Chief Justice John Roberts says he does not want to preside over a second sham Senate impeachment hearing against President Donald Trump.

 

Democrats want to impeach President Trump after he leaves office which has never happened in US history.

 

Democrats are desperate in their attempts at destroying President Trump. They want payback for him exposing their corruption and failures for four years.

Chief Justice John Roberts is eager to avoid presiding over Donald Trump’s second impeachment trial – after he became a lightning rod during the first one.

 

Just as the Senate is seeking to ascertain how it might proceed with an impeachment trial without blowing up the start of Joe Biden’s term, the Supreme Court could face its own business being rearranged.

 

The Constitution states that ‘When the President of the United States is tried the Chief Justice shall preside.’

 

But with the Senate having been in recess since the House voted to impeach, the trial will occur when Trump is no longer in office – potentially giving Roberts an out.

 

For the record… Harvard law professor Alan Dershowitz insists Democrats cannot impeach President Trump saying you can’t impeach an official who is no longer in office.

Biden Administration To Label Pro-Trump Military Members As ‘Far Right Extremists,’ Will Remove From Ranks

 

"These people are not representative of our country's military," said General Mark A. Milley, the chairman of the Joint Chiefs of Staff.

 

The Pentagon is investigating veterans and members of the military who were in the crowd during the Capitol building breach on January 6 to combat and identify “white supremacy” and “far-right extremism.” This comes as over 25 thousand troops have been deployed in DC to provide security for the inauguration of Joe Biden due to alleged “external security threats.”

 

So far, the FBI has identified six people with “military links” throughout the early stages of their investigation into the events that took place at the US Capitol on January 6, according to the New York Times.

 

“These people are not representative of our country’s military,” said General Mark A. Milley, the chairman of the Joint Chiefs of Staff. “There was some indication that an unknown number of veterans associated with the insurrection.”

Pence, other GOP officials expected to skip Trump send-off

 

 

Vice President Pence is not expected to attend a send-off for President Trump at Joint Base Andrews on Wednesday, joining a host of other GOP officials who have declined to see the president off for his official departure from the White House.

 

Trump will leave the base about 8 a.m. on Wednesday for Florida. Officials are planning a formal ceremony for the president, who is declining to attend his successor's inauguration in a break with more than a century of tradition.

 

Pence is slated to attend the inauguration of President-elect Joe Biden, and as a result will not be at the Air Force base. Officials cited the logistical challenges of getting between the two events. Biden is scheduled to be sworn in at noon Wednesday.

 

The top two Republicans in Congress — House Minority Leader Kevin McCarthy (Calif.) and Sen. Mitch McConnell (Ky.) — are also not planning to attend Trump's send-off. McCarthy and McConnell have also been invited by Biden to attend a pre-inauguration church service Wednesday morning.

 

Instead, the ceremony will likely be taken in by Trump's family, closest aides and some supporters, reflecting how some in the GOP have tried to distance themselves from the president after Jan. 6 riot at the Capitol.

 

The White House declined to comment on how many guests are anticipated to be at Trump's farewell. One former administration official anticipated roughly 200 people in total would be there.

 

Several former aides who have since become outspoken critics of the president were invited and given the opportunity to bring up to five guests.

 

Former national security adviser John Bolton, who has said since leaving the White House in 2019 that he does not believe Trump is fit to be president, was invited, as was Bolton's former deputy, Charles Kupperman. Neither will attend.

 

Anthony Scaramucci, who served 11 days as White House communications director before being fired, told "Inside Edition" that he was invited, too, in what he took as a sign that staff were looking to beef up attendance for the image conscious Trump.

 

"Trust me, that had to be a mass email if one of them got sent to me,” Scaramucci said.

 

CNN reported that former White House chief of staff John Kelly was also invited and would not attend. Kelly said earlier this month that he would vote to remove Trump from office under the 25th Amendment if he were still in the role.

 

Trump has been shunned by some of the party's top officials after the riot at the Capitol earlier this month, which came after the president spent weeks sowing doubt about the legitimacy of his election defeat.

 

The president held a rally near the White House on Jan. 6, where he told supporters to show strength and walk to the Capitol to tell lawmakers to halt the process of certifying Biden's victory. A short time later, pro-Trump rioters overwhelmed law enforcement and stormed the complex, damaging the building and forcing evacuations.

