IT'S NOT THE VOTES THAT COUNT, BUT WHO COUNTS THE VOTES
The refusal of the US Supreme Court to take the Texas case against the States of Georgia, et al, has an interesting twist, a consequence that comes back to bite you in the ass.
Texas is arguing that, when counting votes, the law must be adhered to. On the other hand, Georgia, et al, are arguing that the rules DO NOT have to be adhered to. By keeping out of the argument, The Supreme Court is, by default, saying "We don't care one way or the other. Either keep to the rules or break them, it's ok!!" That is now the highest legal ruling in the land on the issue of vote counting.
So, after the Electoral College Votes are cast, it will be Mike Pence, in his capacity as President of The House who will count them. What happens if he decides to count them all for President Trump? The Supreme Court has now said they would be fine with that. I presume, then, that the Democrats will also think that is ok? After all, it would be perfectly "legal" and in many ways, perfectly just x
