The Commission’s investigation, which was first opened in 2011, found that Teva agreed to a “package of commercial side-deals” with Cephalon in exchange for delaying the launch of its generic version of modafinil – a drug prescribed for sleep disorders such as narcolepsy – after the company’s patent had expired in 2005.

Teva allowed its competitor to continue charging these high prices for nearly six years, before subsequently acquiring the company in October of 2011.

The company has already settled for $70 million in July of 2019 with the state of California for violating antitrust laws related to this case.

“We’ve seen the way prices have been jacked up in ways that are incomprehensible,” said Xavier Becerra, the state’s attorney general, following the settlement, adding that these pay-for-delay arrangements are “dark” and “collusive.”

The company’s actions in this case could just be the tip of the iceberg in terms of other reported attempts of inflating prices on a wide range of its generic drugs.

In May of 2019, 44 US states filed suit against the company, alleging that it has a long history of entering discreet agreements with its supposed competitors in order to maintain higher prices.

According to the lawsuit, Teva is at the center of a conspiracy in which it colluded with competitors to raise prices on 86 medications used for a wide range of treatments for conditions that include cancer, epilepsy, high cholesterol, high blood pressure, diabetes, and many more.

“The size of the price increases varied, but a number of them were well over 1,000%,” the complaint said.

“The level of corporate greed alleged in this multi state lawsuit is heartless and unconscionable,” Nevada Governor Steve Sisolak said shortly after the civil action complaint became public.

Teva maintains that it has not engaged in any civil or criminal liability in the US lawsuit, and has also denied its culpability in the most recent EU Commission lawsuit, saying it intends to appeal the case.

“We are currently reviewing the decision but we continue to believe the modafinil patent settlement agreement did not infringe EU competition law,” it said in a statement.

About 46 thousand people reportedly took part in the demonstration in Paris, in Lyon – 7.5 thousand people, in Bordeaux – 6 thousand, in Strasbourg-1.5 thousand, in Lille-1.4 thousand. Protests were held in 70 French cities.

Heavy clashes took place in the capital, where several cars, cafes, newsstands and garbage cans were burned.

Police used tear gas and water cannons to restore order.

According to the interior Minister Gerald Darmanin, 37 police officers and gendarmes have been injured during the demonstrations, so far. He once again condemned the unacceptable violence against the police.

Powell is clearly not playing games, having recently announced a lawsuit in Georgia that calls for the actual seizure of voting machines that were used during the election.

Powell’s lawsuit claims the use of Dominion voting software, “ballot stuffing” and other actions illegally gave Democrat Joe Biden a lead in the state.

It asks the U.S. District Court for the Northern District of Georgia for an “emergency declaratory judgment that voting machines be seized and impounded immediately for a forensic audit.”…
