Not necessarily of any help. First, the contract likely does not assign election misuse to Dominion., The machines probably did exactly what they were programmed to do, thereby fulfilling the contract.

Second, in the even of breach of contract, the fact that buyer can examine source code is a contract issue, not an election malfeasance issue. I bet Trade Secrecy still applies.

I'm privy to many trade secrets. Can't share them, I'm bound by contract to maintain confidentiality unless the material otherwise becomes public. Trade secrets also appear in court/trial venue, and are kept secret.

The problem here is the government agreed to buy this black box. It had nefarious purpose, and aims to shift liability for its own wrongdoing. The government is the culprit here, it "bought the dope."
