Trump Tells America To Prepare For Week “That Will Change History”

An insightful new Security Council (SC) report circulating in the Kremlin today discussing events relating to Day 60 of the election war currently raging in America, says first to note is the New York Post being the best to summarize what will be one of the most consequential weeks in American history by them stating yesterday: “With apologies to Mark Twain, reports about the death of Trumpism are premature…At least for a few days more, Donald Trump has license to keep upsetting apple carts in Washington…Just when it seemed the president was roadkill and about to be abandoned by his own party, growing numbers of GOP members of Congress are signing on to a last-ditch effort to challenge the election results”.

 

Is a summarization describing the remarkable events occurring yesterday showing that President Donald Trump is prepared to do anything needed to save this nation from tyranny, that began by him posting a message to the American people about what is happening and calling it: “An attempt to steal a landslide win…Can’t let it happen!”—that was quickly followed by his message stating: The BIG Protest Rally in Washington D.C., will take place at 11:00 A.M. on January 6th. Location to follow. StopTheSteal!”—then saw the “March For Trump” website suddenly appearing so the American people can reply to this event—after which President Trump posted a video message urging his tens-of-millions of supports to come and support him with the message stating: “This could be the biggest event in Washington DC history!”.

 

Actions taken by President Trump against this corrupted and stolen election then joined by the article “The Big Reveal—How Trump Will Change History On January 6th”, wherein it notes numerous troubling facts such as: “Dan Scavino posts “GAME ON” meme, with Pence in the doorway between darkness and light…On Jan 6th, any member of Congress who votes for the Biden slate of fraudulent electors is admitting to complicity in treason and may face arrest and prosecution…Georgia Governor and Sec. of State order the mass destruction of fake ballots, trying to destroy evidence as quickly as possible before they both get arrested and prosecuted”.

 

All of which are events expected by Security Council Members, who unlike the vast majority of the American people know the truth that under Article II of the Constitution it makes President Trump the supreme law enforcer in the United States—is a Constitutional mandate that makes every US federal law enforcement agency, intelligence organization and Department of Justice subordinate to President Trump—which means that by himself, and him alone, President Trump has the full authority to criminally have charged and prosecuted anyone found committing fraud in a US federal election.

 

A fact most assuredly known to the up to 140 of the 211 Republican Party members of the US House vowing to vote against the certification of this election on the grounds that results in some States are not trustworthy, and to US Senator Josh Hawley, who is also objecting to this election’s certification—all of whom know that to certify a corrupted and stolen election is a grave US federal crime—though most astonishing to notice, are socialist Democrats now calling Senator Hawley’s objection to certification a “coup attempt”—the same socialist Democrats who have themselves objected to every Republican presidential vote certification this century.

 

Though to understand why socialist Democrats are really in terror about Senator Hawley’s objection, Security Council Members this past week noted is because it means that 6 January will become one of the most consequential days in American history, as it puts the never used, untested and maybe unconstitutional law known as the Electoral Count Act of 1887 on a direct collision course with the 12th Amendment (aka Contingent Election) to the Constitution of the United States of America, which is the supreme law of the United States—with the critical difference between them being that while the Electoral Count Act of 1887 says a majority vote in the US House of its members can rule on objections, the 12th Amendment orders this vote in the US House to made by its State delegations—and is a US House whose majority members belong to the socialist Democrat Party, but whose Republican Party members comprise the majority of State delegations 26 to 24.

US federal law vs. Constitution facts most certainly known about by US Senator Ted Cruz, who is a renowned constitutional legal scholar—and is critically important to notice because immediately after President Trump sent out his historic messages yesterday, they were followed by Senator Cruz publishing the astonishing document: “Joint Statement from Senators Cruz, Johnson, Lankford, Daines, Kennedy, Blackburn, Braun, Senators-Elect Lummis, Marshall, Hagerty, Tuberville”—an unprecedented and historic document wherein eleven current and incoming Republican Party US Senators said they would vote to reject the Electoral College votes of some States on 6 January as “not lawfully certified” unless the US Congress appoints a commission to conduct “an emergency 10-day audit of the election results”—would be a 10-day audit with “full investigatory and fact-finding authority”, and afterward “individual states would evaluate the Commission’s findings and could convene a special legislative session to certify a change in their vote, if needed”—and just minutes after this document was published, then saw Vice President Mike Pence’s chief of staff Marc Short releasing an announcement stating: “Vice President Pence shares the concerns of millions of Americans about voter fraud and irregularities in the last election…The Vice President welcomes the efforts of members of the House and Senate to use the authority they have under the law to raise objections and bring forward evidence before the Congress and the American people on January 6th”.

 

Stunning and obviously coordinated events that, in turn, ignited a leftist mainstream propaganda media firestorm, best exampled by the New York Times screaming: “Neither Mr. Pence nor any of the senators who said they would vote to invalidate the election has made a specific allegation of fraud”, and the Washington Post crying: “Trump has made plain his goal with the certification process: to overturn the results of an election he insists was “rigged,” though he has produced no evidence to support that claim”—leftist rage-filled screams and cries, however, having nothing whatsoever to do with facts or reality, as the specific allegations of fraud in this election are overwhelming, and the evidence to support these allegations of fraud have indeed been produced in multiple US federal and State courts, though nearly all of them have been dismissed without any of this evidence being heard—and are election crimes so numerous, dangerous to democracy and blatant, former top CIA official Robert Caron has now assembled a task force of over 400 ex-intelligence officers from the FBI, CIA, Military Intelligence, DIA, and National Security Agency to investigate how this could have happened and who was behind it.

Trump Speaks to State Legislators on Call About Decertifying Election

President Trump spoke to 300 state legislators from the battleground states of Arizona, Michigan, Wisconsin, Pennsylvania, and Georgia on Saturday in a Zoom conference call hosted by Got Freedom? in which the 501 (c) (4) non-profit

 

election integrity watchdog group urged those lawmakers to review evidence that the election process in their states was unlawful and consider decertifying the results of the November 3 presidential election.

President Trump addressed the call for 15 minutes at the invitation of former New York City Mayor Rudy Giuliani, who now serves as the president’s personal attorney, and was one of the featured speakers on the call.

 

Other featured speakers included Chapman Law School Professor John Eastman, Dr. Peter Navarro, Assistant to the President for Trade and Manufacturing (appearing in his personal capacity), John Lott, Senior Advisor, U.S. Department of Justice (also appearing in his personal capacity), and Liberty University Law School Professor Phill Kline.

Kline, a former attorney general in Kansas, is a spokesperson for the 501 (c) (4) Got Freedom? non-profit, and also serves as director of the 501 (c) (3) Amistad Project of the Thomas More Society, an election integrity public interest law firm which is engaged in litigation regarding the 2020 election.

In a press statement released after the call, GotFreedom? said they conducted Saturday’s “exclusive national briefing . . . at the request of state legislators from Michigan, Pennsylvania, and Wisconsin to review the extensive evidence of irregularities and lawlessness in the 2020 presidential election.”

