I think he could. We are officially at war. We have a few dozen National Emergencies declared - over the entire USA, so he has almost unlimited power.
Think Lincoln - he invented the War Powers Act, defied the SC, declared Martial Law allowing civilians to be tried in mil tribunals. Suspended Habbas Corpus - allowing imprisonment w/o speedy trials - lock em up.
We KNOW this is a National Security issue involving foreign countries.
My last point - he hasn't done anything yet. He will strike and the strike will shock the world. He will show what it MEANS to hold the Office of the Presidency.
