No, it isn't. The way it's proceeding is better in the long run. You don't want to open Pandora's Box for every election going forward with the jaws of the judiciary springing open or shut the will of the states and their voters.

 

This case between the states is a much better and prudent way to proceed. The Constitution is a contract between the states and how the conduct business, like electing a president. If rogue states break the rules and disenfranchise the rest of the states, it's the proper place of the SCOTUS to resolve that.

 

That keeps things neat and orderly going forward…not putting thumbs on scales as the wind blows.
