"The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;"
So, Pence should count and tally the ballots on his own, in the Presence of the House and Senate, but ensure that everyone stays anywhere from 60 ft to 100 ft away when this occurs. And then, Pence should deny access to anyone to be able to see the actual ballots afterwards, and then declare Trump/Pence the Winner by 271 to 269.
No. That's the way it works now and nobody can argue against it. He's still obeying the law.