“A similar briefing is being scheduled in Washington, D.C. at the request of Members of Congress,” the group noted.

 

A joint session of the newly convened 117th Congress will meet in Washington, D.C. on Wednesday to determine if they will accept the results of the December 14 meeting of the Electoral College, in which Joe Biden received 306 Electoral College votes for president and Donald Trump received 232 Electoral College votes.

If at least one member of the House of Representatives and one member of the Senate object to certifying those votes on Wednesday, each chamber must then separately hold a debate on whether to accept those Electoral College votes.

More than 30 members of the House have already announced they will object to certification. Last week, Sen. Josh Hawley (R-MO) announced he will publicly object to certification.

Then on Saturday, as Breitbart News reported, 11 Republican senators said they would vote not to certify on Wednesday and would instead recommend the establishment of a commission to review the lawfulness of the election process in

 

the disputed states in a full election audit. That commission would have ten days to review the evidence and report back to the joint session of Congress.

“This information should serve as an important resource for state legislators as they make calls for state legislatures to meet to investigate the election and consider decertifying their state election results,” Kline, who hosted the call on behalf of Got Freedom? said.

“The integrity of our elections is far too important to treat cavalierly, and elected officials deserve to have all relevant information at their disposal as they consider whether to accept the reported results of the 2020 elections, especially in states where the process was influenced by private interests,” Kline added.

The private monies paid the salaries of election workers and funded the purchase of election equipment, but came with strict conditions on the conduct of elections in jurisdictions that accepted the money. These private interventions were aided by the actions of public officials, who sought to undermine transparency, fought efforts to audit the results, threatened legislators with investigation and prosecution for questioning the reported results, and in some cases even physically prevented state lawmakers from entering the Capitol Building in order to prevent them from challenging election certification.

A communication sent to participating state legislators after the call summarized Professor Eastman’s argument during the call about the specific “Constitutional imperatives” of state legislators.

State legislators, Eastman stated, have both the right and duty to:

Assert your plenary power

Demand that your laws be followed as written

Decertify tainted results unless and until your laws are followed

Insist on enough time to properly meet, investigate, and properly certify results to ensure that all lawful votes (but only lawful votes) are counted.

In that subsequent communication, Kline encouraged the state legislators to:

… agree to sign on to a joint letter from state legislators to Vice President Mike Pence to demand that he call for a 12-day delay on ratifying the election, allowing the states the necessary time to further investigate the lawlessness with which the presidential election was conducted. He added that “Representative Daryl Metcalfe (R-Pennsylvania), Senator Brandon Beach (R-Georgia), and Representative Mark Finchem (R-Arizona) already wrote a letter to Vice President Mike Pence for this narrow purpose. Defense Motion to Compel Classified Material Pursuant to M.C.R.E. 505

  1. Procedural History.

a. The Defense in AE 045B moved the Commission “to compel disclosure of the

classified material at issue in AE 045 ” and “disclosure pursuant to M.C.R.E. 505(f)(1)(B) because the information is material to his sentencing.”1 The Government response at AE 045D2 urged the Commission to deny the Defense motion because AE 045 was “properly filed . . . ex parte, in camera and under seal, as expressly provided for in the Military Commissions Act (MCA). See 10 U.S.C. §§ 949p-1–p-7 and [t]he content of, and purpose for, the Government’s filing in AE 045 has absolutely no relationship to, let alone relevance and helpfulness to, the Accused’s “legally cognizable defense, rebuttal of the prosecution’s case, or to sentencing.” 10 U.S.C. § 949p-4(a)(2).” The Defense did not file a reply.

b. The Commission in AE 049,3 set the Defense motion for oral argument. That hearing was cancelled on 14 November 2020.4 Initial oral argument on AE 045 and by extension AE 045B5 was presented on 26 February 2020. Upon additional reflection the Commission finds additional oral argument is not necessary to resolve the issue presented in AE 045B. In

accordance with Rule for Military Commission (R.M.C.) 905(h) the decision to grant oral argument on a written motion is within the sole discretion of the Military Judge.” Any request for oral argument on this motion, express or implied, is DENIED.

  1. Law and Analysis.

a. While couched as a motion for disclosure, the Commission takes the Defense motion as a motion for discovery of the classified information in AE 045. R.M.C. 701(c)(1) requires the Government to produce books, papers, and documents that are “material to the preparation of the defense” when such documents are “within the possession, custody, or control of the Government, the existence of which is known or by the exercise of due diligence may become known to trial counsel.” The materiality standard is not normally a heavy burden. Evidence is material if there is a strong indication that the information will “play an important role in uncovering admissible evidence, aiding witness preparation, corroborating testimony, or assisting impeachment or rebuttal.” United States v. Lloyd, 992 F.2d 348, 351 (D.C. Cir. 1993) (citations omitted). Information is also discoverable if it is exculpatory as set forth in R.M.C. 701(e) and explained in Brady v. Maryland, 373 U.S. 83, 88 (1963). Finally, information is discoverable if it would tend to reduce the sentence. R.M.C. 701(e)(3).

b. “[C]lassified information is not discoverable on a mere showing of theoretical relevance in the face of the government's classified information privilege . . . .” United States v. Yunis, 867 F.2d 617, 623 (D.C. Cir. 1989). The court in Yunis determined the information sought by the defense was not discoverable because, “[n]othing in the classified documents in fact goes to the innocence of the defendant vel non, impeaches any evidence of guilt, or makes more or less probable any fact at issue in establishing any defense to the charges.” Id. at 624.

c. The Government has the responsibility to determine what information it must disclose in discovery. R.M.C. 701(b)–(c); United States v. Briggs, 48 M.J. 143 (C.A.A.F. 1998); Pennsylvania v. Ritchie, 480 U.S. 39, 59 (1987). “Unless defense counsel becomes aware that other exculpatory evidence was withheld and brings it to the court's attention, the prosecutor’s decision on disclosure is final. Defense counsel has no constitutional right to conduct his own search of the State’s files to argue relevance.” Ritchie, 480 U.S. at 59. It is incumbent upon the Prosecution to execute this duty faithfully, because the consequences are dire if it fails to do so. See United States v. Stellato, 74 M.J. 473 (C.A.A.F. 2015) (finding no abuse of discretion in military judge’s dismissal with prejudice of charges due to a Prosecution discovery violation); United States v. Bowser, 73 M.J. 889 (A.F. Ct. Crim. App. 2014), summarily aff’d 74 M.J. 326 (C.A.A.F. 2015)

d. The Commission has reviewed the information the Defense requests. The Commission finds the classified information in AE 045 has nothing to do with the presentation of the Defense’s case in extenuation and mitigation. The classified information is not relevant or material to the presentation of a case in extenuation or mitigation or the Defense’s physical ability to make its presentation. The relevance and materiality of the classified information at issue in AE 045 is best described as the court in Yunis case described the classified information at issue there – “[n]othing in the classified documents in fact goes to the innocence of the defendant vel non, impeaches any evidence of guilt, or makes more or less probable any fact at issue in establishing any defense to the charges.” Yunis at 624. Disclosure of the information for the sake of disclosure, in essence the Defense’s argument, is not a recognized legal standard for discovery of information in a criminal case.

