Secret files lost by courier spark new calls for security clearance overhaul

A file containing highly sensitive personal information about a government employee was lost while it was being transported by a courier, the National Audit Office has found, as the federal government is urged to further overhaul its process for granting security clearances.

The Commonwealth's integrity watchdog also found that the government agency responsible for security clearances has not yet fully implemented all of the recommendations it made in a scathing audit two-and-half years ago.

Liberal MP Dave Sharma argues Australia's security clearance system restricted access for Chinese-Australians while the intelligence and foreign services needed more Mandarin speakers, a position backed on Tuesday by the former Director-General of the Australian Office of National Assessments intelligence agency, Allan Gyngell, who said the lack of representation from Chinese-Australians was a "great waste of talent" as relations between Beijing and Canberra deteriorate.

The details identified during the security vetting process can include sexual history, finances, drug use, overseas travel and acquaintances.

On April 16 this year, a file for a security clearance was lost while it was being transported by a courier. The Australian Government Security Vetting Agency (AGSVA), which is responsible for security clearances, could not locate the file and had to tell the applicant to not engage with anyone claiming to be from the agency.

The applicant was applying for a negative vetting 1 level, which allows holders to deal with classified information and documents up to "secret" level.

In another incident on December 17, 2019, a package containing two security files sent by a subcontracted vetting officer was temporarily lost, and then opened by a courier.

The incidents have been uncovered in a new audit by the National Audit Office, which in 2018 lashed the AGSVA for failing to protect insider threats and called for a major overhaul of its processes.

The AGSVA's processing of security clearances for political staffers and public servants has for years been plagued by delays.

After undertaking a wide-scale audit in 2018, the National Audit Office found the AGSVA was unable to "effectively mitigate the government's exposure to insider threats". The waiting times in that year for positive vetting - the highest security clearance available - blew out to almost 18 months for non-complex cases and more than two years for complex cases.

The report recommended the Attorney-General's Department and the Department of Defence establish a framework so security concerns about potential staffers could be shared with the agency looking to employ them.

Elections undecided by midnight are void & preempted by federal law – Foster v Love (1997; 9-0 Decision)

(Nov. 18, 2020) — “When the federal statutes speak of ‘the election’… they plainly refer to the combined actions of voters and officials meant to make a final selection of an officeholder… By establishing a particular day as ‘the day’ on which these actions must take place, the statutes simply regulate the time of the election, a matter on which the Constitution explicitly gives Congress the final say.” Foster v. Love, 522 U.S. 67, 71-72 (1997)

(Article by Ren Jander republished from ThePostEmail.com)

We will take a closer at this binding precedent below, but in preview, please understand that it emanates from a 9-0 decision of the United States Supreme Court, wherein the entire Court joined, not just the outcome, but also the opinion on this very point.

The voters vote. The officials count. These combined actions form “the election,” and the election must be decided on the day. States that failed to make a final selection of officeholder by midnight after Election Day have violated the statute, subjecting the nation at large to the very evils Congressionally mandated deadlines were drafted to prevent.

Federal Election Day statutes were designed to curtail fraud, and to infuse a prima facie sense of integrity in our electoral process. But these States – in failing to obey Congressional deadlines – have flagrantly attempted to preempt federal law. This is certainly prohibited, and this is why the late election results are void.

Citizens may file actions in the Federal District Courts and appeal all the way to the Supreme Court. Get this information to your State Representatives and Senators. Forward it to the White House if you know anyone with connections. Blog it. Video it. Podcast it. Share it in comments, please. The President’s team has not made this argument yet. They have not plead it. And they must get up to speed.

You were disenfranchised by the failure of States to follow federal law.

Your pursuit of happiness is directly infected. You have a cause of action.

This is the peaceful, legal battle plan of the Republic. Let’s roll.

THE FINESSE

Suspend disbelief. I’m not stretching on that headline. I honestly do not believe the Supreme Court can avoid nullifying the Presidential Election… if President Trump, and some of you too, will plead this in court.

My previous report discussed the plenary authority of State Legislatures to determine how Presidential Electors are appointed. Consider this Part 2. (Review Part 1. Now.)

