He should have standing. I wouldn't be surprised to see that emerge as a strategy. The Supreme Court did not rule on the merits of the case, they kicked it for lack of standing.

Not yet. Still lots of legal avenues to pursue. The only truly hard deadline is January 20th, and even then it's possible the Speaker steps in as acting President until it's sorted out.