EXPANDING EDUCATIONAL OPPORTUNITY THROUGH SCHOOL CHOICE

By the authority vested in me as President by the Constitution and the laws of the United States of America,

and in order to ensure the education, health, safety, and well-being of America's children, our most essential resource upon which the future of our great Nation depends, it is hereby ordered as follows:

Section 1. Purpose. As part of their efforts to address

the public health challenges and uncertainties posed by the

COVID-19 pandemic, State and local officials shut down in-person

learning for the vast majority of our more than 56 million

elementary and secondary school students beginning in late

February and early March of this year. Since then, however, our

Nation has identified effective measures to facilitate the safe

resumption of in-person learning, and the Federal Government has

provided more than $13 billion to States and school districts to

implement those measures.

The prolonged deprivation of in-person learning

opportunities has produced undeniably dire consequences for the

children of this country. The Centers for Disease Control and

Prevention has stated that school attendance is negatively

correlated with a child's risk of depression and various types

of abuse. States have seen substantial declines in reports of

child maltreatment while school buildings have been closed,

indicating that allegations are going unreported. These

reductions are driven in part by social isolation from the

schoolteachers and support staff with whom students typically

interact and who have an obligation to report suspected child

maltreatment. The American Academy of Pediatrics (AAP) has also

found that school closures have a "substantial impact on food

security and physical activity for children and families."

Additionally, a recent survey of educators found student

absences from school, including virtual learning, have nearly

doubled during the pandemic, and as AAP has noted, chronic

absenteeism is associated with alcohol and drug use, teenage

pregnancy, juvenile delinquency, and suicide attempts.

School closures are especially difficult for families with

children with special needs. Schools provide not only academic

supports for students with special needs, but they also provide

much-needed in-person therapies and services, including physical

and occupational therapies. A recent survey found that

80 percent of children with special needs are not receiving

the services and supports to which they are entitled and that

approximately 40 percent of children with special needs are

receiving no services or supports. Moreover, the survey found

that virtual learning may not be fully accessible to these

students, as children with special needs are twice as likely to

receive little or no remote learning and to be dissatisfied with

the remote learning received.

Low-income and minority children are also disproportionately

affected by school closures. In low-income zip codes, students'

math progress decreased by nearly 50 percent while school

buildings were closed in the spring, and the math progress of

students in middle-income zip codes fell by almost a third during

the same period. A recent analysis projected that, if in-person

classes do not fully resume until January 2021, Hispanic, Black,

and low-income students will lose 9.2, 10.3, and 12.4 months of

learning, respectively.

A failure to quickly resume in-person learning options is

likely to have long-term economic effects on children and their

families. According to a recent study, if in-person classes do

not fully resume until January 2021, the average student could

lose $61,000 to $82,000 in lifetime earnings, or the equivalent

of a year of full-time work. Additionally, in 2019, more than

90 percent of children under the age of 18 had at least one

employed parent. Many employed parents do not have the option

of engaging in remote work that allows them the flexibility to

supervise their children during the day when in-person learning

options are not available. Without the resumption of in-person

learning opportunities, the economic and social harms resulting

from such lost employment opportunities will continue to

compound.

To help mitigate these harms, the Department of Health

and Human Services recently announced additional relief for

low-income parents by allowing States to use funds available

through the Child Care and Development Fund to subsidize child

care services and services that supplement academic instruction

for children under the age of 13 who are participating in

virtual instruction. Nevertheless, virtual instruction is an

inadequate substitute for in-person learning opportunities and

this aid is insufficient to meet current needs.

While some families, especially those with financial means,

have been able to mitigate school disruptions through in-person

options such as homeschooling, private schools, charter schools,

and innovative models like microschools and "learning pods," for

many families, their children's residentially assigned public

school remains their only financially available option.

Unfortunately, more than 50 percent of all public-school

students in the United States began school remotely this fall.

These children, including those with special needs, are being

underserved due to the public education system's failure to

provide in-person learning options.

Students whose families pay tuition for their education

are also facing significant hardships due to the economic

disruptions caused by the pandemic. Scores of private schools,

including approximately 100 Catholic schools, have permanently

closed since the onset of COVID-19, and more than half of our

Nation's private schools are believed to have lost enrollment

due to the pandemic. These closures and declining enrollments

are harmful to students, bad for communities, and likely to

impose increased strain on public school systems.

I am committed to ensuring that all children of our great

Nation have access to the educational resources they need to

obtain a high-quality education and to improving students'

safety and well-being, including by empowering families with

emergency learning scholarships.

Sec. 2. Providing Emergency Learning Scholarships for

Students. The Secretary of Health and Human Services shall take

steps, consistent with law, to allow funds available through the

Community Services Block Grant program to be used by grantees

and eligible entities to provide emergency learning scholarships

to disadvantaged families for use by any child without access to

in-person learning. These scholarships may be used for:

(i) tuition and fees for a private or parochial

school;

(ii) homeschool, microschool, or learning-pod costs;

(iii) special education and related services,

including therapies; or

(iv) tutoring or remedial education.

Sec. 3. General Provisions. (a) Nothing in this order

shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive

department or agency, or the head thereof; or

(ii) the functions of the Director of the Office

of Management and Budget relating to budgetary,

administrative, or legislative proposals.

(b) This order shall be implemented consistent with

applicable law and subject to the availability of

appropriations.

(c) This order is not intended to, and does not, create

any right or benefit, substantive or procedural, enforceable at

law or in equity by any party against the United States, its

departments, agencies, or entities, its officers, employees, or

agents, or any other person.

Shana Broussard, Sean Cooksey, Allen Dickerson sworn in as Commissioners

December 18, 2020

WASHINGTON—Shana M. Broussard, Sean J. Cooksey and Allen Dickerson have been sworn in as members of the Federal Election Commission, returning a quorum to the agency charged with administering and enforcing federal campaign finance law. The Commission has jurisdiction over the financing of campaigns for the U.S. House, Senate, Presidency and Vice Presidency.

 

The three new Commissioners were nominated by President Donald J. Trump and confirmed by the United States Senate on December 9, 2020. Commissioner Cooksey, whose term will end on April 30, 2021, fills the vacancy in the seat previously occupied by Lee E. Goodman. Commissioner Broussard, appointed to a term ending April 30, 2023, fills the vacancy in the seat previously occupied by Ann M. Ravel. Commissioner Dickerson was appointed to a term ending April 30, 2025, and fills the vacancy in the seat previously occupied by Caroline C. Hunter.

