California Appeals Court Blocks Judge’s Order Allowing San Diego Restaurants to Resume Indoor Dining – Keeps Newsom’s Lockdown in Full Effect

 

A California appeals court on Friday evening blocked a judge’s order that allowed San Diego restaurants to resume indoor dining.

 

Governor Newsom’s lockdown order is now in full effect in San Diego.

 

A California judge on Thursday snubbed Governor Newsom’s authoritarian Covid order and said San Diego restaurants can resume indoor dining.

 

The case was originally brought to the court by two San Diego strip club owners.

 

Newsom recently put most of California in the most restrictive “purple tier” lockdown and closed virtually all indoor businesses. Only big box retailers that sell stuff made in China are allowed to stay open while small businesses are forced to close down.

 

Cheetahs Gentlemen’s Club and Pacers Showgirls International led the way and previously sued the county and state.

 

San Diego Superior Court Judge Joel Wohlfeil last month said strip clubs are exempt from Newsom’s Covid order and during a hearing on Thursday clarified his previous injunction also included all restaurants.

 

However, Newsom’s lawyers immediately asked for emergency intervention to close down restaurants and punish small business owners.

 

“In the midst of the worst surge in the COVID-19 pandemic … a single trial court judge has unilaterally thwarted public efforts to avert that looming catastrophe, by issuing an injunction that allows all restaurants in San Diego County to reopen without any restriction, contrary to the orders and judgment of the State’s top health officials,” lawyers for Newsom wrote in their filing with California’s Fourth Appellate District.

 

A three-judge panel in California’s 4th Appellate District immediately sided with Newsom’s lawyers and did not give an explanation for their decision to block the judge’s order.

President Trump Signs Bill To Bar Chinese Companies From US Stock Exchange

 

"The Holding Foreign Companies Accountable Act" will target Chinese companies such as Alibaba and PetroChina Co Ltd.

 

President Donald Trump signed the Holding Foreign Companies Accountable Act on Friday in an effort to prohibit foreign companies from being on the US stock exchange.

 

The act “requires certain issuers of securities to establish that they are not owned or controlled by a foreign government.” In order to establish this, the companies will have to cooperate with audits by the U.S. Public Accounting Oversight Board.

 

If the board can’t “inspect the issuer’s public accounting firm for three consecutive years, the issuer’s securities are banned from trade on a national exchange or through other methods,” according to the Congress website.

 

“Foreign issuers of securities that use such a firm to prepare an audit report must disclose for each non-inspection year

 

the percentage of shares owned by governmental entities where the issuer is incorporated,

whether these governmental entities have a controlling financial interest,

information related to any board members who are officials of the Chinese Communist Party, and

whether the articles of incorporation of the issuer contain any charter of the Chinese Communist Party.”

 

Chairman of the US Securities and Exchange Commission Jay Clayton issued a statement following the enactment of the new law.

 

Over the last several years, my colleagues and I have taken a number of actions to bring greater attention to, and to further address, the various risks associated with investing in emerging markets, including China.[1] Additionally, as part of the President’s Working Group on Financial Markets, I supported the July 2020 release of the Report on Protecting United States Investors from Significant Risks from Chinese Companies (“PWG Report”).[2]

 

This comes as the recently hacked SolarWinds board of directors’ ties to Chinese companies make way to public view, as National File reported.

 

SolarWinds director Seth Boro, a man who was instrumental in starting the private equity firm known as Thoma Bravo, “currently serves on the board of directors of several software and technology service companies in which certain investment funds advised by Thoma Bravo hold an investment,” according to his biography on the SolarWinds website.

 

In 2019, Thoma Bravo bought JD Power for $1.88 billion from XIO Group, a mysterious Chinese company based in Hong Kong.

 

Furthermore, National File reported that another SolarWinds board director had “led the establishment” of a $75 billion investment firm into China.

 

According to his biography on the Silver Lake website, Kenneth Hao “led the establishment of the firm’s offices in China and Japan and led Silver Lake’s investments in Alibaba Group” from 2008-2011.

