Chairman Graham Releases Information from DNI Ratcliffe on FBI’s Handling of Crossfire Hurricane

 

WASHINGTON – Senate Judiciary Committee Chairman Lindsey Graham (R-South Carolina) today released a letter from Director of National Intelligence (DNI) John Ratcliffe. DNI Ratcliffe responded to Graham’s request for intelligence community information regarding the FBI’s handling of Crossfire Hurricane.

 

DNI Ratcliffe provided the following declassified information to the committee:

 

“In late July 2016, U.S. intelligence agencies obtained insight into Russian intelligence analysis alleging that U.S. Presidential candidate Hillary Clinton had approved a campaign plan to stir up a scandal against U.S. Presidential candidate Donald Trump by tying him to Putin and the Russians' hacking of the Democratic National Committee. The IC does not know the accuracy of this allegation or the extent to which the Russian intelligence analysis may reflect exaggeration or fabrication.”

“According to his handwritten notes, former Central Intelligence Agency Director Brennan subsequently briefed President Obama and other senior national security officials on the intelligence, including the ‘alleged approval by Hillary Clinton on July 26, 2016 of a proposal from one of her foreign policy advisors to vilify Donald Trump by stirring up a scandal claiming interference by Russian security services.’”

“On 07 September 2016, U.S. intelligence officials forwarded an investigative referral to FBI Director James Comey and Deputy Assistant Director of Counterintelligence Peter Strzok regarding ‘U.S. Presidential candidate Hillary Clinton's approval of a plan concerning U.S. Presidential candidate Donald Trump and Russian hackers hampering U.S. elections as a means of distracting the public from her use of a private mail server.’”

 

“I appreciate DNI Ratcliffe responding to my request for any information concerning all things Russia in the 2016 campaign, not just alleged Trump-Russia involvement.

 

“Director Ratcliffe will make this information available in a classified setting. I will try to review the material as early as today.

 

“This latest information provided by DNI Ratcliffe shows there may have been a double standard by the FBI regarding allegations against the Clinton campaign and Russia. Whether these allegations are accurate is not the question. The question is did the FBI investigate the allegations against Clinton like they did Trump? If not, why not? If so, what was the scope of the investigation? If none, why was that?

FBI failed to inform FISA Court, Continued to Seek FISA Warrants

 

WASHINGTON – Senate Judiciary Committee Chairman Lindsey Graham (R-South Carolina) today released a letter from Attorney General William Barr and a declassified summary from the Federal Bureau of Investigation (FBI) that indicate Christopher Steele’s Primary Sub-source was a likely Russian agent and had previously been the subject of an FBI counterintelligence investigation.

 

In response to Graham’s request for oversight of the reliability of the Steele dossier, the Justice Department recently declassified a key footnote in Inspector General Horowitz’s report. The footnote states Christopher Steele’s Primary Sub-source “was the subject of an FBI counterintelligence investigation from 2009 to 2011 that assessed his/her documented contacts with suspected Russian intelligence officers.”

 

“To me, failure of the FBI to inform the court that the Primary Sub-source was suspected of being a Russian agent is a breach of every duty owed by law enforcement to the judicial system.”

 

The FBI summary provided to the committee reveals that the Crossfire Hurricane team was aware of this information in December 2016, yet failed to inform the Foreign Intelligence Surveillance Court.

 

Further, they continued to seek three FISA warrant applications using the Steele dossier as a basis.

The Crossfire Hurricane team knew in December 2016 that Christopher Steele’s Primary Sub-source was an individual who the FBI had indicated in 2009 “could be a threat to national security.”

In May 2009, Steele’s source reportedly attempted to recruit two individuals connected to an influential foreign policy advisor connected to President Obama, offering that if the two individuals “‘did get a job in the government and had access to classified information’ and wanted ‘to make a little extra money,’ [Steele’s source] knew some people to whom they could speak.”

FBI databases revealed Steele’s source “had contact in 2006 with the Russian Embassy and known Russian intelligence officers, [including contacting a known Russian intelligence officer] ‘so the documents can be placed in tomorrow’s diplomatic pouch.’”

One individual interviewed by the FBI noted that “the Primary Sub-source persistently asked about the interviewee’s knowledge of a particular military vessel.”

Significantly, the “record documenting the closing of the investigation [of the Primary Sub-source] stated that consideration would be given to re-opening the investigation in the event that the Primary Sub-source returned to the United States.”

House Speaker Nancy Pelosi (D-CA) on Friday defended what is expected to be a small inauguration for President-elect Joe Biden (D) next week, emphasizing that the scaled-down event is “not a concession to the terrorists,” but a “recognition of the danger” of the Chinese coronavirus.

 

“For a long time now, weeks, it has been determined that we would have a very small inauguration because of COVID,” Pelosi told reporters during Friday’s press conference, adding, “that in order to have the distancing and the rest on the platform and then some people down below, it would be necessary to limit it,” she continued.