 

“I am gratified that the Commission is finally back at full strength so that we can tackle the large backlog of enforcement cases and other vital work,” said Chair James “Trey” Trainor III. “I look forward to working with my outstanding new colleagues, each of whom brings valuable experience and perspectives to our common mission of administering and enforcing the federal campaign finance law in a just and fair manner.”

 

Commissioner Broussard of Louisiana joined the Commission in 2008 as an attorney in the Enforcement Division of the Office of General Counsel. In 2015, she was assigned on detail as Counsel for Commissioner Steven T. Walther, advising the Commissioner during his tenure as Chair in 2017 and continuing in that role until her own appointment as Commissioner. Commissioner Broussard previously was an Attorney Advisor at the Internal Revenue Service, Office of Professional Responsibility, and Deputy Disciplinary Counsel at the Louisiana Attorney Disciplinary Board. She also worked as a New Orleans Assistant District Attorney, and was appointed in that role to the Violent Offenders Strike Force. A proud alumna of two historically black universities (HBCUs), Commissioner Broussard earned her B.A. from Dillard University and her J.D. cum laude from Southern University Law Center. She received the NAACP 2015 Juneteenth Celebration Trailblazer Award for Terrebonne Parish in recognition of her achievement as the first African American attorney from Gibson, LA.

 

Commissioner Cooksey served most recently as General Counsel to U.S. Senator Josh Hawley, advising him on issues including constitutional law, judicial nominations, election law, federal criminal law, and ethics compliance. He previously served as Deputy Chief Counsel for U.S. Senator Ted Cruz. Prior to his Senate service, Commissioner Cooksey worked as an attorney at Gibson, Dunn & Crutcher LLP in Washington, D.C., where his practice focused on appeals and constitutional law. He also served as a law clerk for Judge Jerry E. Smith of the United States Court of Appeals for the Fifth Circuit. Commissioner Cooksey received his B.A., summa cum laude, from Truman State University and his J.D. from the University of Chicago Law School, where he graduated with High Honors and Order of the Coif.

 

Commissioner Dickerson served as Legal Director of the Institute for Free Speech from 2011 to 2020. At IFS, he led a nationwide First Amendment litigation practice and regularly appeared before legislative bodies and regulatory agencies. Ann Calvaresi Barr Sworn In as USAID Inspector General

Washington, D.C. — Today, Ann Calvaresi Barr became the U.S. Agency for International Development’s (USAID’s) fifth Inspector General. Ms. Calvaresi Barr was nominated to become Inspector General by President Obama in May 2015 and confirmed by the Senate earlier this month. She brings more than 30 years of experience in the federal oversight community to her new position.

 

As USAID Inspector General, Ms. Calvaresi Barr will oversee more than $20 billion in U.S. foreign assistance and development programs worldwide. She will lead an office of over 200 investigators, auditors, and other personnel who work to improve the effectiveness and efficiency of foreign assistance programs and deter waste, fraud, and abuse. Ms. Calvaresi Barr will also be responsible for oversight of the Millennium Challenge Corporation, the U.S. African Development Foundation, the Inter-American Foundation, and the Overseas Private Investment Corporation.

 

“Inspectors General play an important role in upholding the integrity of federal programs, including those providing aid and assistance overseas,” Ms. Calvaresi Barr said upon her swearing-in. “I look forward to working to protect the integrity of U.S. foreign assistance programs and ensure that the funds supporting them are well managed and used effectively.”

 

Prior to becoming USAID’s Inspector General, Ms. Calvaresi Barr served as Deputy Inspector General at the U.S. Department of Transportation. She also spent 25 years at the U.S. Government Accountability Office, where she served as a Director in the Acquisition and Sourcing Management Team and, earlier, worked overseas to evaluate defense, national security, and foreign disaster assistance programs.

President Obama nominates USAID IG, but many watchdog vacancies remain unfilled

President Obama has nominated Michael A. Carroll as inspector general for the U.S. Agency for International Development, an appointment that would fill a nearly two-year vacancy.

 

Carroll, who has served as the acting IG at USAID since 2011, has a long history with the agency's oversight office. He was deputy IG from 2006 to 2011, and before that was assistant inspector general for management.

 

He also served a stint as director of administration for the Department of Commerce's Bureau of Industry and Security from 2004 to 2006. The BIS keeps an eye on technology transfers from U.S. firms to foreign governments and companies.

 

Appointing someone from within an IG office has upsides and downsides, with the most significant of the latter being the potentially negative impact on an individual's independence, according to Joe Newman of the Project on Government Oversight, a non-profit watchdog group.

 

"What we ask of our IGs is that they come in and are aggressive and aren't intimidated by people who are at the top of the agencies," Newman said.

 

USAID has 87 international offices and spends billions of dollars every year on development and humanitarian projects overseas.

 

But USAID often flies under the radar, Newman said, so its involvement with foreign governments and projects means the agency needs strong oversight.

 

The biggest internal challenges the new IG will confront at USAID are assessing potential projects for weakness to avoid wasting money on unsuccessful grants; reporting accurate data that helps make decisions about future projects; and conducting audits of the U.S. for-profit companies that do a large share of its work.

 

The agency had a backlog of 370 unfinished audits as of September 2012. An agreement had been reached with the Defense Contract Audit Agency to do the audits, but DCAA has been slow to respond, according to USAID, so it has contracted with an auditing firm to help clear the backlog. In 2010, DCAA only completed 10 percent of audits within its 12-month goal.

 

USAID's biggest contractor, Chemonics International, is a for-profit company that received $735 million from the agency in 2011 for more than 100 projects around the world.

 

Carroll's nomination is one of several Obama has made in the last month. Obama has allowed at least seven IG positions to remain vacant for extended periods, including the State Department slot throughout former Secretary of State Hillary Clinton's five-year tenure.

 

Three of the seven vacancies now have nominees awaiting Senate confirmation, including Carroll.

 

Obama's slowness in filling vacant IG positions has drawn fire from critics in the non-profit watchdog and transparency communities.

 

"Inspectors General are the American people's inside advocates at federal agencies," said Mary Beth Hutchins, a spokesman for one such group, Cause of Action.

 

Without an IG overseeing them, deputy IGs can be granted too much autonomy, which can lead to accusations of waste and corruption, Hutchins said. She pointed to Charles Edwards, the acting IG at the Department of Homeland Security who is presently under investigation for complaints of nepotism and misconduct. Edwards has vigorously denied the allegations.

 

"If this is an administration committed to transparency and accountability, an Inspector General should be in place at each agency to actively root out the problems that have led to the GSA spending scandal, the IRS political targeting scandal, and the EPA private email scandal," Hutchins said.

