While @Raiklin said Pence needs to send letter to Governors/States today, I do not see a letter from Pence is critical informing Governors/States.

 

In all of the contested states, there are either ongoing legal battles and/or State Legislatures holding hearings. They know their states have issues. Pence pointing it out is not critical.

 

Sending a letter today is showing your hand, IMO, and giving the enemy time to come up with a stronger defense.

 

06 Jan is the day that matters. Pence can bring up ongoing court cases, State Legislature issues, etc on that day and not count those votes due to ongoing and/or unresolved issues.

 

My take. Not a Constitutional lawyer like @Raiklin.

Alternatively, he can send the letters today/tomorrow/whenever by certified mail, return receipt requested, I am sure, and present the return receipt on 06 Jan.

 

No reason to play the hand today, IMO.

I really do not think he has to, again, IMO.

 

There is ongoing court cases, as stated.

 

Pence can wait for the conclusion of those court cases.

 

If not concluded, he can make a decision on 06 Jan.

 

For example, SCOTUS giving states until 14 Jan is not Pence's duty to warn states that this BS date will leave their case unresolved.

 

States, IMO, violated the safe harbor deadline by certifying votes prior to resolution of cases.

 

And if he MUST notify, I go back to certified return receipt requested.

 

Why give them more time to create a stronger defense?
