What if they were waiting to go to court as a private citizen? If SCOTUS says there was no standing for the states. They would HAVE to say that Trump himself has standing and suffered a tragic grievance.
That path probably goes through friendlier courts. Gets the evidence documented. Then, a slam dunk case with SCOTUS with all of the evidence laid out bare.
How strong would a case would this be?