Trump Issues “Criminal Offense” Election Warning—Then Leftist Media Goes Insane

A gobsmacking new Security Council (SC) report circulating in the Kremlin today discussing events relating to Day 61 of the election war currently raging in America, says first to note was Republican Party leader Georgia Secretary of State Brad Raffensperger releasing to the leftist Washington Post yesterday a recording of a call (Full Transcript) held between himself, his lawyers, President Donald Trump, his chief of stall and lawyers, dealing with issues relating to the stolen vote in Georgia—a recording that caused the leftist mainstream propaganda media to go insane and publish articles about it like “It’s Impeachable. It’s Likely Illegal. It’s A Coup”—and saw this event being quickly followed by Georgia Senate President David Shafer posting the message: “The audio published by @TheWashingtonPost is heavily edited and omits the stipulation that all discussions were for the purpose of settling litigation and confidential under federal and state law”—then saw him posting the message stating: “President @realDonaldTrum has filed two lawsuits - federal and state - against @GaSecofState…The telephone conference call @GaSecofState secretly recorded was a “confidential settlement discussion” of that litigation, which is still pending”.

 

An event made remarkable because this call was privileged and dealt with pending legal issues relating to the corrupted Georgia election involving the parties in this dispute—is most commonly known as a legal negotiation wherein the parties seek to resolve their differences before having to litigate them in court—was a call that saw President Trump being the only non-lawyer participating, though legal experts have noted about his grasp of the issues involved by stating: “The level of granularity was actually remarkable, especially for a President that the media continues to allege is not concerned with details”—and who further observed about this legal negotiation: “Throughout the call, the President makes clear that his calls are for election transparency, full and transparent audits, and public access…At no point does the President imply he wants votes invented or confected, as the establishment media is portraying…He even offers to recuse himself from parts of the conversation and ends by asking for ‘the truth… it’s just that simple’”.

 

Though most critical to notice about this legal negotiation call was President Trump using it as warning and making clear that he knows the exact crimes that happened in this election—such as revealing his knowledge of “vote scammer and hustler” Ruby Freeman and the 18,000 fraudulent votes she hid in suitcases to be counted when no one was observing and the ballots Georgia has just been discovered illegally shredding—saw President Trump in this negotiation attempting to give these Georgia election and State officials a way out by his saying “I’m not looking to shake up the whole world, we won Georgia easily…Look, ultimately, I win, OK?…Because you guys are so wrong”—then saw President Trump stating to these Georgia’s lawyers: “So what are we going to do here, folks?…I only need 11,000 votes…Fellas, I need 11,000 votes…Give me a break…You know, we have that in spades already…Or we can keep it going, but that’s not fair to the voters of Georgia, because they’re going to see what happened”.

All of which is occurring at the same time hundreds-of-thousands, if not millions of Trump supporters are descending upon Washington D.C. at the urging of President Trump for them to be there on 6 January—though beginning to be noticed is socialist leader Joe Biden staying silent and not even defending himself against these stolen election charges—a silence, however, not being observed by all the living former Defense Secretaries, who, for unknown reasons, suddenly released a letter yesterday warning President Trump and his Defense Department appointees that the election is over, the time for questioning the results has passed and they better not involve the military in the election fight—a shocking letter because it interjects the American military into this election without explaining why—and in noticing has caused shockwaves, best exampled by leftist journalist Susan Glasser posting the message: “The very worrisome question is why all 10 living former Secretaries of Defense, including Trump officials Esper and Mattis, chose to speak out now…What is the scenario they are worried about?”, and leftist journalist Steve Clemons posting the message: “Wake up folks…When 10 former SecDefs, including Esper and Mattis, join up & warn of dangers of military intervention in elections, they smell something, they feel something, they are worried”.

Acting United States Attorney Appointed For The Middle District Of Pennsylvania

 

HARRISBURG – The United States Attorney’s Office for the Middle District of Pennsylvania announced today that Bruce D. Brandler has been appointed Acting United States Attorney for the Middle District of Pennsylvania effective January 2, 2021. Mr. Brandler was appointed upon the resignation of former United States Attorney David J. Freed, which became effective at midnight on January 1, 2021. Mr. Brandler’s appointment is for three hundred days or until a Presidential appointment is made, whichever occurs first.

 

Mr. Brandler previously served as United States Attorney for the Middle District of Pennsylvania between October 2, 2016, and November 26, 2017. He was first appointed to the position by former Attorney General Loretta E. Lynch on October 2, 2016, and then reappointed by Order of the District Court Judges on January 30, 2017. Mr. Brandler served as First Assistant United States Attorney under former United States Attorney David J. Freed between November 27, 2017, and January 1, 2021.

 

Mr. Brandler began his legal career as an Assistant District Attorney in Brooklyn, New York, where he served from 1981 until 1985. Upon leaving the District Attorney’s Office, he became the Deputy Chief and then the Chief Investigative Counsel of the New York State Senate Committee on Investigations, Taxation and Government Operations from 1985 to 1986.

 

Mr. Brandler was appointed an Assistant United States Attorney for the Middle District of Pennsylvania in 1986 and was promoted to the position of Senior Litigation Counsel in 1992. In 2014, he became the Chief of the Criminal Division and served in that capacity until his appointment as United States Attorney in October 2016.

 

During his tenure as an Assistant United States Attorney, Mr. Brandler specialized in complex white-collar prosecutions, including high-profile public corruption cases. Some of the notable cases Mr. Brandler prosecuted included a tax evasion case against former Luzerne County Judge Arthur Dalessandro; a perjury case against former State Representative Frank Serafini; a bribery/extortion case against former Lackawanna County Commissioners Robert Cordaro and Anthony Munchak; an illegal campaign contribution and fraud case against Renato Mariani, the former President of Empire Sanitary Landfill, Inc.; a disadvantaged business enterprise fraud case against Joseph Nagle, the former President of Schuylkill Products, Inc.; an accounting fraud case against Paul Polishan, the former Chief Financial Officer for the Leslie Fay Companies, Inc.; and an environmental crimes case against Chemical Waste Management, Inc. for illegal dumping activities at a Superfund site in Lackawanna County.

 

Mr. Brandler graduated from Stony Brook University in 1978 and received a B.A. in Political Science with honors, and was inducted into the Phi Beta Kappa honor society. He received his law degree in 1981 from the Boston University School of Law. He resides in Harrisburg, Pennsylvania.

United States Attorney J. Douglas Overbey Announces Management And Supervisory Staff Changes

 

KNOXVILLE, Tenn. – J. Douglas Overbey, U.S. Attorney for the Eastern District of Tennessee, today announced changes in some of the management and supervisory personnel for the district.

