What I think is, these guys have had so many years of being backed up by corrupt judges who will accept any bullshit they throw out there, they're no longer capable of producing any solid legal argument, especially on short notice.
Pressure is on Biden now. Done beforehand. Set up is to make Biden a leper. Good guys will peel off peripheral players (e.g. Swallwell) until the dem/pub swamp suits tell him to give it up. Harris probably a bigger problem, here, though. It will be interesting to see who they peel off to get to Harris.
IF SCOTUS goes 6-3, it should be enough to force Biden out, since the threat he poses isn't worth the alternative.
Alternative is disclosure of the ongoing war with China (cyber/informational/biological) and the outing of those collaborating with them. That includes foreign actors.
In that scenario, optics won't mean shit. IOW, I don't think it will even be weighed, the situation is too dire.
Choice atm, then, is go with a reasonable 6-3 ruling, Biden concedes (fraud, but he didn't "know", and we clean up the mess out of the public eye, or, we disclose the military operation currently underway and let the chips fall where they may in the public square.
