Hunt & Hunt NSW Managing Partner Jim Harrowell AM accompanied Her Excellency the Honourable Margaret Beazley AO QC, Governor of New South Wales, as part of the delegation on a Vice Regal Mission to the People’s Republic of China.

 

The visit marks the 40th anniversary of the Sister-State relationship between New South Wales and Guangdong Province, reinforces the important relationship between China and New South Wales, and shows support for the NSW-Guangdong Joint Economic Meeting to be held in Sydney in October.

 

Jim attended the trip in his role as the NSW Special Envoy to China. In this role, Jim provides advice and assistance to the Premier of NSW, the Minister for Trade and various New South Wales Department and Agencies on engaging with China to develop two-way trade and investment.

 

During the trip, Governor Beazley undertook high-level meetings with His Excellency Mr Ma Xingrui, Governor of Guangdong; Mr Chen Rugi, Mayor and Secretary of the Party Leadership Group of the Shenzhen Municipal People’s Government; as well as numerous Australian and Chinese business people in Guangzhou and Shenzhen.

 

The Governor’s visit to China underlines the important bilateral relationship between Guangdong and New South Wales.

Personal Experience

Providing easy to understand comprehensive advice while taking into account key issues has been the driving force of Jim’s success as a specialist commercial and litigation lawyer for more than 30 years.

 

His managerial responsibilities reflect the invaluable skills he brings to our practice. Jim is currently the Head of the Litigation and Dispute Resolution Group in our Sydney office. He is a previous National Chairman and National Managing Partner of the firm and was also Chief Legal Representative of the Hunt & Hunt Shanghai office.

 

With clients spanning Australia and the globe, Jim’s commercial law expertise is widespread, covering legal, strategic, commercial, governance and reputation issues.

 

Jim’s in-depth knowledge of international legal issues is second to none. As a Director and former Chairman of Interlaw and through his wide network of contacts in more than 115 major global cities, Jim has provided commercial advice to clients for over 20 years ranging from negotiating joint ventures and resolving disputes, to mediation, litigation and arbitration.

 

China is undoubtedly his stronghold. In 2006, Jim was appointed a Member of the Order of Australia for service to international relations, particularly the development of legal and business links with China and in 2012 UNSW recognised his work in China with the award of Doctor of Laws Honoris Causa. Jim is currently the New South Wales Special Envoy for China and he is the immediate past President of the Australia China Business Council NSW branch.

 

He is one of seven Australians appointed to the China International Economic and Trade Arbitration Commission (CIETAC) panel of arbitrators, and is the only Australian appointed to the Shanghai Arbitration Commission. Jim regularly presents seminars on China and assists Austrade programs in Beijing and China.

 

Jim appears as Counsel on matters in the Supreme Court, Federal Court and, at times, the High Court. A selection of the matters on which Jim represents his clients include:

 

Construction – the Moomba–Sydney Gas Pipeline and the Sydney Superdome

Defence – acting for Australian Submarine Corporation on many issues including contractual matters and intellectual property and for Thales on a tender dispute concerning The Australian Advanced Air Traffic System (TAAATS)

Trade Practices – advising on exclusive dealing and misleading conduct and constitutional issues, for example Jewel Foodstores on interstate trade in milk

Corporations Law – including ASIC investigations

Royal Commissions – appearing as Counsel for clients called before the Royal Commission into Institutional Abuse of Children in several case studies over many weeks.

Insolvencies – acting for the US receiver appointed by the US Securities & Exchange Commission regarding a US$300 million Ponzi scheme and most recently for the liquidator in recovery actions against the Obeid family

Appearing as counsel on international trade disputes in Chinese Arbitrations for Elders Limited relating to the export of cattle to China

Enforcement of foreign arbitration awards.

Jim’s corporate experience includes over 12 years working with government as Chair of the Commonwealth company responsible for the accreditation of aged care faculties in Australia where he reported directly the Minister of the day and worked closely with Commonwealth government departments.

China disputes and arbitration

Hunt & Hunt regularly assists on resolving commercial disputes in China involving litigation and arbitration. We have appeared as Counsel on a number of occasions in CIETAC Arbitrations in Beijing particularly in relation to trade disputes.

 

China joint ventures

We help Chinese businesses select and establish business partners, trading entities and joint ventures in Australia, as well as help establish equity and cooperative joint ventures, WOFEs and representative offices in China. We have assisted investors from China in joint ventures across a variety of industries including mining and resources, agriculture, health, aged care and property.

 

More than just legal advice

Our team provides government and commercial introductory services to help you explore Chinese trade and business opportunities. We conduct market research and feasibility studies, including the development of market entry strategies. We also provide English and Chinese language translation services in-house or by referral to external translators.

 

Forging stronger business ties with China

Our lawyers regularly participate in outbound business delegations to promote Australia's capabilities to the Chinese business community. Our partners attend trade missions to China, sponsored by the Australian federal and state governments. We also regularly host visiting Chinese delegations.

Personal Experience

With over 25 years experience in commercial litigation and dispute resolution, Charles has built a solid reputation for delivering commercially decisive and cost-effective results.

 

As head of our national insolvency and debt recovery practice, Charles has a strong track record in litigating insolvency matters for both secured and unsecured creditors and for debtors. He is also an expert in the practice and procedure of the Federal, Supreme, District and Federal Magistrates Courts.

 

Despite his proven litigation skills, Charles is acutely aware that, at times, mediations and negotiations will achieve far more successful outcomes for his clients.