 

Francis M. (Trey) Hamilton III has been chosen to serve as the First Assistant U.S. Attorney for the district. Hamilton, a native of Nashville, Tenn., joined the office in 2002, as an Assistant U.S. Attorney. He had previously served as a Deputy Chief and Senior Litigation Counsel in the Criminal Division. Over his career, Hamilton has overseen and tried numerous complex prosecutions ranging from corporate fraud to civil rights deprivation. Most recently, Hamilton was awarded the Attorney General’s Claudia J. Flynn Award for Professional Responsibility. Prior to joining the U.S. Attorney’s Office, Hamilton worked for two prominent national law firms where he engaged in complex civil litigation, and before that, he served as law clerk to the Honorable Jerome Turner, United States District Judge for the Western District of Tennessee. Hamilton received his law degree from Washington & Lee University School of Law, where he graduated summa cum laude, was inducted into the Order of the Coif, and served on the Washington & Lee Law Review. He earned his undergraduate degree from Rhodes College, where he graduated magna cum laude and was inducted into Phi Beta Kappa.

 

Caryn L. Hebets has been chosen to serve as Chief of the Criminal Division. Hebets, a native of Dearborn, Mich., joined the office as an Assistant U.S. Attorney in October 2005. She most recently served as a Deputy Chief of the Criminal Division and as the lead Organized Crime and Drug Enforcement Task Force (OCDETF) attorney for the district. Prior to joining the U.S. Attorney’s Office, Hebets was an Assistant Prosecuting Attorney for Berrien County, Mich., in addition to, working with the FBI. She received her law degree from Wayne State University and her undergraduate degree from the University of Michigan. She is a member of the Michigan bar.

 

Matthew T. Morris has been chosen to serve as Deputy Criminal Chief for the Knoxville office’s white collar and general crimes unit. He joined the U.S. Attorney’s Office in 1996. Since then, Morris has focused on prosecuting white-collar and child exploitation offenses, including environmental crime, fraud, public corruption, and child pornography. He has served as the U.S. Attorney’s Office’s Senior Litigation Counsel since 2018. Morris has previously headed up the office’s Project Safe Childhood, Environmental Crime, Asset Forfeiture, and Affirmative Civil Enforcement programs. Prior to joining the office, he was an Assistant Regional Counsel for the U.S. Environmental Protection Agency in Atlanta, GA, for five years. Morris earned his law degree in 1990, from the University of Oregon School of Law and his undergraduate degree from Kent State University in 1986.

 

Tracy Stone has been chosen to serve as Deputy Criminal Chief for the Knoxville office’s violent crimes and drug trafficking unit. Since joining the office in January 2006, Stone had prosecuted violent crimes, firearms offenses, and large-scale drug cases. For most of his tenure with the office, Stone has been assigned to the Organized Crime and Drug Enforcement Task Force (OCDETF). Established in 1982, to conduct comprehensive, multi-level attacks on major drug trafficking and money laundering organizations, the OCDETF program continues to be the centerpiece of the Department of Justice’s drug supply reduction strategy. Since 2010, Stone has dedicated significant time to battling the opioid epidemic, which hit the Eastern District of Tennessee particularly hard. Stone has successfully prosecuted hundreds of cases, including many successful jury trials. One of his more high-profile trials includes Eric Boyd’s federal trial for his role in the carjacking and murders of Channon Christian and Chris Newsom. Another is the recent four-month trial of Sylvia Hofstetter and three medical providers for their roles in operating illegal pill mills in Tennessee and Florida. Immediately prior to joining the United States Attorney’s Office, Stone prosecuted a variety of criminal cases, including several homicides, as an Assistant District Attorney in Tennessee’s Fourth Judicial District (Sevier, Cocke, Jefferson, and Grainger Counties). Previously, Stone was in private practice with the Chattanooga firm of Chambliss, Bahner & Stophel. Stone holds a Bachelors in Agricultural Economics from The University of Tennessee and is a 1999 Cum Laude graduate of the University of Tennessee College of Law.

David P. Lewen, Jr. has been chosen to serve as Senior Litigation Counsel. Lewen joined the U.S. Attorney’s Office in December 2007. Since then, Lewen has prosecuted a broad spectrum of complex cases, including large-scale drug trafficking and money laundering crimes, multi-million-dollar corporate fraud offenses, public corruption, and violent crimes, including bank robbery, extortion, kidnapping, and carjacking. In 2019, Lewen served a one-year international detail with the U.S. State Department to Timor-Leste, the youngest democratic nation in the Indo-Pacific, where he served as the U.S. Embassy’s Resident Legal Advisor, providing rule-of-law training and case-based mentorship to Timorese judges, prosecutors, and police. Prior to joining the U.S. Attorney’s Office in 2007, Lewen served for five years on active duty in the U.S. Army Judge Advocate General’s Corps, which included service in Korea, Hawaii, and Fort Bragg, N.C. Lewen received his law degree in 2002, from the Georgia State University College of Law, and in 1999, received his undergraduate degree in political science from Norwich University in Vermont, where he was the class valedictorian, a Distinguished Military Graduate, and a Rhodes Scholarship nominee.

 

Chris Poole has been chosen to serve as the Chattanooga Division Branch Chief. Poole joined the office in 2002, and, for the past 18 years, has focused on prosecuting violent crime. To that end, Poole presently serves as the office’s Project Safe Neighborhoods Coordinator and Anti-Gang Coordinator. Prior to his employment with the U.S. Attorney’s Office, Chris spent four years as an Assistant District Attorney in Hamilton County, Tenn., where he was a Criminal Court Division Supervisor. He received his undergraduate degree from Wake Forest University and his law degree from Georgia State University.

 

The Greeneville branch office continues to be supervised by Branch Chief Donald Wayne Taylor. Before joining the office as an Assistant U.S. Attorney in 2007, Taylor served as the Chief Assistant Commonwealth’s Attorney in Floyd County, Ky. He also has experience as an associate in a private law firm. He received a law degree from Widener University School of Law in Wilmington, Del., after receiving an undergraduate degree from Penn State University.

 

In the Civil Division’s Office, Loretta Harber remains Chief of the Civil Division. Harber, a native of Brooklyn, N.Y., and raised in Lexington, Ky, began in the office as an Assistant U.S. Attorney in 1987. She received her undergraduate and law degrees from the University of Tennessee. And, Robert C. McConkey, III continues to serve as Deputy Chief of the Civil Division. McConkey has been an Assistant U.S. Attorney with the office since 2010. Prior to joining the U.S. Attorney’s Office, he worked as an associate in private practice handling commercial and general civil litigation and served as a Deputy Law Director for Knox County, Tenn. He received his law degree from the Cumberland School of Law at Samford University after receiving an undergraduate degree from East Tennessee State University.

 

The U.S. Attorney’s Office for the Eastern District of Tennessee represents the interests of the United States in federal court in both civil and criminal matters. The eastern district is the largest federal district in Tennessee, with a population of more than 2.6 million, encompassing 41 of the state’s 95 counties, and spanning 420 miles. In addition to the headquarters office in Knoxville, there are branch offices in Chattanooga and Greeneville. U.S. Attorney Overbey, who was sworn in as the presidentially appointed, senate confirmed U.S. Attorney in November 2017, serves as the top-ranking federal law enforcement official in the district.

