Ok…ONCE AGAIN, I recognize my need to apologize to you and ask you to forgive me for that! (I'm "working on it") As of this writing, there's no doubt in my mind that we could sit down over a few beers and debate the matter! I've been too hard on you! Nevertheless, I think you're on a slippery slope with: "… the right still exists for it [pron] to exist"! …and on that point I would try to develop and argument that is based on "The Spirit" of The Law! I'd argue that our Republic was founded, or as John Adams penned: "Our Constitution was madeONLYfor a moral and religious People", thus, as a moral and religious people, a commandment, by God, to fight against evil! I can go so far as to point out (and defend the argument) that people who stand-by and allow evil to advance, become, just as GUILTY of the offense as those who perpetrated the offense! I'm sure you've heard Burke's quote: "The only thing necessary for the triumph of evil is for good men to do nothing.” Therefore: the most important question at hand is, "What kind of Republic do you want to have?" The "Free-est" Republic possible can only be realized by a moral and religious people! In order to live in a Free Nation, we MUST be a moral people…which, I believe, goes directly to your point (if I may paraphrase) "One cannot legislate morality"! However, even though I might "broadly" accepts parts of that concept, I think perhaps we SHOULD legislate morality! Neither is perfect, but which society would be healthier and stronger? I think the answer is clear!
