It was NEVER legal. But it still got done on an as-needed basis. BTW, being tarred and feathered was often a death sentence. Hot tar does bad things to bare skin. No fun when it cools and begins to break off, either. And no shelter / aid from anyone who saw it ... it was just assumed (since it took a committee to apply) that it was warranted.