U.S. Special Representative for Afghanistan Reconciliation Ambassador Zalmay Khalilzad departed for travel to South and Central Asia as well as the Middle East on January 3.

 

In Doha he will meet with the two Afghan teams, encourage them, and offer U.S. support to accelerate the peace process — an immediate, significant reduction in violence and ceasefire and an agreement on a political roadmap and power-sharing as soon as possible.

 

In the region, Ambassador Khalilzad will encourage Afghanistan’s neighbors to support an end to the violence and a political settlement as soon as possible.

 

In Kabul, Ambassador Khalilzad will meet with Afghan leaders and convey U.S. support for the Afghan people and security forces.

 

During this trip, Ambassador Khalilzad will continue to encourage projects and plans for expanded regional connectivity, trade, and development which will be aided by an Afghan peace agreement and will help sustain peace.

NSA Director Rogers Disclosed FISA Abuse Days After Carter Page FISA Was Issued

On March 9, 2016, Department of Justice (DOJ) oversight personnel learned that the FBI had been employing outside contractors who had access to raw Section 702 Foreign Intelligence Surveillance Act data. These contractors retained access to the information after their work for the FBI was completed.

 

This information was disclosed in a 99-page April 26, 2017,FISA Court ruling that was declassified by Director of National Intelligence Dan Coats.

 

This was not an isolated incident and the improper access granted to outside contractors “seems to have been the result of deliberate decisionmaking.” (footnote – page 87).

 

The FISA Court noted the “FBI’s apparent disregard of minimization rules” and questioned “whether the FBI may be engaging in similar disclosures of raw Section 702 information that have not been reported.”

 

Section 702 permits the government to target foreign persons located outside the United States for surveillance with the purpose of acquiring foreign intelligence information. Oversight of Section 702 collection is conducted by the FISA Court. For more on Title III and Section 702 see here.

 

On the same day of the discovery of the FBI’s use of private contractors, FBI lawyer Lisa Page sent a text to FBI agent Peter Strzok; “Need to try to fix a HUGE who f-up.” Page quickly corrected her typo by texting “Wfo”—an abbreviation for the FBI’s Washington Field Office.

 

Page would later send another text on the same day, noting, “Need to go meet with andy again now.” Andy was then-Deputy FBI Director Andrew McCabe.

Following the discovery that outside contractors for the FBI were accessing raw FISA data, National Security Agency (NSA) Director Admiral Mike Rogers directed the NSA’s Office of Compliance to conduct a “fundamental baseline review of compliance associated with 702” sometime in early April 2016 (Senate testimony & page 83-84 of court ruling).

 

Rogers served concurrently as Director of the NSA, Commander of the U.S. Cyber Command, and Chief of the Central Security Service from April 2014 to May 2018. Rogers previously served as the director for Intelligence for both the Joint Chiefs of Staff and U.S. Pacific Command, and as Commander of the U.S. Fleet Cyber Command and the U.S. Tenth Fleet.

 

Rogers played a key role in uncovering the ongoing FISA abuse and his efforts are revealed in the April 26, 2017, FISA Court ruling. Significant changes to the handling of raw Section 702 FISA data resulted from the FISA Court’s findings.

 

On April 18, 2016, Rogers moved aggressively in response to the disclosures. He abruptly shut down all FBI outside contractor access. At this point, both the FBI and the DOJ’s National Security Division (NSD) became aware of Rogers’ compliance review. They may have known earlier, but they were certainly aware after outside contractor access was halted.

 

Despite an ongoing daily stream of messages between Strzok and Page, no texts from the specific day that Rogers halted contractor access to the NSA database have been made public. On the following day, April 19, 2016, Page sent a text that ended with “And still in with andy.” The version available is heavily redacted. Strzok responded, “Hi going to try and catch Bill.” This text refers to Bill Priestap, head of the FBI’s Counterintelligence Division. Later, Page responded again, “Still in with andy.”

 

The DOJ’s NSD maintains oversight of the intelligence agencies’ use of Section 702 authority. The NSD and the Office of the Director of National Intelligence (ODNI) jointly conduct reviews of the intelligence agencies’ Section 702 activities every 60 days. The NSD—with notice to the ODNI—is required to report any incidents of agency noncompliance or misconduct to the FISA Court.

 

Instead of issuing individual court orders, Section 702 requires the Attorney General and the Director of National Intelligence (DNI) to provide the Foreign Intelligence Surveillance Court (FISC) with annual certifications that specify categories of foreign intelligence information the government is authorized to acquire pursuant to Section 702.

 

The Attorney General and the DNI must also certify that Intelligence Community agencies will follow targeting procedures and minimization procedures that are approved by the FISC as part of the annual certification.

On Sept. 26, 2016, NSD Head John Carlin filed the Government’s proposed 2016 Section 702 certifications. Carlin knew the general status of Rogers’s compliance review. The NSD was part of the review.

 

In his filing, Carlin failed to disclose a Jan. 7, 2016, Inspector General report that was highly critical of agency controls for monitoring query compliance. Carlin also failed to disclose the FBI’s use of private contractors and Rogers’s ongoing compliance review.

 

On Sept. 27, 2016, the day after he filed the annual certifications, Carlin announced his resignation, which would become effective on Oct. 15, 2016.

 

On Oct. 4, 2016, a standard follow-up court hearing was held (Page 19). Carlin was present at the hearing. Again, Carlin made no disclosure of FISA Abuse or other related issues. This lack of disclosure would be noted by the Court later in the April 2017 ruling:

 

“The government’s failure to disclose those IG and OCO reviews at the October 4, 2016 hearing [was ascribed] to an institutional “lack of candor.”

 

On Oct. 15, 2016, Carlin formally left the NSD.

 

On Oct. 20, 2016, Rogers was briefed by the NSA compliance officer on findings from the 702 NSA compliance audit. The audit had uncovered a large number of issues, including numerous “about query” violations (Senate testimony).

 

On Oct. 21, 2016, Rogers shut down all “about query” activity. “About queries” are particularly worrisome. They occur when the target is neither the sender nor the recipient of the collected communication—but the target’s “query,” such as an email address, is being passed between two other communicants.

 

On the same day, Oct. 21, 2016, the DOJ & FBI sought and received a Title I FISA warrant on Trump campaign adviser Carter Page. At this point, the FISA Court was still unaware of the Section 702 violations.

 

Sometime between Oct. 21 and Oct. 24, 2016, Rogers reported his findings to the DOJ. From there, he presented his findings to the FISA Court (Senate testimony & inferences from court ruling):

ROGERS: I was briefed on something like October the 20th…I then, from memory, went to the Department of Justice and then on to the FISA Court at the end of October—I think it was something like the 26th of October—and we informed the court: we have a compliance issue here and we’re concerned that there’s an underlying issue with the technical solution we put in place.

 

LANKFORD: So you reported initially to the court, this is an issue, or the court initially came to you and said, we have an issue?

 

ROGERS: I went to the court and said, we have an issue.

