No Sullivan. With Texas being a party to the case ot goes straight to the doorstep of the Supreme Court per Article III of the Constitution.

 

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction.'

 

Supreme Court by law has to hear the case. Now if all that safe harbor shit is true, that means they got to rule on it Today. Wow, if true.