 

Silver Lake also notes that “Hao currently serves as a director on the boards” of several companies, including SolarWinds.

 

The aftermath of the SolarWinds breach has left Americans with national security concerns. Amid the signing of the Holding Foreign Companies Accountable Act, the country awaits the delayed foreign election interference report from DNI John Ratcliffe.

 

As the joint statement reads, the agencies issued an Emergency Directive which instructed federal civilian agencies “to immediately disconnect or power down affected SolarWinds Orion products from their network” due to exploitation from “malicious actors.”

'Updated' Arizona Billboard Shows Donald Trump as Prisoner

 

In 2017, artist Karen Fiorito created a billboard mocking the US president, Donald Trump, amid dollar signs made to look reminiscent of swastikas. The picture had been located along Grand Avenue near 11th Avenue in Phoenix, Arizona.

 

Artist Karen Fiorito has reconsidered her piece of art that has remained on a billboard for over three years, now placing Trump’s image behind bars, and changing his clothes to a glaring neon orange prison jumpsuit that says “Don the Con”.

 

On 17 December, Fiorito commented on the new installation on her Facebook page: "What should we call it? 1. Don the Con 2. Lock Him Up 3. Bye Don! 4. Trump for Prison 2020."

 

The derisive billboard initially depicting Trump as a Nazi reportedly belongs to Beatrice Moore, who commissioned the artist.

 

The initial artwork, called “Trumpocalypse”, was taken down in June.

 

Outgoing US President Donald Trump could face prosecution when he steps down from the White House on 20 January, losing presidential immunity.

 

According to the New York Times, Trump is already involved in 30 civil and criminal cases related to his election campaign and allegations of tax evasion.

 

On 4 December, he personally expressed concern that people who failed to sue him while he was the US president, have now sent all relevant information to New York “so that they can try to get him there".

 

The US president has not yet conceded to his Democratic rival, Joe Biden, although the 14 December Electoral College presidential election vote results show that the latter has gained the majority. Trump continues to contest the election outcome by filing multiple unsuccessful lawsuits alleging voter fraud.

Mitt Romney criticizes Trump for 'inexcusable silence and inaction' on suspected Russian cyberattack compromising US agencies

Sen. Mitt Romney (R-Utah) criticized President Donald Trump for what he called "inexcusable silence and inaction" on a serious Russian cyberattack that compromised government agencies.

 

The Cybersecurity and Infrastructure Security Agency identified a serious cyberattack on SolarWinds Orion, a network monitoring application, that could have began as far back as March. The attack exposed numerous networks used by the U.S. government as well as state and local agencies.

 

"This threat actor has demonstrated sophistication and complex tradecraft in these intrusions," said the CISA in a statement on Thursday. "Removing the threat actor from compromised environments will be highly complex and challenging."Romney on Thursday released a statement expressing his alarm at the attack and also criticizing the president for his silence.

 

"The cyber attack is like Russian bombers have been repeatedly flying undetected over our entire country," said Romney. He then listed the dangers associated with the attack.

"Past time for national security re-set that prioritizes cybersecurity capabilities and defenses," he added.

 

Romney said in a Sirius radio interview that the attack showed "that our cyber warfare readiness is extraordinarily weak, that they think so little of our ability to fight back from a cyber standpoint that they do this with impunity."

 

Romney joins a chorus of voices demanding a response from the White House, while President-elect Joe Biden has already released a statement from his transition team.

 

"A good defense isn't enough; We need to disrupt and deter our adversaries from undertaking significant cyberattacks in the first place," Biden said.

 

"We will do that by, among other things, imposing substantial costs on those responsible for such malicious attacks, including in coordination with our allies and partners," he added. "Our adversaries should know that, as President, I will not stand idly by in the face of cyber assaults on our nation."

 

Intelligence officials suspect the cyberattack came from Russian state actors, but the Russian government has denied the allegations.