 

Pelosi said it is “most disappointing” because “we’re excited about nominating a new President of the United States, but not at the risk of people’s health and well-being and, indeed, their lives.”

 

“So this is always going to be small,” she said before mentioning the Capitol protests that occurred on January 6, adding that it necessitates additional security.

 

“Now, with the insurrection of last week, it is necessitated by security to have more security but hasn’t changed the nature of the swearing-in,” the 80-year-old lawmaker said.

 

“I think it’s important for people to know that,” she continued. “This is not a concession to the terrorists. It is a recognition of the danger of COVID.”

 

The inauguration is expected to be fairly unconventional, with the inaugural committee announcing this month that Biden will have a “virtual” parade, forgoing the traditional march because of coronavirus-related concerns.

 

President Trump will not attend Biden’s inauguration and is expected to leave the White House that morning. He will reportedly hold a farewell event at Joint Base Andrews before heading to Florida.

But in 2016 when there was a similar counterintelligence threat to the Trump campaign, FBI leadership failed to give a defensive briefing to the Trump campaign, opting instead to open the Crossfire Hurricane investigation and relentlessly pursue FISA warrants targeting the Trump campaign.

 

“There was a clear double standard by the Department of Justice and FBI when it came to the Trump and Clinton campaigns in 2016.

 

“These newly released documents indicate that a foreign government was trying to influence the Clinton campaign through a campaign associate and the FBI was seeking a FISA warrant. However, the Bureau, as it is supposed to do, required that Hillary Clinton be defensively briefed about the matter so she could engage in corrective action.

 

“When it came to the Trump campaign, there were four counterintelligence investigations opened against Trump campaign associates. Not one time was President Trump defensively briefed about the FBI’s concerns.

 

“Even more egregious, when the FBI gave a generic briefing to the Trump campaign about foreign influence, not only did they fail to mention the specific concerns about Trump associates, they sent an FBI agent into the briefing to monitor President Trump and General Flynn.

 

“The FBI used the generic briefing as an intelligence gathering tool, which I believe to be inappropriate and shameful.

 

“The FBI did the right thing by briefing Clinton and failed to do the right thing by never specifically briefing President Trump about their concerns.

 

“Counterintelligence investigations are designed to protect American interests from foreign influence. They are not criminal in nature.

Pennsylvania Lt. Governor John Fetterman (D) on Friday said President Trump does not have the right to say the election was stolen.

 

According to Fetterman, saying the election was stolen or rigged is not protected under the 1st Amendment.

 

“This idea that saying that Pennsylvania was ‘rigged’ or that we were ‘trying to steal the election’ — that’s a lie. And you do not have the right, that is not protected speech,” Fetterman said.

Judiciary Committee Releases Declassified Documents that Substantially Undercut Steele Dossier, Page FISA Warrants

 

WASHINGTON – Today, as part of the Senate Judiciary Committee’s ongoing investigation into the Crossfire Hurricane investigation and related FISA abuses, Chairman Lindsey Graham (R- South Carolina) released two recently declassified documents that significantly undercut the reliability of the Steele dossier and the accuracy and reliability of many of the factual assertions in the Carter Page FISA applications.

 

“I’m very pleased the investigation in the Senate Judiciary Committee has been able to secure the declassification of these important documents,” said Chairman Graham. “I want to thank Attorney General Barr for releasing these documents and allowing the American People to judge for themselves.

 

“What have we learned from the release of these two documents by the Department of Justice? Number one, it is clear to me that the memo regarding the FBI interview of the primary sub-source in January 2017 should have required the system to stop and reevaluate the case against Mr. Page.

 

“Most importantly after this interview of the sub-source and the subsequent memo detailing the contents of the interview, it was a miscarriage of justice for the FBI and the Department of Justice to continue to seek a FISA warrant against Carter Page in April and June of 2017.

 

“The dossier was a critical document to justify a FISA warrant against Mr. Page and this DOJ memo clearly indicates that the reliability of the dossier was completely destroyed after the interview with the primary sub-source in January 2017. Those who knew or should have known of this development and continued to pursue a FISA warrant against Mr. Page anyway are in deep legal jeopardy in my view.

 

“Secondly, the comments of Peter Strzok regarding the February 14 New York Times article are devastating in that they are an admission that there was no reliable evidence that anyone from the Trump Campaign was working with Russian Intelligence Agencies in any form.

 

“The statements by Mr. Strzok question the entire premise of the FBI’s investigation of the Trump Campaign and make it even more outrageous that the Mueller team continued this investigation for almost two and a half years. Moreover, the statements by Strzok raise troubling questions as to whether the FBI was impermissibly unmasking and analyzing intelligence gathered on U.S. persons.
