As much as I wanted the SCOTUS to hear the case, this may not actually be true. There was no vote count released. My understanding is that it takes 4 justices to vote to hear a case. Perhaps Kavanaugh, ACB and Gorsuch were forced to recuse since they were appointed by Trump. That would leave only Alito and Thomas to vote for it and didn't meet the 4 vote threshold to hear the case.