3 U.S.C. § 2 kicks the decision back to the State Legislatures after a failed election renders the previous results void. Failed elections nullify all votes, not just some votes, not just late votes, not just illegal votes. The election itself is void in late States.

Allen West: Seven States Will Join Texas in SCOTUS Lawsuit Against Georgia, Michigan, Wisconsin and Pennsylvania

Col. Allen West joined Steve Bannon Tuesday evening on The War Room. Allen West, the Republican Party Texas state leader, went on to discuss today’s Texas lawsuit against Georgia, Michigan, Wisconsin and Pennsylvania at the Supreme Court.

West told Steve Bannon that Louisiana joined the lawsuit on Tuesday afternoon.

Louisiana AG Jeff Landry announced earlier this afternoon that Louisiana is joining in on the Texas lawsuit filed yesterday against the states of Georgia, Michigan, Wisconsin and Pennsylvania over irregularities and lawlessness in the conduct of the 2020 election.

Allen West told Steve Bannon, “I think you’re going to see ten states sign on to this petition and lawsuit. I know as you said Louisiana just came on board.”

SEVEN states have now joined the Texas lawsuit, arguing that the Equal Protection Clause has been violated in this election from state-to-state.

Louisiana, Arkansas, Alabama, Florida, Kentucky, Mississippi, South Carolina, South Dakota.

"…..This Was Not an Election Between Candidate A and Candidate B - This Was an Election Between Being a Republic and Being a Communist Nation" - Amen

LaVoy Finicum: ‘Shot Down Like A Dog With His Hands In The Air’

One of the truly great blogs out there, The Burning Platform, asked a very specific question: If not now, when? The answer is very simple: NEVER. This is the time in American history when it all hinges on the individual to take action. As The Burning Platform pointed out all of the many abuses and unconstitutional acts committed by the government over the years, it seemed as if the people had never taken action against those ills, but that’s not quite true. The Second Amendment violations have been countered any number of ways and the Assault Weapons ban was allowed to sunset, but the point is still clear: not often enough and not severe enough.

The abuses of government against the Constitution have been ratchet clicks around the neck of the republic. Individual rights have been adjudicated down to mere suggestions subject to any locality to abridge them as they see fit, because, well, they have not suffered enough when they did. That is the truth of the matter. Never has this been made more clear than through the pandemic. All of the information coming out of the “health experts” has been a lie and yet, we still wear the mask, stay home if we can and let our businesses go bankrupt. That is insane, but it is a gauge on what they can do in the future. Unless, we recognize our strength and put a stop to it.

The question is: Why have we not acted before? Why did we not do something a long time ago about the unconstitutional orders of governors and mayors? The truth is, we still believed in the idea of the republic in the sense that we believed that our votes were cast and the winner became the representative, senator or president and if it didn’t go our way, we would have to wait two, four or six years to try and get it right. We believed the Supreme Court would hear and overturn these restrictions.

The election of 2020 proved that our belief was just that, a belief, a thing taken on faith in the system. We all knew some voter fraud took place, but didn’t think it could exist to the point where it would change any but a very tight race. That belief was shattered in the early morning hours of November 4th, 2020, when we woke up to find the voting trends we have watched for decades obliterated in the night, wiping out huge gaps between Trump winning and suddenly showing Biden way ahead. That had never happened, not even in the 2000 election. It changed everything.

As witnesses came forth and signed affidavits that fraud had taken place on a massive scale; after video footage showed boxes being pulled out from under counting tables after the room had been cleared of poll workers and poll watchers; after arrogant poll workers bragged about their roles in stealing the election for Biden, the belief in our elections has come to an end. This was a stolen election.

"Wall Street South": Goldman Leads Financial Firm Exodus From NYC To Florida

Liberal politicians have been driving citizens out of their cities and states all year - as we have documented in cities like Chicago and states like California - due to an increasing embrace of higher taxes and more regulation, all while acting as authoritarian lockdown hypocrites (see here and here) and embracing defunding the police.

The latest genius to singlehandedly ruin his city now appears to be Bill de Blasio, who not only has turned New York into a destitute shell of the city it once was, but could also be single-handedly on the verge of ruining the financial capital of the United States. Thanks to his "leadership", massive financial firms like Goldman Sachs and Elliot Management are now taking their operations out of New York and into states like to Florida.
