US Judge Dismisses Lawmaker Lawsuit Against Pence Over Electoral Count

A U.S. judge on Friday rejected a lawsuit filed by a Texas lawmaker and other Republicans against Vice President Mike Pence who is set to preside Wednesday over a joint session of Congress to formalize the results of the 2020 presidential election.

 

U.S. District Judge Jeremy D. Kernodle said Rep. Louie Gohmert and other Republicans who filed suit lack standing to bring the legal action seeking to overturn the election of President-elect Joe Biden.

 

Gohmert's brief claimed Pence can overrule the Electoral College and effectively decide the 2020 presidential election himself

 

Under the Constitution, Gohmert claims in a brief, Pence has the authority to conduct that proceeding as he sees fit. He may count elector votes certified by a state’s executive, or he can prefer a competing slate of duly qualified electors. He may ignore all electors from a certain state. That is the power bestowed upon him by the Constitution.

 

He adds that the Twelfth Amendment of the Constitution unequivocally entrusts to him [Pence] all the prerogatives and rights to determine what electoral votes to count.

 

The congressman’s lawyers claim that a court striking down a century-old law that keeps Congress in control of counting electoral votes is the best solution for resolving ongoing contention over the election.

 

On Wednesday, the Electoral College tally giving Biden the election and the presidency is to be accepted formally by Congress, a typically ceremonial process. This year, though, potent allegations of widespread voter fraud leveled by President Donald Trump have spurred questions about every step of the election process.

 

Indeed, dozens of Republican congressmen and at least one senator, Josh Hawley, threaten to bog down the approval, even if they ultimately can't derail it and upend the election outcome.

 

On Thursday, weighing in on Pence's behalf, Justice Department lawyers urged the judge to dismiss Gohmert's case. They said he should have sued the U.S. Senate or the House of Representatives if he disagrees with the established way that Electoral College votes are counted.

 

According to news reports by DailyMail.com and The New York Times, that shocked and disappointed Trump, who himself called Pence to express his "suprise" over DOJ's intervention against the legal case.

Report: President Unhappy DOJ Interfered With Gohmert Suit

President Donald Trump reportedly was not pleased the Department of Justice responded on Vice President Mike Pence's behalf to shoot down a lawsuit aiming to expand Pence's powers during the electoral vote certification.

 

Rep. Louie Gohmert, R-Texas, filed a failed lawsuit Tuesday saying Pence could overturn the election results all by himself. President-elect Joe Biden defeated Trump in the election.

 

However, Pence's lawyer, Deputy Assistant Attorney General John Coghlan, pointed out Thursday night that in order to sue, the plaintiff and the defendant must be in opposition. Here, Gohmert and Pence's interests are aligned, per the Daily Mail.

 

New York Times White House correspondent Maggie Haberman tweeted the president was not happy with Coghlan's actions.

 

"POTUS was not pleased that DoJ responded on Pence's behalf in the Gohmert et al lawsuit trying to expand the VP's procedural role on Jan 6, per 3 ppl briefed. POTUS called Pence this AM to express some surprise about it; he has been more vocal with others about his displeasure," Haberman tweeted Friday.

 

Pence himself had asked the court to reject Gohmert's lawsuit.

 

In a new filing Friday afternoon, Gohmert argued Pence simply was more than simply a "glorified envelope-opener in chief" during the electoral vote certification.

 

"Under the Constitution, he has the authority to conduct that proceeding as he sees fit," Gohmert wrote. "He may count elector votes certified by a state's executive, or he can prefer a competing slate of duly qualified electors. He may ignore all electors from a certain state. That is the power bestowed upon him by the Constitution."

 

As he had done after the initial filing, Texas U.S. District Judge Jeremy Kernodle threw out Gohmert's suit on Friday night.

 

Gohmert argued the 1887 Electoral Count Act violated the 12th Amendment, which outlines the procedure for electing the president and vice president. The amendment, ratified in 1804, says the "President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall be counted."

 

The lawsuit argued the "President of the Senate," which is Pence, has the sole authority to determine which votes to count.

Biden Overruled Electoral Certification Objections in 2017

When House Democrats objected to the 2017 Electoral College vote certification that gave then-President-Elect Donald Trump victory, they were overruled by one of their party leaders: Joe Biden.

 

Biden, then vice president, presided over the certification of electoral votes.

 

On Jan. 6, a joint session of Congress again will meet, this time to certify results of the 2020 election in which Biden defeated President Trump.

 

Sen. Josh Hawley, R-Mo., has said he will join a group of Republican representatives who have announced they will object to the certification. If so, that will guarantee both chambers debating the election results.

 

President Trump has alleged that voter fraud in several key battleground states gave Biden the triumph.

 

"I don’t hear the Democrats making outrageous claims when they were the ones who were objecting to electoral college certification in 2004 and 2016," he told the Fox News Network on Wednesday. "Democrats have done this for years to raise concerns about integrity."

 

Congressional members and protesters interrupted Biden during the certification four years ago. Democrats objected 11 times, according to CNN.

 

Democrats claimed then President-elect Trump prevailed in an unfair 2016 election due to either Russian interference or voter suppression.

 

When Rep. Pramila Jayapal, D-Wash., objected to Georgia's vote certificate, Biden replied: "It is over.''

 

When Rep. Barbara Lee, D-Calif., Rep. Sheila Jackson Lee, D-Texas, and Rep. Raúl Grijalva, D-Ariz., objected, a visbily agitated Biden replied, "There is no debate. There is no debate. There is no debate."
