The OIG can never do a criminal prosecution, only referrals.

So by definition it would need to be the DOJ that declined.

Given the charges, that only makes sense if the person is cooperating.

 

It could be McCabe - but I don't think he gets off. He's too central. Probably Rybicki or Brower.
