scotus HAS made many bad decisions
however i do not expect that in the 2020 election litigation
i do bot believe they will rely upon granular detail and legal niceties
hey will uphold the basic principle of free and fair elections as there is massive evidence that this was not the case - massive
the pending cases will provide the foundation and ramework for scotus to repair this damage
they may fix on certain facts but that will not be the real basis of the trump win and there many constitutional arguments and precedents that tell us this is so - it is very complex too
but
states cannot simply rewrite election rules by admin. fiat
states cannot deny ballot access and observations
states cant just destroy evidence digital or otherwise
the real tough issue will not be finding an unconstitutional election(s)
the real issue will be the remedy
on that i can only speculate there are many many options and paths
my GUESS is they will toss it to the congress and state legislatures under the Artile ! elections clause
