Some thoughts on the current situation with the 2020 election…

Read the 12th Amendment which spells out the process of electing the President via the Electoral College…

there is no provision to consider anything but the slate of electors certified by the several States… no alternative certificates of ascertainment are mentioned in the Amendment… the sole role of the President of the Senate is to unseal the records sent by the several States of those electors and their votes recorded in the certificates of ascertainment, and count the votes in the presence of Congress… the alternate certificates will not even be considered…

however, there are real issues not treated in the 12th Amendment… if some of the States do not certify their electors and their votes, what happens to the count? Is it null and void, because not all states sent certification and therefore the electoral college vote is dumped and the next step in the process, a single vote from each state, as if no candidate had a majority, is enacted to elect the President? Or are those votes simply not cast for any candidates and the remaining votes decide the election based on a smaller total number of electors?

There is also the possibility, that certifications by some of the contested states will be changed, either by the courts or by the several legislatures, so up until Jan. 6, the States certifications may be changed by the legislatures or be in legal limbo in the courts, as appeals continue

Then there are the issues of the the 2018 EO targeting foreign interference in the elections… what exactly is the President empowered to do (like seize all election records in all the states and audit them) and what push back is expected from the MSM and Democrats?

Also, the Insurrection Act of 1807… what exactly is the President empowered to do, how bad the optics of this move is and what the MSM and Democrats might do as push back?

Finally, Gen. Flynn's limited martial law proposal… what exactly should be the scope of this, how bad the optics are again and what can be expected from the MSM and the Democrats?
