Possible what gets triggered are the military tribunals to deal with anybody collaborating with a foreign power to overthrow the government. In this way, POTUS does not need the civil courts to deal with the worst offenders.
An Emergency Government might also be correct to use the courts to deal with the issue of election fraud to avoid a new election. There is more than enough evidence to prove fraud, all that is needed is for the SCOTUS to hear the evidence.
Can Military Tribunals Prosecute Civilians?
Apparently, civilians can be prosecuted in Military Tribunals. Or, so US Supreme Court Justice Brett Kavanaugh says while facing a tough confirmation process.
According to Supreme Court, Justice Brett Kavanaugh’s testimony during his Senate Confirmation Hearing said there is sufficient existing precedent to try, convict, and punish civilians guilty of sedition or treason if they conspire with a foreign government against the US.
Still, in effect, the US entered the “War on Terrorism,” by Congressional authority on September 14th, 2001.
Any US citizen or group conspiring against the US with a foreign country can be tried in a Military Tribunal using their separate body of law called “Armed Conflict,” instead of “Criminal Law.”
A “Death Penalty” is possible.