Incitement Or Free Speech? Comey Calls For The Republican Party To Be "Burned Down"

 

There is an interesting interview this week with former FBI Director James Comey. He states that he now believes that the infamous alleged “pee tape” may be real and makes other surprising statements while pitching his new book.

 

One statement, however, stood out:

 

“The Republican party needs to be burned down … It’s just not a healthy political organization.”

 

Since the Republican National Committee was targeted with a pipe bomb in the recent riots, some could argue that this is incitement to arson or violence. I would not. I would call it free speech and hyperbole. The question is where the line is drawn given the impeachment of Donald Trump based on his speech and the allegations that others who used such hyperbolic language are actually guilty of incitement.

 

As I have previously stated, I condemned Trump’s speech in a series of tweets while it was being given and I called for a bipartisan vote of censure over his responsibility in the riots. However, I opposed the use of a snap impeachment by the House and raised concerns over the framing of the article of impeachment as an “incitement to insurrection.” Despite the chorus of legal experts insisting that the speech would constitute a strong case for criminal incitement (and the DC Attorney General said he may charge Trump), I believe such a prosecution would eventually collapse on free speech grounds if based solely on this speech and Trump’s other public statements.

 

Comey is not alone in the use of such rhetoric in today’s super-heated political environment. We previously discussed how conservatives have pointed to Rep. Maxine Waters (D-Calif.) calling for people to confront Republican leaders in restaurants; Rep. Ayanna Pressley (D-Mass.) insisted during 2020’s violent protests that “there needs to be unrest in the streets,” while then-Sen. Kamala Harris (D-Calif.) said “protesters should not let up” even as many protests were turning violent. They can all legitimately argue that their rhetoric was not meant to be a call for violence, but this is a standard fraught with subjectivity.

 

The question is whether Comey would be charged under this same logic if the RNC building was attacked again and actually burned down. That would be obviously ridiculous. However, where is the line drawn? Free speech demands bright lines and those are being erased in our cancel culture from universities to the media to Congress.

 

The interview also had this remarkable statement on the allegation in the Christopher Steele dossier that the Russian government had a video of Trump watching sex workers urinate on each other in a Moscow hotel room in 2013:

 

“It came to us in late September. We had information since the summer with which it was consistent and I didn’t know what to make of it, but, because it was from a source who had a track record with the FBI, our team dove into it to see if they could replicate it. I still don’t know. I actually think the Senate intelligence committee report, coupled with [former Trump lawyer] Michael Cohen’s account in his book, probably makes the ‘pee tape’ stuff more likely than it was when I was fired.”

 

That is an extraordinary assertion based on a widely discredited dossier and the equally discredited Michael Cohen. Comey does not cite what in the Senate intelligence report gives credence to the allegation.

 

Comey does make a point that I agree with. He does not understand how the rioters gained access to the Capitol and he wants an investigation. I voiced the same suspicion the day of the riot. All of these questions should be answered in a full and transparent way.

 

The call for a commission is far more constructive than Comey’s version of the “burn baby burn” mantra.

Sidney Powell Asks Supreme Court to Dismiss Her Case from Georgia

 

Today attorney Sidney Powell asked the US Supreme Court to dismiss her challenge to the presidential election results in Georgia.

 

The Washington Examiner reported:

 

 

With just hours to go before President-elect Joe Biden’s inauguration, Trump ally Sidney Powell dropped her remaining challenges to the presidential election results in Georgia.

 

Powell on Tuesday requested that the Supreme Court dismiss a case that she had appealed up to the high court in December. The court last week denied Powell’s request for it to expedite the case, a decision that came nearly a week after Congress certified Biden’s win in the Electoral College. The Supreme Court also denied expedition for election challenges raised by Georgia lawyer Lin Wood and Pennsylvania Rep. Mike Kelly.

 

Of course Powell knows that there was broad voter fraud in the state of Georgia which ended up stealing the election for Joe Biden in that state. It is unknown why she is asking to dismiss this case.

 

Powell issued the case in Georgia right after the US Supreme court decided not to hear the Texas case related to the stolen election.

 

Powell’s requested dismissal of her case in Georgia is puzzling. Has the Trump team given up or is there some other reason Powell requested the case be dismissed?