 

Rogers’ recollection was correct. On Oct. 24, 2016, Rogers verbally informed the FISA Court of his findings (Page 4 of court ruling):

 

“On October 24, 2016, the government orally apprised the Court of significant non-compliance with the NSA’s minimization procedures involving queries of data acquired under Section 702 using U.S. person identifiers. The full scope of non-compliant querying practices had not been previously disclosed to the Court.”

 

On Oct. 26, 2016, Rogers appeared formally before the FISA Court and presented the written findings of his audit (Page 4, 14 & 19 of Court Ruling & Senate testimony).

 

“Two days later, on the day the Court otherwise would have had to complete its review of the certifications and procedures, the government made a written submission regarding those compliance problems…and the Court held a hearing to address them.”

 

“The government reported that the NSA IG and OCO were conducting other reviews covering different time periods, with preliminary results suggesting that the problem was widespread during all periods under review.”

 

The FISA Court was unaware of the FISA “query” violations until they were presented to the Court by NSA Director Rogers.

 

The NSD and FBI knew Rogers was conducting his own compliance review. Rogers knew the NSD was finalizing its 2016 Certification. The NSD was aware its 2016 Certification lacked material and legally required disclosure.

 

The NSD carries the “responsibility of overseeing the foreign intelligence, counterintelligence and other national security activities of the United States Intelligence Community.” Duties include “representing the government before the Foreign Intelligence Surveillance Court (FISC).” Additionally, the Operations Section of the NSD is “responsible for preparing and filing all applications for Court orders pursuant to FISA.” The original Page FISA application, along with the three subsequent renewals, carried a signature page from a DOJ attorney, whose name was redacted, but is almost certainly associated with the NSD.

 

Carlin had to be aware of the FISA application on Page that was being prepared by the FBI. His lack of disclosure of the FISA abuses in the annual Section 702 Certifications paved the way for the Page application to pass.

The FBI and the DOJ’s NSD were literally racing against Rogers’s investigation in order to obtain the FISA warrant on Page.

 

As all of this was transpiring, DNI James Clapper and Defense Secretary Ash Carter submitted a recommendation that Rogers be removed from his position as NSA Head. The move to fire Rogers, which failed, originated sometime in mid-to-late October 2016—exactly when Rogers was preparing to present his findings to the FISA Court.

 

Rogers knew the NSD had submitted their annual proposal to the FISA Court. Rogers also had to know of preliminary results from his compliance review before the Oct. 20, 2016, formal briefing from his NSA compliance officer.

 

So why didn’t Rogers provide an earlier, preliminary briefing to the FISA Court? To be clear, Rogers was not in any way assisting the FBI in obtaining the Page FISA. The information Rogers presented to the FISA Court was damning. It resulted in a complete overhaul of the FISA process and its underlying systems. The FISA Court was particularly critical of the FBI in its ruling.

 

The presiding judge of the FISA Court is Rosemary Collyer. Rogers presented his findings directly to her. Collyer and Rogers would work together for the next six months, addressing the issues Rogers had uncovered. It was Collyer who wrote the April 26, 2017, FISA Court ruling on the entire episode.

 

It was also Collyer who signed the original FISA Warrant on Carter Page on Oct. 21, 2016.

 

Rogers informed Collyer of the ongoing FISA abuses by the FBI and NSD just three days after she personally signed the Page FISA warrant.

 

To my knowledge, virtually every FBI and NSD official with material involvement in the original Page FISA application would later be removed in one fashion or another. One significant and potentially telling exception is Bill Priestap, who still holds his position as head of the FBI’s Counterintelligence Division.

 

Rogers formally retired on May 4, 2018, in a ceremony that paid honor to his service. Remarkable, given the Obama Administration tried to fire him well over a year earlier.

 

One other notable event transpired that directly involved Rogers.

 

On the morning of Nov. 17, 2016, Rogers traveled to meet President-Elect Trump and his Transition Team in Trump Tower. Rogers did not inform DNI Clapper of his meeting.

 

On the evening of Nov. 17, 2016, the Trump Transition Team announced they were moving all transition activity to Trump National Golf Club in New Jersey.

NATURE OF THE ACTION

 

1. This suit arises out of Defendant’s defamatory statements of and concerning

 

Plaintiff.

 

2. During 2000-2002, beginning when Plaintiff was 16, Plaintiff was the victim of

 

sex trafficking and abuse by convicted sex offender Jeffrey Epstein.

 

3. Epstein’s trafficking scheme involved recruiting young girls, often by claiming

 

they would be paid $200 for simply providing a massage to a wealthy billionaire. The young girl

 

would then be brought up to Epstein’s bedroom where Epstein would be on a massage table;

 

Epstein would then sexually abuse the girl. This same pattern was repeated numerous times with

 

numerous children.

 

4. “From between 1999 – 2007, Jeffrey Epstein sexually abused more than 30 minor

 

girls…in his mansion in Palm Beach Florida, and elsewhere in the United States and overseas…

 

In addition to his own sexual abuse of the victims, Epstein directed other persons to abuse the

 

girls sexually. Epstein used paid employees to find and bring minor girls to him. Epstein

 

worked in concert with others to obtain minors not only for his sexual gratification, but also for

the persons with whom Epstein acted in concert was Dershowitz.

 

5. Like other minor children who came before and after her, Plaintiff was initially

 

recruited to provide massages, and thereafter to engage in a variety of sexual acts, for Epstein.

Teacher Who Used Kik to Solicit, Receive and Distribute Child Pornography Sentenced to 70 Months in Prison

 

John H. Durham, United States Attorney for the District of Connecticut, announced that DYLAN KOERNER, 29, of New Britain, formerly of West Hartford, was sentenced today by U.S. District Judge Janet Bond Arterton to 70 months of imprisonment, followed by three years of supervised release for soliciting, receiving and distributing child pornography.

 

Pursuant to the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), the court proceeding occurred via videoconference.

 

According to court documents and statements made in court, between July 2019 and October 2019, Koerner used a false identity and posed as a teenager on Kik, an internet mobile application, to solicit nude photographs from Kik users who were minor females as young as 12 years old. He then traded those images with other Kik users to receive more images of child pornography.

 

On October 29, 2019, HSI agents executed a search warrant of Koerner’s residence and seized his cell phone, laptop and external hard drive. Analysis of the seized devices revealed approximately 121 unique images, nine unique videos depicting child pornography, and numerous images and video depicting child erotica.

 

After earning his teaching certification in 2018, Koerner worked as an elementary school music teacher in Hartford, and as a substitute teacher at various elementary, middle and high schools in Connecticut.

 

On September 21, 2020, Koerner pleaded guilty to one count of distribution of child pornography.

 

Koerner, who is released on a $100,000 bond, is required to report to prison on May 4, 2021

 

This investigation was conducted by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI). The case was prosecuted by Assistant U.S. Attorney Nancy V. Gifford.
