If you read Yost's brief for Ohio, he agrees with Texas' claim, just not their proposed remedy.

He's right.

The Court cannot order the legislature what to do.

But it can nullify the rules put into place outside of the legislature and then suggest the legislatures do whatever they think is best to resolve the situation.

Which is almost certainly what SCOTUS would do anyway…
