After he left office, former Palm Beach County State Attorney Barry Krischer did consulting for the Palm Beach County Sheriff’s Office and volunteered at the State Attorney’s Office.

After leaving office a decade ago, State Attorney Barry Krischer faded from the spotlight but remained entrenched in two agencies under scrutiny for cutting a deal with sexual predator Jeffrey Epstein.

Krischer has pocketed $112,000 as a consultant and instructor for the Palm Beach County Sheriff’s Office while also serving the State Attorney’s Office, now as a sworn assistant state attorney.

He also sat on the county’s Criminal Justice Commission until resigning a month after Sheriff Ric Bradshaw, a political ally, asked the agency to review the sheriff’s work-release program. The sheriff had drawn criticism over the 2008 decision to let Epstein out of jail 12 hours a day, six days a week.

Q. Let's change gears here. Now, I understand your limitations in answering questions about an issue that is now before the appellate courts, butRush Limbaughand his lawyer, Roy Black, have been very vocal in their criticisms of your investigation into whether Limbaugh sought overlapping prescriptions from various doctors and whether he committed a crime. Can we talk about, in general terms, search warrants vs. subpoenas in seeking medical records? You got Limbaugh's records through a search warrant. He argues that the legal way to get those records is through a subpoena. What's the difference?

A. A subpoena would be issued by this office under the authority of this office. To issue a subpoena merely requires a showing that it is a lawful police investigation so if you want to know who's talking to your daughter on the telephone, you can't get a subpoena for that. All I have to do is make a showing that this is a legitimate police investigation, and I can issue a subpoena.

A search warrant, on the other hand, requires a showing of probable cause to believe a crime has been committed and the target is probably the perpetrator. It is reviewed by a judge, approved by a judge and signed off by a judge. So there's obviously greater protection afforded to people when a judge makes that decision, as an obviously independent judicial officer. The fact is the U.S. Supreme Court and the Constitution view search warrants as the method to protect rights of citizens and to ensure the integrity of the investigative agency.

Q. How long do you think it'll take before the appeals court rules?

A. There's no telling. I never would have believed they would have taken this long. But they're obviously determined to do a first-rate job on the opinion because, obviously, the opinion is going to get a lot of scrutiny. It's fine with me if they don't rush. As they said, "We may not be fast, but we get it right."

Barry Krischer has been the Palm Beach County state attorney for the past 12 years and was re-elected unopposed when filing closed July 16. Prosecution of juveniles has given him a high national profile.
